12-017 11 1 ORDINANCE NO. 12 -17 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, RESCINDING CITY ORDINANCE 11 -029 5 WHICH REQUIRED REGISTRATION OF LOBBYISTS AND 6 ELECTING TO REGULATE LOBBYING ACTIVITY UNDER 7 THE PALM BEACH COUNTY LOBBYIST REGISTRATION 8 ORDINANCE; PROVIDING FOR CONFLICT, 9 SEVERABILITY, AND AN EFFECTIVE DATE. 10 11 WHEREAS, On December 20, 2011, the Palm Beach County Commission adopted 12 the Palm Beach County Lobbyist Registration Ordinance providing a centralized lobbyist 13 registration system for the County and all municipalities in the County which took effect on 14 April 2, 2012; and 15 WHEREAS, The County Ordinance applies to any municipality that does not have a 16 conflicting ordinance in effect; and 17 WHEREAS, City Ordinance 11 -029 is a conflicting Ordinance which currently 18 prohibits application and enforcement of the Palm Beach County Lobbyist Registration 19 Ordinance; and 20 WHEREAS, This Ordinance, if adopted by the City Commission, will rescind the 21 City's Lobbyist Registration Ordinance and clear the way for enforcement of the County's 22 Ordinance; and 23 WHEREAS, the City Commission finds that it would be in the best interest of the 24 public for lobbyists to be registered and regulated under a County -wide system. 25 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 26 THE CITY OF BOYNTON BEACH, FLORIDA THAT: 27 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed 28 as being true and correct, and are hereby incorporated herein and made a part hereof. Document in Windows Internet Explorer 3 II 1 Section 2. Ordinance 11 -029 is hereby rescinded in its entirety. All provisions 2 1 regarding lobbyists, lobbyists registration and enforcement of lobbyist activity contained in 3 the City Code of Ordinances shall be deleted. 4 Section 3. The provisions regarding lobbyist registration shall hereinafter be 5 governed by the Palm Beach County Lobbyist Registration Ordinance as amended from time 6 to time by Palm Beach County. 7 Section 4. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions 8 in conflict herewith be and the same are hereby repealed to the extent of such conflict. 9 Section 5. If any clause, section, or other part or application of this Ordinance shall to be held by any court of competent jurisdiction to be unconstitutional or invalid, such 11 unconstitutional or invalid part or application shall be considered as eliminated and so not 12 affecting the validity of the remaining portions or applications remaining in full force and effect. 13 Section 6. This Ordinance shall not be codified. 14 Section 7. This Ordinance shall become effective on passage. 15 FIRST READING this 16 day of October, 2012.
