M. on Wedmesday, August 20, 1975, ef 70 bicycles a~d assorted miscellameo~s items. Mr. Kohl them read the follow- img notice: "The City of B~ynton BeacH, Florida will hold an Auctiom Sale at-the rear of the Boymtom Beach Police Station, 135 N. Mayor Roberts announced that the 1975-1976 Budget Books would he ava~able for the public to see ~ the Office of the City Clerk~and in the Public Library after final adoptiom. He added that the books were imthe process of beimg compiled and would be available im a few weeks. Mayor Roberts announced that City Hall would be closed om Labor Day, Monday, September 1, 1975. Regular City Council Meetin$ - August 5, 1975 Mrs. Jacksom referred to Page 17, seventh line, and stated it should read: "If someone wants to come iL and have a trans- cript efa portion of some meeting, that is good." Mrs. Jackson referred to Page 17, second paragraph, and Mr. StrRad's reference to her bantering with the department heads about fire hydrants. She gave the definitions for the word bartering and referred to Mr. Strnad hearing most of this meeting and it was evident they were not ba~teri~g or Joking. She asked if he would like to change this word and_Mr. Strnad replied she could use any word she wanted. Mr. Strnad referred to Page 17 and Mrs. Jackson's reference to different tape recorders being played. He qmestioned the approximate n~m~er of tape recorders and after discussion, Mrs. Jackson stated she could not give the exact number, but was sure it was more than one. M~or Roberts referred to Page 13, second paragraph about s~gns, 11th line, and stated it should be: "foisted" upon the CAB. He then referred to line 14 and stated it should be "compatible,, to s~rroundings~ He then referred to the re- mai~de~ of this paragraph and the remarks from two organiza- tions composed of businesspeople~*-~ ...... ~ ~-~ ~ support, He would like this entire reference to be stricken. ~yor Roberts then referred to Page 17, next to last para- graph, and he also stated at this time that the estimated cost would run in the vicinity between $250 and $300. Mr. DeLong referred to Page 5, middle of page, second para- graph, and 3/10's should be 2/10'$. Mr. DeLong referred to Page 16, third paragraph, eighth line, and he explained f~ther his thought in this matter snd sug- gested the additio~ of "also" between is and coming. PUBLIC AUDIENCE ~yor Roberts asked no response. if anyone desired to speak and received BIDS Sale of Used EQuipment - Eighteen - Five Cubic Yard Carts Mr. Kohl informed the City Council that Bids on the above were opened on Friday, August 8, 1975 at 3:00 P. M. in the office of our Purchasing Agents Mr. William H. Sullivam. H~ read ,,The Tabulation Committee recommends acceptance of the high bid from Southland Equipment Corporation in the amount of $540.00. The o~/y other Bid received was from Boynton Ser- vice Corporation in the amount of $}20.00, for six (6) carts only. Attached hereto please find Tabulation Sheet and Pro- posal signed by Mr. Paul J. Myers, President of Southland Equipment Corporation." He concurs with the recommendations of the Tabulation Committee. Mrs. Jackson moved that they accept the recommendation of the City Manager and approve the high Bid of $540.00 from South- land Equipment Corboration for 18 five cubic yard carts. Mr. Harmening ~ec~nded. Under dis- cussio~, Mrs. Jacksom stated that this had been going on for mor~ tha~ several years. The ma~ h~s been rumning into all kinds of snags and she would like to correct their mistake new. Mr. F~rmening stated that it seemed to him they moved rather rapi~Iy to correct this error, but they have ether erro~swhichare af£ecting more people. Ee would like to see some of these non-conforming lots handled asexpeditionsly as this o~e. ~i~y~eoPle are being h$1d up. Nayor Roberts informed him that he believed everything wa~ heimg done be- tween the Gity Gou~cil, Planning & Zomimg Board a~d Board of Adjustment to get this corrected. LEGAL Ordimances - First Readin~ (Cont.) ~eposed Ordinance Ne. ~5- Re: Revision of Ordinance No. ~2-31 - Regulations for Beach Decals N~. Kohl requested that this be tabled, in asmuch as the City Attorney is still working on this. Mr. Harmeni~g moved to table this ordinance, seconded by Mrs. Jackson. Motio~ car- ried 5-0. Mr. Strnad asked if there was any target date of when they may expect this and Mr. Kshl informed him that in talking with the Attorney, he will have it on the ~ext agenda. Mr. Simon added that the reason for the delay was that there were certain penalty provisions in the proposal that they would like to look into. Resolutions None Other Discuss Zonin~ Ma~ Errors Mr. DeLong referre~ to the e~rors made in the zoning map and stated he believed the appeals had been submitted to the wrong -6- MINNTES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 19, 1975 body. He believes the City Council and Pl~n~ing & Zoning Board should reach an agreement on this with these not the Board of Adjustment. He would like to k~ow if there is some way to expedite it in order to give the people some relief. Mr. Kohl i~formsd him that he would meet with the people right after the meeting a~d take care of this. ~hey are working with the attorney and it will be resolved in the regular order of business, Mr. DeLong replied that he was not apprised of this. Discuss Interim Services & Facilities Fees Mayor RoBerts asked Mr. Simon if he had a~y comments on the legal angle referring to interim services and facilities fees. Mr. Simon asked if the City Council desired further action in reference to the litigation. He added, as they knew, the judge ruled the ordinance invalid. The case as it now stands only affects the plaintiffs. If the Cl~y does nothing more at this time and does mot appel, the City m~st pay the cost of the case which is about $269° There is nothing to refund to the plaintiffs. The alternate is toappeal to the Fourth District Court of Appeals. He explained how other cities had similar ordinances and were waiting to see what the City of Boynton Beach was going to do. Mr. DeLong stated he read the petition for the re-hearing. He added that whether they wanted to go and pursue it was definitely up te this City. Other cities are in the same position and some have a great deal more escrow to pay back. Is the City 9f.Boy~ton Beach just ~oing to give up or try to get more definite opinions from ot~er cities of what direc- tion they are going in? They should be in a position of what they intend to do. Mr. Simon clarified that theoother cities, which have the same ordinance, have not gone to court and ars not under the gun like Boynton Beach. They are just cerned because they have the same ordinance. At this point, their ordinance is not in questions Mr. DeLong questione~ if they wouldn't return the escrow until people instituted suit and Mr. Simo~ replied that he was not sure if the ether cities have their money in escrow. Mr. DeLong remarked that h~ had read about several which do and he the~ asked for Mr. Simon,s guidance in directing them in what they should do. Mayor Roberts asked if quite a few cities were having a pro- blem with similar ordinances and Mr. Simom informed him that there have been a number of cases throughout the State with cities having similar ordinances and having them attacked. He told about the Town of South Palm Beach and their im~ct fee being questioned and whether it was i~ addition to that authorized by statute. m MINU ~h~S - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 19, 1975 Mayor Roberts asked if there was ~ question regarding the type and number of servic~es they were chargimg for not being s~lled out in the ordinance and Nr. Simon replied that in their ordinance there was no particular utility this parti- cular fee was charged for. He added that this was where a lot of the argument came from. Mayor Roberts questioned why it was denied hy the court and Mr. Simon explained how they usually get some guidance from the court, but in this case it was net ia detail. The judge stated it was invalid for lack of specific services. He added that ia his memoramdmm he did refer to some ordinances relating the fee to cer~ services. Mr. DeLong stated that even if this ordinance was tightened now, it would have no affect on this ruling. Mr. Simem in- formed them if they enacted a new ordinasce, they should impose new fees and state for what services. He added that a municipality is bound to provide certain services which they cannot charge additional fees for. He gavesexamples of this. In the present' ordd~ce, they have net related to a specific utility or service. Mr. DeLong sta~ed he believed the State was plamning a bill to enact this mnto State law. Mrs. Jackson asked if ~hey woul~ be protecte~ by settlimg this now and paying this one case and not go~ng further, re~ci~ding the present ordinance and drawing up a new ordi- nance with the uses spelled out? Mr. Simon replied that they would not be immune from an attack by a new t~xpayer. They would have a better fighting chance ~hough. Zt will take a great deal of research to come up with a new idea. Mayor Roberts suggested ~oing away with this ordinance and going to work with somethinE ~hmore teeth to start from scratch, instead of contiaually appealing this, The ame~nt of people moving in is at a minimum compared to what it was and he believes they should take this opportunity to come up with a new ordinance and clear the books on the ol~. He feels they will be hit with more suits if they don,t clear this off the books. Mr. DeLong agreed, but added that he thought they would be spinning their wheels playing around with the ordinance. He believes they should devote their efforts te the State representatives to get semething on the books whereby all municipalities will have the same treatment. ~o repeal the interim servi~e £ee Ordinance and ~ See Min. Mr. DeLo~g secen~ed for the pur- pose of getting a~ op~ion from the City Attorney. Under discussion, Mrs. Jackson clarified that a refund would be given only if zt was asked for. M~yor ~e~er~s replied that he didn't believe this was fair a~ exp±a~L~e~. Mrs. Jackson continued that she made the motio~ this wa~, as she believes it will be going on for several years. The money is drawing interest and people will hear about it and everyone won't rush into the fro~t doer tomorrow morning. She did this on purpose ~ecause she ~eels it should not be an automatic thing. ~ d Mr. DeLo~g stated that if one was entitled to a re,uA , all were entitled to a refund and they should pay them as they appeal, ~ayor Roberts stated they should make payment with- omt re2~astS. Simon advised the City Council that his silence did not indicate they were obligated to do anything, At this point, they are not obligated to do anything. If they decide to re- fund any interest or money, it is literally out of the good- ness of their hearts. Mr. DeLong agreed, but added that they have taken action not to appeal. Mrs. Jackson moved to refund all monies paid in by the people. Mr. DeLong seconded, Under discussion, the members expressed their agreement. Motion carried 5-0. Mr. DeL~ng questioned if this money had been invested and ~. Kohl informed him it was in the bank drawing interest. Mr. Harme~ing suggested that perhaps they should clarify whether they were going to refund the interest. The members dis- cussed this and agreed to discuss it further at a future date. M~. Simon suggested that in directing the refund be given, a release should be obtained from each taxpayer of all claims whatsoever. -9- MI~3TES - REGULAR CITY COUNCIL MEETING BOYNTON BEACH, FLORIDA AUGUST 19, 1975 Discuss Amendment to Article III, Re: City Manager Section 2-2! of the Code Mayor Roberts stated he reviewed this and meant to ack on it before. It seems a great many department heads live out of ~ewn and he does~,% believe the. last sentence should be in- cluded. He doesa't tb~nk it is necessary. The City Council ca~ at any time get rid of a manager no% properly doing his job. Occasionally, they do have other department heads liv- ing mearby. F~. DeLomg agreed that forcing anyone to move to live i~ the City and Mrs. Padgett agreed. Mrs. Jackse~ comtinued that she felt it was very discriminatory amd agrees it should mot be included. Nr. Narme~ing moved to ask the City Attorney to draw up aa amendment to Section 2-21 eliminating that last sentence. Mrs. Jackso~ seconded. No discussion. Motion carried 5-0. Other Mrs. Jackson stated she would like to know the status of the title search on Ocean Ridge and questioned if it was going ahead? Mr. Simon informed her that the title compaay search$ lng it reached a point with regard to certain land marks and the compaay stopped and stated they were a little reluctant to go ahead. Mrs. Jackson continued that she ~uderstood that Ocean Ridge was having a search of the title also. If they come to the same standpoint, is there a chance of a friendly lawsuit? She thisks it is time they know who owms what and thinks the people i~ Ocean Ridge would also like to know. Mayor Roberts clarified that it was not being pursued and that is the status quo. OLD BUSINESS Amendment to Ordinance #30-B-32-2-C-W. & N. Florida #281 TABLED ~. Harmening moved to take this off the table, seconded by Mrs. Jackson. Motion carried 5-0. Mr. DeLong stated he felt the Code of Ordinances#30-B-32-2- C-W. & S. ~t be amended immediately to read: "all other exceptions or agreements shall be approved ~y the City Coun- cil.,, Mayor Roberts noted that Section C was not included tonight. Mr. DeLong continued that the comtention pertained to the granting of the easement going beyond what the speci- fic section of the ordinance pertained to in gra~ting the easement. He explained further. - 10- MINUTES - REGULAR CITY COUNCIL MEETING AUGUST 19, t975 BOYNTON BEACH, FLORIDA Mayor Roberts pointed out that this particular project had been completed. Mr. DeLong questioned if it would refer to amy future gra~ts of easemen{s a~d Mr. Simon informed him that the applicability is no longer there once it is com- pleted ~ud once everybody is connected. Mr. DeLong stated he wanted it inelude~ im the evez~t that any agreements should be made in the future. Mr. Simon informed him that the ex- ceptions recited here are the only o~es available. He added that the exceptions had te do with water and sewer connection charges~ Mr, DeLong referred to additional goodies being given an~ how ke woul~ like to see this eli- whereby there cannot be a~y agreements ~tside those aD- proved by the City Council. Engineers ca~ deal with the people, but they must come back to the City Council. Mayor Roberts stated possibly another sectioa would take care of this. He clarified that Mr. DeLeng wanted to remove ~he~a~t~ority from the engiueers or a~yo~e else and pass it ac~ ~o~ne City Co~ncil..Mr. D~Long agreed that it shoul~ go oack to ~he City Council. He has no objections to eng,- needs, etc. ma~ing recommendations, but he doesn,t believe ~he~ should make agreements. This is policy m~W~g and should e ~n the realm of the City Council. MayorRober~ agreed and thought it. would not be too difficult, to include a para- .graph. Mr. S~mon s~ggested including it in the section deal- ing with acquisition of easements. F~. Harmening referred to larger muaicipalities and govern- mental ~odies having people soliciting easements and right- of.-~ays. He referred to small considerations being given, which didn,t fall within governing bodies. Thers may be guidelines set by statutes. If they through another delay in the process of o~taining easements, which is lengthy, it $ould cause them i~ the future to have greater difficul- ties than the small amount of considerations given in the pas~ and very rarely. He is a little reluctant to see them do this. In the past, he doesn't think engineers, etc. have been overly generous with public funds. .Mr. DeLong disagreed and refsrred to the fence being installed. In ~eference to easements, he doesn,t think anyone has the right to make commitments for taxpayers, money. He is Just asking for an amendment whereby the authority amd jurisdic- tion rests with the City Council. He again referred to the giving of a fence and lateral. Mayor Roberts agreed and clarified that the engineers could make aa offer, but should bring it back to the City Council. Mr. DeLong stated he would just like to ask the City Attorney to amend this parti- cular ordinance to include such authority. - 11 MINUTES - REGULAR CITY COUNCIL ~ETING BOY~ON BEACH, FLORIDA AUGUST 19, 1975 M~. Harmening referred to the legal document and the consid- eration of $1.00 being given amd questioned if the man must come forward for the ~1.007 Mr. DeLong replied that he was referrimg to other valuable considerations smch as the femce and lateral. He wants to protect the taxpayers of this City. No employee outside of the City Council is privileged to make agreements where £u~ds are to he expended. Mr. DeLong made a motion to instruct the City Manager to re- quest the City Attorney to amend the ordimamce to give the authority and Jurisdiction, te the City CO~mil. Mr. Strma~ seconded. NEW BUSINESS ~o~e ADMINISTRATIVE Consider Receipt of Letter from Comm~-~ty Action Misra~t Program Mr. Eohl requested Mr. Glover to speak for his own cause. ~. Marvi~ Glover appeared before the City Council and re- ferred to a couple months back when he presented this pro- posal to the Community Relations Board and they studied it and accepted it and presented it to the City Manager. He spoke to the City _Manager and requested the opportunity to discuss the pmrpose of the Rangeline Mobil Co-Op with the City Coum¢il. it is mot a comm~mity action migrant program. Their intention is to service many elderly citizens and he explained. They have received funds from Palm Beach County. They continue to get calls from people in Boynton Beach for meals and transportation. They do have a gentleman providimg transportation, ~ut need additional to take people to doctors, pick up medicime, etc. They would like to use the requested amount of $2,000 to begJna the program. They have a bus driver now through Manpower of Palm Beach County. This is their home base and they would like to receive something from the City of Boyntom Beach. If they give to this Co-Op, it would help smd add support from the City. Mr. DeLong referred to the Board of Adjustment needing all the help they could get and not having a quorum at the last meeting. Annexation of Property. on Con~ress Avenue Mr. Kohl showed two plans showing the lots and property and stated all the gentleman wanted to know was if it would be acceptable on this basis and he will proceed. He believes the Plsmning & Zoning Board should review this. If they are going to supply services to these people, they should get the benefit of ad valorem taxes. Any place where the~ are rendering a service, they should get the benefit of it~ He referred te The Meadows and the additional revenue. E~wever, they have not had time to study nor discuss this. They don't ksow all the answers and the ~ther people in the ~ity shoml~ have a review. He suggested telling the man the~ were very suscep- tible to annexation, but must agree on it. Budget Discussion Mr. Kohl referred to the general charge in the Utility Fu~d aud stated that 35%was for administrative. He contimued that every city was doing this to a certain limit. There is nothing illegal about this. If they want to change it, he will have to find funds somewhere else, ~ut they don't have funds to look for. Mayor Roberts stated he wanted the City Co~ncil to be aware of the fact that this money was t~en from Utilities and it was a fair amount. DeLong referred to water and sewer and how they were in a lot better shape than other cities. Mayor Roberts added that they are i~ the medium of expansion. Mrs. Jackson referred to 1966 and how the City got in trouble for taking ~/3 across the board from the utilities and using it. This was discussed some and Mr. DeLsng pointed out hew they had made strides i~ the water and sewer system siace 1973. Mr. Harmening stated that for the past two years, they have been good for watching the amount charged to water and sewer for administrative. He remarked when reviewing the budget that they stepped it up considerably, One reassn they got the AAA rating on their water and sewer bonds was because they stepped this skimming practice. If they go back to it, they may not get as goo~ a rating ia. the future. In the con- struction of the expansion of the water plant and during the construction of the regional sewage plant, it is not easy to get the grant. He then explaine~ the · procedure. Besides the $186,000 that they took for a~ministra~ive purDoses, he be- lieves they are paying the complete engineering department out of it. If they do this sad do mot :AaVe fumdS available and funds are required before say grant money, they are going to be very close. Mayor Roberts stated agaia that he just wanted to make the City Council members aware of this. He adde~ that they just got the good news that they may expect 1,000 hookups, which will enhance the utility fund. He will go ahead with the recommendation of the City Manager and let it ride at this point. M~. Harmening stated that personally, he would like to see the amount reduced to a certain extent. He thJwks the engi- neering portion in particular cannot be justified. He is not sure whether the other figure of $186,000 can be justi- fied. He would like to see a breakdown of how this figure was arrived at. Mr. DeLong stated that the budget sessions are over and de- cisions have been made. He thinks a breakdown should have - 16- MINUTe. Mr. Harmening continued and referred to every time they come up with a new water and sewer project, they always find they are short of money. If they have to go into the market for a bond issue, the next thing they will have to do is raise the rates. If they did not spend all the mo~ey by transfer- ring excess amoumts to the general fund, in the future it would not be as necessary to raise funds. Mr. DeLong disagreed and added that time would tell. ~yor Roberts stated he thought everyone had stated their opinions. He just brought it up to get expressions. The figures have been reviewed by the City ~nager ~ud he feels the figure is justified. If it was reviewed, they might knock off $50,OOO. The amount of money involved is not that great. They are moving forward with the new hookups and he thia~ they will recover their ground. He doesn,t want to tie up the budget. M~. DeLoRg stated that he didn't think anyone on the Council of ~973 had asmmuch reserve as he did with the water and sewer system. He will serve the City to give them his know- ledge of his lifetime of service. He will mot let the City back-slide. This is his every day jo~. Mmyor Roberts stated he would be incliRed to go along with the figure suggested. Mr. Harmening stated it was nice to have ~,0OO new sewer connections and ~e off the moratorium, but they must remenuber that this was counting chickens before they hatch. Mayor Roberts suggested that they look ahead in the future.
