Minutes 11-18-75MINUTES OF REGULAR CITY COUNCIL MEETING OF THE CITY OF BOYNTON BEACH, FLORIDA, HELD IN CITY HALL, TUESDAY, NOVEMBER 18, 1975. PRESENT David Roberts, Mayor Joe DeLong, Vice Mayor Edward F. Harmening, Councilman Norman F. Strnad, Councilman Emily M. Jackson, Councilwoman Frank Kohl, City Manager Ernest Simon, City Attorney Tereesa Padgett, City Clerk Mayor Roberts called the meeting to order at 7:42 P.M. He asked all to rise for the invocanion Riven by the City Manager, Frank Kohl, followed by the Pledge of Allegiance to the Flag, led by Councilman Harmening. Announcements Mayor Roberts read a Proclamation, designating November 23-30, 1975 as Bible Week in Boynton Beach. The Mayor then announced tha5 City Hall would be closed for the weekend beginnin~ November 27 and 28 in observance of the Thanksgiving holiday. Mayor Roberts advised that the Primary election returns for the City of Boynton Beach would be presented when the resulss are completed from all precincts. Mayor Roberts then requested the Agenda just before BIDS - had no objections. the addition of another item. to re: Amending the Budmet. Council The Mayor asked all those wishing to soeak about items on the Agenda to give their names no the City Clerk sc they could be called at the appropriate time. MINUTES Regular City Council Meetin~ - November 4, 1975 Mrs. Jackson referred to oage 11, para.~raph 2, correcting it to read, "Mrs. Jackson moved to accept the recommendation of the City Manager in conjunction with the recommendations of the Planning ~ Zoning Board ..." She then referred no page 12, second paragraph from the bottom -- the beginning of the second sentence should read, "She doubted that even one quarner of the residents have done so ... On page 15, paragraph 2, the last word "hand" should be chan~ed to "handwriting". Mrs. Jackson corrected the word "sites" to "cites" on page 18, paragraph 2, line 11. MINUTES - REGULAR CITY COUNCIl. ~ETING BOYNTON BEACH, FLORIDA NOVEMBER 18, 1975 Mayor Roberts referred to the last item on page 12, correcting it to read -- "Discuss Return of All Known Easements for Utilities that Will Not be Utilized - Councilwoman Jackson". Also, the phrase "rights of way" in the first sentence of the last paragraph should be changed to "utiliny easements". Mr. DeLong moved to adopt the Minutes of the Regular City Council Meeting of November 4, 1975 as corrected. Mr. Harmening seconded. No discussion. Motion carried 5-0~ PUBLIC AUDIENCE No one wished to speak. Amending the Budget Mr. Kohl asked for Council's approval to have an Ordinance prepared for the next meeting to amend the Budget to include additional $59,000 to the budget through additional revenues re the Traffic Safety Enforcement Department which the Ciny received some time in October. Word had previously been received from the Traffic Enforcement Bureau that the~City was going to receive this money. an Mr. DeLong moved no have the City Attorney instructed to prepare the appropriate instrument for amending the budget. Mrs. Jackson seconded. Mr. Kohl said in addition to %hat (but not to go in the Ordinance), the amount of $11,000 will be nransferred from the Contingency Fund, which Council had approved when the City received the Traffic Enforcement grant. Motion carried 5-0. BIDS One (1) New 1976 Ambulance Mr. Kohl said bids on the above were ooened on November 10, 1975 at 1:00 P.M. in the office of the Purchasing Azent, Mr. Sullivan. The Tabulation Committee recommended acceptance of the iow bid from Custom Ambulances of Florida, Inc. of North Palm Beach, Florida in the amount of $18,617.00. Before Council were conies of the Tabulation Sheet and Affidavit signed by Mr. John R. Corson, Manager of Marketing & Sales for Custom Ambulances of Florida, Inc. Mr. Kohl said he checked all other requirements and every- thing is in order. Funds for the purchase of this item are available in the Federal Revenue Sharing Account No. 020-810. Mr. Kohl concurred with the recommendations of the Tabulation Committee. Mr. Harmening moved to accept the City Manager's recormnendation above, seconded by Mrs. Jackson. Mrs. Jackson asked if this ambulance would be able to take the EMT equipment which was put in the budget should the hospital finalize it and Mr. Kohl said yes. Motion carried 5-0. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVE~iBER 18, 1975 One (1) New Industrial Tyoe Rubber Tired Tractor Complete Tgith Backhoe and Front End Loa~er '~ Mr. Kohl said bids on the above were ooened on November 10, 1975 at 4:00 P.M. in the office of the Purchasinm Agent, Mr. Sullivan. The Tabulation Committee recommended acceptance of the low bid from DeWind.Machinery Company of Ft. Lauderdale in the amount of $15,473.00, Model 715, Allis-Chalmers. Before Council were copies of the Tabulation Sheet and Affidavit signed by Mr. V. M. Holloway, Vice President of the DeWind-Machinery Company. Mr. Kohl has Checked all other requirements and everything.is in order Funds for the purchase of this item are aval%able in A~count No. 030-920-53. M~ Kohl concurred with the recommendations of the Tabulation~Commitnee. Mr. Chuck Smith, representing Trail Ford Tractor Company in Lake Worth, noted thgt D~Wind Machinery Company's bid was~ ~518.00 under his company's bid. He wished ~ospeak zn' defense of Trail FOrd's 5id and felt his equipment would be superior in over-all performance. Mr. Smith gave a letter to Council outlining the reasons his company felt it~should have been awarded the bid and he spoke at length about these points. Mr. DeLong clarified with Mr. Kohl that the City Manager was previously aware of Mr. Smith's statements, and Mr. Kohl noted that many times he must advise Council of his recommendations based on the advice of his department heads. He complimented Trail Ford Tractor Company and DeWind Machinery in that they are both repu5able companies with good equioment and he felt in this case the City got the best buy. Based on the City Manager's statemenns and recommendations above, Mr. DeLong moved to award the low bid to DeWind Machinery Company of Ft. Lauderdale in the amoun~ of S15,473.00, Model 715, Allis- Chalmers. Mr. Strnad seconded. It was noted this motion was based on the recommendations of the City Manager and Tabulation Committee. No discussion. Motion carried 5-0. One (1) New 1976 3/4 Ton Cab & Chassis Without Body and Two (2) New 1976 1/2 Ton Light Utility Vehicles Mr. Kohl said bids on the above were opened on November 10, 1975 at 3:00 P.M. in the office of the Purchasing Agent, ~. Sullivan. The Tabulation Committee recommended acceptance of the bid from Adams Chevrolet for two (2) 1/2 ton light utility vehicles in the amount of $6,214.00; and the bid from Jack Nicklsus for the one (1) 3/4 ton cab & chassis without body in the amount of $4,427.00. Before Council were copies of the Tabulation Sheet indicatinm recommendations by the Tabulation Committee on both of the above items; and Affidsvit signed by Mr. Gerald A. Polidan of Jack Nicklaus Pontiac, Inc. of Delray Beach; and Affidavit si~ned by Mr. James H. Shepherd, Truck Manager of Adams Chevrolet Comoany. Mr. Kohl said he checked all other requiremenns and everything is in order. No reply~ Noting that this ma~ter has been going on for a long time, Mrs. Jackson moved to accept the recommendation of the Planning & Zoning Board for the abandonment of Alley between Lots 22 and 23, Block 12, Boynton Heights Rev. Plat, Recorded in Plat Book 10, Page 64, Palm Beach County Records and the South 25 ft. of Lots 4 and 5, Block 6, Boynnon Heights (Original), applicant being Mr. Clarence W. Shelton, Sr. Mr DeLong seconded ~ith the request that all back- ground information come before Council'at each meeting. There being no further discussion, motion carried 5-0. MINUTES - REGULAR CITY COUNCIL MEETING NOVEMBER 18, 1975 BOYNTON BEACH, FLORIDA Two (2) Motorcycle Radio Units Mr. Kohl said bids on the above were opened on Monday, November 10, 1975 at 10:30 A.M. in the office of the Purchasing Agent, Mr. Sullivan. The Tabulation Committee recommended acceptance of the sole bid from Motorola in the amount of $2,802.00 and funds are now available since the budget will be amended oer the motion made earlier this evening. Mr. Kohl said he would have the Tabulation Sheet and Affidavit for Council as usual Mr. Kohl concurred with the recommendation of the Tabulation Committee. Mr. DeLong moved to accept the City Manager's above, seconded by Mr. Strnad. Resolutions Proposed Resolution No. 75-XXX - Re: Amendment to Resolution No. 75~ZZ Lowering Rates of Tennis Fee System Mr. Simon read the above proposed Resolution in its entirety. There was some discussion regarding the orocedure of asking if anyone in the audience Wished to spea~ for or against this item. When it was established that no one wished to speak, Mr. De~ong moved for the adoption of Resolution No. 75-XXX, seconded by Mr. Strnad Mr. Harmening felt ~his was a much better Resolution than the original one with hi~her rates and should benefit those who play tennis. OLD BUSINESS Discuss Repeal of Article IV., Re: Residents to Pay for a Permit to Install T.V. Annenna - Councilwoman Emily M. Jackson (TABLED) At Mr. Kohl's request due to Mr. Bushnell's absence because of illness, Mrs. Jackson moved to table the above item Mr. Harmening seconded. The Mayor noted that the item had already been taSled since the last meeting, therefore no further action was necessary. Discuss 3:00 A.M. Bar Closing Hours Vice Mayor Joe DeLong Rev. RoSy Snider of the Boynton Baptist Temple, appealed to Council~embers not to change their minds about the earlier bar closing hours. He felt the City would suffer no loss of revenues and quoted various statistics regarding the oroblem of alcoholism, adding that this was non solely a mora% issue. It was nosed that the second reading of the Ordinance on this matter would be December 2nd. Mr. DeLong felt people were unduly alarmed abo. ut his intentions this evening. His reasons for wishing to discuss this matser were due to the Mayor's prior snatements about a desire for flexibility and there was 6 MINUTES REGULAR CITY COUNCIL MJ~ETING BOYNTON BEACH, FLORIDA NOVEMBER 18, 1975 doubt about what that flexibility would consist of. Mr. DeLong said since the first reading of the Ordinance, a communication has be~n received from the liquor dealers, requesting certain days be allowed for them to remain open until 5:00 A.M. His understanding was that the City Attorney was to be apprised by Council as to what days would be allowed. In answer tO a question from Mrs. Jackson regarding the addition of more days to the Ordinance, Mr~ Simon said caption on first reading whiah~has already been published listed New Year s Day as the only ex- ception. If ~dditional days were going to b~ listed, there would have to be another first reading and publication. Mrs. Jackson felt it might be b'etter to leave th~ Ordinance as is and then amend i~ later However, Mr. DeLong felt the Ordinance should be clarifi-ed now and readvertisedif necessary, in con- sideration of the various businesses in the City. Mayor Roberts felt the question should be discussed a bit further and the Or, dinance readvertised if necessary. He had received some information since the last meeting and learned that the south portion of Palm B~ach C~unty from the snandpoint of population has more munzci!palities that have closing hours between 2-3:00 A~M. He noted tha~ so~e statistics have bee{ compiled and it's expected they wil~l be presented to the County Commission before they take their vo~e next Tuesday. The Mayor wished to see this m~tter reconsidered by the County Commission in view of the desire for uniform~ny~ He would go along with Mr. DeLong in making some adjustments and concessions if after next Tuesday it's found that n~ one is ~iving in. Discussion continued with Mrs. Jackson wishing to se~ the Ordinance adopted as is, with possible amendmentj later,! ~d Mr. DeLong favoring the extension of time being allowed for ~o~e additional days. Mr. DeLong then moved that there will be no action taken on the Ordinance in question until such time as it is known what direction the County Commission is taking. Mr. Strnad seconded. It was noted that the Ordinance would appear on the next Agenda and Council would have to decide at that time what action to take on it. Mr. DeLong then withdrew his motion and Mr. Strnad with- drew his second, leaving the matter ooen until the next meetinm. NEW BUSINESS Confirm Appointment of Chief Executive OfficeC ToSouth Central Regional Wastewater Treatment & Disposal Plant - Mayor Roberts Mayor Roberts noted that under the Inter-local Agreement, it specifies that the Chief Executive Officer for the South Central Regional Wastewater Treatment & Disoo_sal Plant should be confirmed by each individual City Council -- Delray and Boynton -- and it may be done by motion. approve and Mrs. Jackson moved tn/confirm the appointment of Anthony Canon as Chief Executive Officer to the South Central ReKional Waste- water Treatment & Disposal Plant. Mr. Harmening seconded. Mr. DeLong asked what the vote was at the time this gentleman was appointed as he was absent from that Min. of 12/2/75 meeting. Discuss Ordinance Regarding Central File - CouncilwomAn Jackson Mrs. Jackson referred to Minunes of Regular City Council meetings in December, 1969 and January 5, 1970 pertaining to the policy concerning Central File. Since the City is growing and she believed there were some items not placed in Central File, Mrs. Jackson felt an Ordinance should'be drawn, rather than having just a policy that everything pertaining to public business go into Central File -- in line with Public Law 119. Mrs. Jackson moved to have the City Attorney draw up an Ordinance that all public records go into the Central File. b~. Harmening seconded. Mayor Roberts s.uggested including a time limit of ten days or t~o weeks wi~thin the O~dinance. Mrs. Jacks'onbelieved· that the State Law required ten days. Mr. of State regarding various records and where they are filed. DeLong did not agree wi%h Mrs. Jackson's motion as he felt it would creane a "miniature CIA". He referred to an instance where he was questioned by the State Attorney regarding the turning over of of£icial communications, wherein the State Attorney found there was no basis for any charges. He feln the motion would,cause an invasion of privacy. Mrs. Jackson disputed Mr. DeLong's comments and felt her motion would orove beneficial in improving the Central File system. Mr. DeLong read the motion made at the January 5, 1970 meeting adopting the policy pertaining to Central File and other oertinen[ correspondence, and he felt said policy should be followed. Regarding the time limit, it was clarified that a 10-day time period was se~ uD zn Public Law 119 and it was'felt this should be included in the O~dinance. MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 18, 1975 Mr. Simon interpreted his understanding of the discussion in that Mrs. Jackson's motion asked that the City Attorney prepare a proposed Ordinanca, whereas Mr. DeLong suKgests that rather than prepare a proposed Ordinance, Mr. Simon present a suggestion or recommendation as to what area should be covered by an Ordinance, and if Council didn't like those guidelines, the Ordinance wouldn't need to be prepared Mayor Roberts then suggested that Mr. Simon come back with a time element as noted in the Public Law. Mr. Harmening noted that until passage on second reading, it would only be a proposed Ordinance and whatever the City Attorney brings back before Council, it would amount to the same things-- a proposal or a Drooosed Ordinance. After some further discussion, Mayor Roberts repeated the motion for Mr. Simo~ to researdh the question and return to Council with a proposed Ordinance, including the time element. }~rs. Caldwell 1,032 Gene Moore 1,468 Norman Strnad 2,720 Joseph Zack 2,974 Nicholas Zito 775 Mrs. Jackson moved to place the top four names on the ballon for the General Election to be held December 2, 1975. Mr. DeLong seconded. No discussion. Motion carried 5-0 Discuss ChrisCmas Bonus - Councilwoman Jackson It was noted that the employees of the City are given a Chrisn- mas bonus every year and it is taken out of the Contingency Fund. The bonus had always been S10.00 and last year it was $20.00. Mrs. Jackson moved to give the City employees the sam~e bonus as they received last year. Mr. DeLong seconded with the request that the bonus be increased to $25.00. Mrs. Jackson agreed after clarifying with Mr. Kohl that there was enough money to cover this amount Mayor Roberns spoke against the MINUTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA NOVEMBER 18, 1975 increase, since the money was coming from the naxoayers and he felt the bonus should just be a token gesture. Mr. DeLong believed everyone in the City was happy with its emplayees and there would be no objection to .the 8~5.00. The May6r ~hought it might be interesting if it went to a referendum, although it f · was elt thzs was not n~cessary. Mr~ DeLon~ noted the surplus available through the Czty's frugality of $168,000,.largel~ due no employees no longer with the City and not rep.laced, 'wi'th their workload picked up by others. He therefore felt the g25.00 bonus was in: order. The motion was repeated in that the City would give all employees a Christmas bonus of $25.00. Motion carried 3-2 in favor, with Mr. Harmening and Mayor Roberts~against. ADMINISTRATIVE Request Approval for Change Order No. 2 - Maintenance Garage, Kozich & Kozich, Inc. Mr. Kohl noted the Change Order No. 2 which was before Council, listing changes no the City's Maintenance Garage and totaling to the amount of $3,906.00. Mr. Kohl said he's talked to th~ Engineers and there were changes to the original interior walls, fire doors and ceramic tile, the latter being in both bathrooms instead of vinyl tile. Mr. Kohl concurred with the Change Order and requested Council's approval of same. After clarifying that funds were available, Mr. DeLong moved to accept the recommenda- tion of the City Manager and approve the Change Order° Mr. Strnad seconded. No discussion. Motion carried 5-0. Request for Extension of Retirement Mr. Louis J. Pehtke, Electrical Inspector Mr. Kohl said in accordance with Pension Ordinance No. 68-10, Section 5.3 regarding "Delayed Retirement", he was submitting a requesE from Mr. Pehlke, Electrical Insoector, and a copy of the recommendation from Mr. Warren Bushnell, Acting Building Official, that Mr. Pehlke's full-time employment be extended for one year. Mr. DeLong moved to granE the re~uest of Mr. Pehlke, in conjunction with the recommendations of the City Manager and Acting Building Official. Mrs. Jackson seconded. No discussion. Motion carried 5-0. Applications for Permit to Solicit: American Cancer Society, Palm Beach CounEy Unit; Palm Glades Girl Scout Council, Inc. Mr. Kohl said everything was in order regarding these nwo applica- tions and he recommended they be aporoved. Mr. DeLong move~-to approve the applications for both of the above organizations, seconded by Mrs. Jackson. No discussion. Motion carried 5-0.
