A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE A SERVICE CONTRACT
BETWEEN THE CITY OF BOYNTON BEACH AND
HARDRIVES, INC., OF DELRAY BEACH,
FLORIDA, FOR THE SALE AND REMOVAL OF LIME
SLUDGE AT THE WATER TREATMENT PLANT; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, upon recommendation of staff, for the past several
years the Contract for the sale and removal of lime sludge has been
extended to Hardrives, Inc., of Delray Beach, Florida; and
WHEREAS, the City Commission of the City of Boynton Beach,
Florida has deemed it to be in the best interests of the citizens
and residents of the City to renew the Contract with Hardrives,
Inc., of Delray Beach, Florida for one year.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section i. The Mayor and City Clerk are hereby authorized
and directed to execute a Service Contract between the City of
Boynton Beach, Florida and Hardrives, Inc., of Delray Beach,
Florida, said Agreement being attached hereto as Exhibit "A".
Section 2. This Resolution

SERVICE CONTRACT
This agreement dated ..~' day

by and between the CITY OF BOYNTON BEACH, PALM BEACH COUNTY,
FLORIDA, hereinafter called the Owner, and
HARDRIVES, INC. OF DELRAY
(a corporation organized and existing under the laws of the State
of FLORIDA ) and hereinafter called the Contractor.
WITNE$SETH: The Owner~and the Contractor, for the
consideration stated herein, agree as
ARTICLE I: SCOPE OF WORE
The Contractor shall perform all

all in strict accordance with the specifications, including any and
all Addenda, and in strict compliance with the Specification
documents hereinafter enumerated.
It is understood and agreed that said labor, materials, tools,
equipment and service shall be furnished and said work performed
and completed under the direction and supervision and subject uo
the approval of the Owner or its authorized representative.
However, the Contractor shall retain his identity as an independent
contractor and no wise shall be considered an agent of the Owner.
ARTICLE II: CONTRACT PRICE
The Contractor shall pay the Owner as-jusn compensation for
the LIME SLUDGE as provided in the Specifications Documents for the
following unit prices. The Contract amounn is One Dollar and
Sevenny-six Cents/Price Der cubic yard of Lime Sludqe ($1.76)
based upon unit lump sum prices herein contained. The undersigned
Bidder agrees that he has carefully inspected the site and is
thoroughly familiar with all conditions therein. The Bidder
further agrees no commence removal within nwenty-four {24) hours
after notification.
IN WITNESS WHEREOF, The parties hereto have caused this
agreemen5 to be executed as of the day and year first above-
