5 AUTHORIZING SUBMISSION OF AN , ENDMENT
6 TO THE DEPARTMENT OF HOUSI ' AND URBAN
7 DEVELOPMENT (HUD) TO THE 2008
8 APPLICATION AND SUBSTANT AL AMENDMENT
9 TO THE NEIGHBORHOO P STABILIZATION
10 PROGRAM; AMENDING TH 2009/10 COMMUNITY
11 DEVELOPMENT BLOCK GRANT (CDBG) SUB -
12 RECIPIENT CONTRACT AGREEMENT BETWEEN
13 THE CITY OF BOY TON BEACH AND THE
14 BOYNTON BEACH F. ITH BASED CDC AND R M
15 LEE COMMUNIT DEVELOPMENT CENTER;
16 PROVIDING AN FECTIVE DATE.

18 WHEREAS, the NSP .s established through Title II, Division B of the Housing
19 and Economic Recovery ct of 2008 for the purpose of assisting cities in the
20 redevelopment and reus; of abandoned and foreclosed homes; and
21 WHEREAS the City Commission adopted the NSP via Resolution R08 -139 on
22 November 18, 2 t,08 approving a substantial amendment to the City of Boynton Beach
23 Community II - velopment Block Grant program allowing the acceptance of $2,963,311 for
24 the purpose of assisting in the redevelopment of abandoned and foreclosed homes under
25 the E rgency Assistance for Redevelopment of Abandoned and Foreclosed Homes,
26 refe d to as the Neighborhood Stabilization Program (NSP); and
27 / WHEREAS, as part of the application, $400,000 was allocated for the Community
28 ledevelopment Agency for the purpose of providing down payment assistance to potential
29 purchasers in the project known as Ocean Breeze which the CRA Board has subsequently
30 canceled a contract regarding this project; and
31 WHEREAS, the $400,000 will be added to the acquisition and rehabilitation
32 activity of the grant increasing the amount mailable for the purchase and rehabilitation of

1 j foreclosed upon, bank owned properties; and
2 WHEREAS, The Boynton Beach Faith -Based CDC, along 'rth the R.M. Lee
3 Community Development Center, currently has an existi = CDBG sub - recipient
4 agreement and has experience in property acquisition and r- abilitation through the City's
5 State Housing Initiatives Partnership (SHIP) Program taff wishes to amend the existing
6 agreement to reflect the NSP program. The cube'' scope of services under this agreement
7 stipulates that the agencies agree to " • : ertake the acquisition of abandoned and
8 foreclosed upon homes for rehabilitat' • • and resale."
9 WHEREAS, upon the re • , mendation of staff, the City Commission deems it to
10 be in the best interests of t citizens and residents of the City of Boynton Beach to
11 approve the following:
12 1. Author 'the submission of an amendment to the Department of Housing
13 and Urban Develo • ent (HUD) to the 2008 Application and Substantial Amendment to

21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
22 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
23 Section 1. The foregoing "Whereas" clauses are true and correct and are

1 hereby ratified and confirmed by the City Commission.
2 Section 2. The City Commission of the City of Boynton Beach, Florida,
3 hereby approves the following
