R94-78RESOLUTION NO. R94-~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A TRANSPORTATION AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND THE SCHOOL BOARD OF PALM BEACH COUNTY, FLORIDA, PROVIDING BUS SERVICE FOR THE BOYNTON BEACH SUMMER DAY CAMP PROGRAM; AND PROVIDING AN EFFECTIVE DATE° WHEREAS, the City Commission of the City of Boynton Beach, Florida is desirous of entering into an Agreement with the School Board of Palm Beach County, to provide Opportunities of a recreational nature for the children of Boynton Beach Summer Day Camp Program; and WHEREAS, said Agreement between the parties has now been reduced to writing; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The Mayor and City Clerk are hereby authorized to execute an Agreement between the City of Boynton Beach and the School Board of Palm Beach County, Florida, providing for school buses and drivers for trips organized and supervised by the City of Boynton Beach Recreation Department/Summer Day Camp, which Agreement is attached hereto as Exhibit "A". ATTEST: Ci~ff Clerk -- CITY OF BOYNTON BEACH, FLORIDA Mayor ~/ (Corporate Seal) Authsig.WP5 Rec.DayCamp 4/27/94 TRANSPORTATION AGREEMENT (As required by 234.21112) (a) Florida Statutes This agreement, made and entered into this 25th day of April ., 1994, by and between the SCHOOL BOARD OF PALM BEACH COUNTY, FLORIDA, a public school corporation herein referred to as "BOARD" and The City of Boynton Beach , a political subdivision of the State of Florida, hereinafter referred to as the "City!' Whereas the "BOARD" owns and operates school buses and whereas the "BOARD" recognizes the need on occasion, for other parties to utilize those buses to provide.opportunities of a recreational nature for the child~en.~of Boynton Beach Summer Day Camp Proqram. Provision of Buses The "BOARD" agrees to provide school buses and drivers for trips organized and supe~;ised by The City of Boynton Beach Recreation Department/Summer Day Camp (government entity) during the time period of Jnne Ju_~B_~y_, and ~,,g,,~ .,t~84;- . Compensation The City agrees to fully compensate the BOARD for these bus trips. These costs include the driver's salary at Twenty (20) dollars per hour and charge of $1.00 per mile. Liability Insurance The City (government entity) agrees to provide the ,,BOARD" with a certificate of insurance naming the "BOARD" as an additional insured on the City (government entity's) automobile liability insurance policy with regard to the .BOARD'S" buses· If the City (government entity) elects to self-insure the liabilities under paragraph 4, the City (government entity) agrees to provide the "BOARD" with written acknowledgement that these liabilities will be covered by the self-insurance plan. Indemnification (As required by 234.211(2) (a)) The City (government entity) shall indemnify and hold harmless the "BOARD" from any and all liability, claims, lawsuits, damage and expenses (including attorney fees) related to loss of life, bodily injury, property damage (including loss of use thereof) directly or indirectly caused by, resulting from, arising out of or occurring in connection with the use of such buses per this agreemenn. This paragraph is authorized by Chapter 234.211 subject to Chapter 768.28 of Florida Statutes. and Damaqe to School Buses in Use Pursuant to This A~reement The City, (government entity) agrees to be responsible for accidental damage to the "BOARD'S" school bus directly or indirectly caused by, resulting from, arising out of or occurring in connection with the use of the buses. 6. Res-~onsibilit- The requesting government entity shall be solely responsible for the safety and well being of those being transported. Procedure for ReGuestinG Use of School Buses Ail requests for the use of school buses by government entities will be initiated in writing and directed to the principal (or his/her designee) for community education at a local community school. After the aforementioned conditions have been met, the assistant principal for community education will forward the request to the Transportation Department. The money to financ~ the trips must flow from the government entity to requesting school to the Transportation Department. This agreement shall become effective upon official approval of both parties. Approved as to form: Dr. C.
