3 AN ORDINANCE OF THE CITY COMMISSION OF THE
4 CITY OF BOYNTON BEACH, FLORIDA,
5 DESIGNATING THE PROPERTY KNOWN AS THE
6 AUDREY D. GERGER HOUSE LOCATED AT 331 NW
7 1 AVENUE, WHICH IS MORE FULLY DESCRIBED
8 HEREIN, AS A LOCAL HISTORIC SITE; PROVIDING A
9 NON - SEVERABILITY CLAUSE AND AN EFFECTIVE
10 DATE.

12 WHEREAS, Chapter 4, Article IX, Section 6.C. of the City of Boynton Beach Land
13 Development Regulations provides for the designation and protection of historic sites in the
14 City of Boynton Beach; and
15 ; WHEREAS, the owner of the Audrey D. Gerger House, a home which demonstrates

16 an example of the Mission style of architecture constructed in the City of Boynton Beach in
17 the 1920's; and
18 WHEREAS, the Historic Preservation Board of the City of Boynton Beach prepared a
19 designation report for the designation of the Audrey D. Gerger House as an historic site and
20 held a duly noticed public hearing in regard to the designation of the property as an historic
21 site at which no member of the public spoke in opposition to the designation of the property
22 as an historic site; and
23 WHEREAS, the Historic Preservation Board of the City of Boynton Beach on
24 September 10, 2012 recommended that the Audrey D. Gerger House be designated an historic
25 site; and
26 WHEREAS, the City Commission of the City of Boynton Beach has conducted a
27 duly noticed public hearing in regard to the designation of the Audrey D. Gerger House as an
28 historic site.

1 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
2 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
3 Section 1. The foregoing whereas clauses are true and correct and are now ratified
4 and confirmed by the City Commission.
5 Section 2. The Audrey D. Gerger House is located at 331 NW 1 Avenue, which
6 is legally described on the survey which is attached and incorporated into this Ordinance as
7 Exhibit "A ", and is hereby designated as the Audrey D. Gerger Historic Site in accordance
8 with and under the provisions of Chapter 4, Article XI, Section 6.C., of the City of Boynton
9 Beach Land Development Regulations.
10 i Section 3. It is the intention of the City Commission of the City of Boynton Beach
11 that this Ordinance and each and every of its terms be considered a part of a single whole and
12 that the Ordinance not be severable and that if a court of competent jurisdiction finds that any
13 section of this Ordinance is unlawful or unenforceable the Ordinance shall be unenforceable it
14 its entirety.
15 Section 4. This Ordinance shall become effective immediately upon its passage
16 and adoption.
