A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
APPROVING THE AWARD OF A BID FOR
REPLACEMENT OF TWO EXISTING ELEVATED
STEEL TANKS, IN THE AMOUNT OF
$2,201,780.00; AUTHORIZING AND DIRECTING
THE MAYOR AND CITY CLERK TO EXECUTE A
CONTRACT BETWEEN THE CITY OF BOYNTON
BEACH AND CROM CORPORATION; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, bids were received for proposals to design and
build the Concrete Elevated Storage Water Tanks, to replace
two existing elevated steel tanks for more water storage, Bid
No. 011-401-94/VSMG; and
WHEREAS, the City Commission of the City of Boynton
Beach, Florida, upon recommendation of staff, has deemed it to
be in the best interests of the citizens and residents of the
City of Boynton Beach, Florida to award the bid to THE CROM
CORPORATION as the most responsive and responsible bidder
meeting specs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida, hereby approves the award of a bid for the
replacement of two existing elevated steel tanks to THE CROM
CORPORATION and authorizes and directs the Mayor and City
Clerk execute a Contract between the City of Boynton Beach and
The Crom Corporation, a copy of which is attached hereto as
Exhibit "A".

hereinafter described, and said Commission having canvassed said proposals, has

submitted, and has authorized the execution of this contract.
NOW, THERe-gORE, in consideration of these premised and the mutual
conditions and covenants contained herein, the parties ague. as follows:
1.0 Agreement
1.1 The CITY does award the conwact to and does hire and employ the
Design/Builder and the Design/Builder does accept the award, predicated upon the pro-
posal and negotiat~l total proJeCt cost of the Design/Builder, dated Januarlz 6, 1994
which is hereby incorporated by reference into this agreement, and the Design/Builder
does agree to furnish the necessagt labor, tools, eqmpment, materials and supplies,

2.0 Scope of Service. s
2.1 Design/Builder ful~her agrees to desigu and permit the facilities and furnish
all materials, supplies, machines, equipment, tools, suporintendents, labor, insm~mce, and
other accessories and services necessary to complete said project in-acoordance ~'ith the
conditions and prices as s~t~ in the contract condifions~ supplemental general~ conditions
and spec/al conditions of the contract, and ~written explanatory,matter thereof as contained
in the request for proposal, contract documents and performance specffications for the
project.
2.2 All the work and labor, performed under this contract shall be performed,
and all of the material furnished shall be, in strict conformity with said proposal and
pefformanc~ spec/ficafiens, and contractor a~epts and consents to the conditions
contained in saki proposal and performance specifications and expressly agrees to comply
with every requirement and stipulation, therein contained to be perforined by: the party
contracting to do said work.
2.3 The Design/Builder further agrees to furnish ail tools, equipment, materials
and supplies and to do all the work above mention in a first-class, substantial and
workmanlike manner, and in conformity with the details for said work on file in the
office of the BOYNTON BEACH UTILITY DEPARt, for CITY and strictly in
accordance with the specifications, general stipulations and plans which are hereby
referred to and made a pan of this contract, as well as to the satisfaction of the City
Commission and the CITY MANAGER of the said CITY, and in strict obedience with
the directions which may be given by the said CITY MANAGER or his authorized
representative, at and for the priced herein plainly set forth.
2.4 Upon receipt of written notification from the CITY, to correct any
defective or faulty work or materials which may appear within one (1) year after com-

pletion of the contract and receipt of final payment. Design/Builder shail make the

2.9 Upon completion of the work, the DIRECTOR OF ~ shall

accordance with the plans, specifications and contract document. When the DIRECTOR

3.1 Design/Builder hereby agrees to commence work under this contract on or

3.2 Tune is the essence of the contract. In the event the Design/Builder shall

time limit set forth in thecontract, after due allowance for any extension or extensions of
time made in accordance with provision he~=inbefore set fonh~ the Design/Builder shall
be liable to the CITY, as liquidated damages and not as a penalty, in the amount
stipulated therefore in the special conditions or in other contract documents for ~ach and
every calendar day,that the Design/Builder shall be in default of completion. The CITY
shall have the right to deduct said liquidated damages from ,any amount due. or that may
become due the Design/Builder, or to collect such liquidated damages from the
Design/Builder or his Surety.
3.3 Design/Builder shall, as soon as practicable, aiter signature of contract,
notify Director of Utilities in writing of nantes of subcontractors proposed for principal
part of work, and for .such others as Director of Utilities may direct, and shall not
employee any that architect may, within a reasonable time, object to as incompetent or as
unfit.

6.0 Indenmification
6.1 The Design/Builder:shalldndcmnifyr and save harmless and defend the
CITY; its :agenu, servants; and employees from and against: any claim, demand, or cause
of action of whatsoever kind or namm arising out of error, omission or negligent act of
Design/Builder, its agents, servants, or employees in the performance of services under
this Agreement.
6.2 ' :' Design/BUilder shall indemnify and save hanrdeSs and defend City, its
agents; servants, and employees from and. agaimfit any and all causes, claims, demands,
actions, losses,- liabilities, :settlements, judgements, damages, costs, expenses, and fees
(including without limil~ion~a'easonabl¢, attorney's and ~:attorney's fee,s) of
whatsoever kind or nature for damages tO persons:or ixopeny mused in whole or in pan
by any act, omission, or default of the City, its agents, servants, or employee~ arising
and covenant ~that the DeSi~nilder ,has mcorpotated~m its on~ :proposal, which
constitutes the e, ontract sum payable by the City to the Design/Builder, specific additionai
consiclcration provided for in this t~ragraph. It is the City's and Design/BUilder's full
intention~that ,this provision .~hall ,be enforceable.and: imid provision shall :be in compliance

6.3 The execution of this Agreement by the Design/Builder shall obligate
Design/Bulider to comply va~th ~ foregoing ~demnification provision, as well as the
insurance providons/whiCh are set forth in Supplemental Conditions. However, the
indemnification prox~sion, and the insurance provision contained in this Contract are not
interdependent of each other, each one is ,~0arate and distinct from the other.
6.4 The obligation of the De~-gn/Builder to indemnify the City is not subject to
any offset, limitation or defense as a result'of any insurance proceeds available to either
the City or thc Design/Builder.

8.4 The value of any change ordered under the ConUact for extra work and/or

Records of extra work done shall be reviewed at the
end of each day by the Design/Builder and the

done under the Change Order. Duplicate copies of

Deign/Builder and the Owner and one copy retained
by ench.
8.5 Claim of payment for extra work shall be submitted by the Design/Builder
upon certified statement supported by receipted bills. Such statements shall be submitted
for the current Contract payment for the month in which thc work was done. No claim
for extra work shall be allowed unless the same was ordered, in writing, as aforesaid and
the claim presented at the time of the first estimate after the work is completed.

14.0 Remedy for Delay
14.1 In the event of any delay in the pwject caused by any act or omission of
the City, its agent or employees~ by the act or omission of any other party, or delay
caused by w~ther conditions or unavailability of materials, the sole remedy avalhhle to
Design/Builder shall be by extension of the time allocated to complete the pwject. No
moneta~ damages, shall'be claimed or aWaixied to CcotlaCtor in a.ssodafion with any
delay in the project caused by an act or omission of the CITY, its agents or employees,
by the acto~ omiss/on of any other.pany~ or dehy caused by weather conditions o~

14.2 Failure on the Part~of~I}~gn/Builder to process a written request for an
extension of time to complete the work within 10 business days of the acts occurrence or
omission which is the re.on for the request, shah constitum a waiver by Design/Builder
and Design/Builder shall be held responsible for completing the work within the time
ahecated by this project.
14.3 All request~ for extension of time to complete the work shall be made in
accordance with the Genera/and Spec/al Conditions.
14.4 For the purpose of this section, the phrase "the City, its agenta and
employees' shall inclUde but shah not be 1/m/ted to the arch/tect, project manager, and

negotiation meeting of January 20, 1994 with the selection committee. They were
confirmed and in some cases more clearly defined by your letter of January 26, 1994.
Access door at base of pedestal .................. Add $1,700
The City has requested a double door at the I~as~ of the pedestal. The extra
costs result from the increased direct material costs, an increase in the labor and
changing the structural requirements of the concrete around the doorway.
Ventilation vents atthe base of the pedestal ............. ~Add $3,150
To improve ventilation, if the bottom area is used for storage/workshop space, we
have estimated four 24" x 36" aluminum vents with weatherproof vanes to be
alaced at 90° approximately 12' above the foundation level. This includes the
structural strengthening in the pedestal concrete around the vents. A catalog
description of a representative Vent iS attached.
Increase of interior electrical service .............. Add $2,350
The City has requested a 200 amp, ~l~0~,, single phase service with 42-circuit
panel. We had originally estimated a 110v service for driving interior stairway
lighting only. We have also included five receptacles, four at the base and one
the top landing. The change has also added somewhat to the panel box and
electrical cable requirements.

open/closed sensor for the altitude valve are included.
Pedestal/Tank Architectural Lighting ................ ~ Add $4,400

prevent damaging the vision of anyone who may walk around the tanl~at night. A

As you can see from the attached'drawing the "panelizing" helps breakup the long
vertical visual effect of the pedestal and the width of the bowl. If the.tank is
illuminated at night, the panels should provide some additional shadowing effects.

We have estimated use of either a "rough pebble" or a "fractured rib" formliner for
the pedestal. On,the bowl we have only considered the "rough pebble" formliner,
since the conical shape does not lend itself to parallel ribs. Samples of these
liners wiil be available at the meeting.
Option 4 - Use of raised aluminum letters for the City name .... Add $21,000
Rather than painting the name of the City on the tank= we think use of raised
aluminum letters will provide a superior architectural appearance and the lowest
maintenance. The letters are 5'-6" high and say "BOYNTON BEACH." The
letters can be backlit with white or colored lights for a unique visual impact at
night. This is for one set. A second set can be added for an additional $15,000.

We have attached cut sheets on typical light poles and fixtures for your review.
Payment schedule revisions
A revised payment schedule with a breakout of the $40,000 lump-sum allowance
for the anti-surge facilities is attached.
Delay
We agree to delete Section 7 - Delays, and intend to meet the requirements of the
City of Boynton Beach's RFP on the project.

'We included the Pratt valve m our original price. The Ross valve is about $2,000 more

be happy to have the City supply the valve for us to install. Review this information and

We are still working on the cost differential between below and above ground

Architectural Treatment Options
Option 5 - Use of a textured formliner on the tank only ...... Add $134,500
This option provides some texture to the formed surface of the panels on the bowl
of the tank. As you can see from the attached drawing the texture serves to break
up the width of the bowl. The texture will also tend to mask any slight waviness of
the formed surface. This waviness occurs from normal minor variations in
formwork and the casting operation. If the tank is lit, the texture should provide
some additional shadowing effects. We believe the texture may also tend to
reduce the visual impact mildew may have on the tank. The pedestal will have
vertical rustications cast into the concrete to help break up the smooth concrete
cylinder and lend to interesting shadows/lighting effects.
Option 6 - Use of non-illuminated aluminum letters for the City name Add $7,$00
Rather than painting the name of the City on the tank, we think the use of raised
aluminum letters will provide a super[or architectural appearance and the lowest
maintenance. The letters are 5'-6" high and say "BOYNTON BEACH." The

Prestressed Concrete Elevated Storage Tank Project Criteria
(Performance Specification)
The new prestressed concrete elevated storage tank facility will be locnt__~J_ on land
immediately south of the existing ~ site, replacing existing 0.5 MG elevated tanks
that will be demolished under a separate contract. Figure 3-1 shows the proposed site
plan for the prestre-s__~ed concrete elevated storage {ank. The desired shape of the
prestressed concrete eleva~xi ~ is similar ~o a champagne ~ with a narrow center
support colunm flaring out at the top. Figure 3-2 illustrate~ this ~ of lank.
Required DistribUtion System MOdifications
The new prestressed concrete elev~t_~ tank is to tie into the existing distribution system
at the 16-inch-diameter wa~er mzin on Seacrest Boulevard, approximately 1,000 feet
south of Woolbright Road. At this location, the new prestressed concrete elevn_t_,~_ tank is
to also ~s~ in dampening pressure surges from ~he WTP and provide continuous
pressure to the distribution system. Isolation valving shall be provided at points where
the new pre~'e~ed concrete-storage ~ facility ties into the existing distribution system.
Design Criteria for the Prestressed Concre Elevated Tank
Locating the tank at the WTP will require that the high water level of the tank be at a
height equal to the typical operating discharge pressure for the high service pumps. The
City curreatly maintains 60 pounds per square inch (l~i) in the distribution main leaving
the WTP. This corresponds to a 138-font water elevation. The City wishes to maintain
60 psi pressure on the discharge side of the altitude valve. The high water level within
the tank is to be se. tat 150 feet or 65 psi to allow the City some flexibility if an increase
in operating pressure is requlred'~tOmaintain pressure within the distribution system. The
Iow water level and ~uk overflow should be set at 115 feet (50 psi) and 161 feet (?0 psi),
respectively. An altitude valve is required in a valve pit at the base of the elevated tank
and should be designed to automatically close if the pressure exceeds a preset level (i.e.
6O psi). ,

A preliminary geotechnical investigation was pedonned on February 19, I~2, to
