4 FLORIDA, RATIFYING THE ACTION TAKEN BY THE SOUTH
5 CENTRAL REGIONAL WASTEWATER TREATMENT AND
6 DISPOSAL BOARD, ON NOVEMBER 8, 2012, AS STATED
7 HEREIN; AUTHORIZING AND DIRECTING THE INTERIM
8 CITY MANAGER AND CITY CLERK TO EXECUTE SAID
9 RATIFICATIONS; AND PROVIDING AN EFFECTIVE DATE.

11 WHEREAS, The South Central Regional Wastewater Treatment & Disposal Board
12 (SCRWTDB) requests ratification of the action taken by the Board at the Quarterly Meeting of
13 November 8, 2012, as set forth in the attached Exhibit "A ".

15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
16 CITY OF BOYNTON BEACH, FLORIDA THAT:

Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution upon adoption.
Section 2. The City Commission does hereby ratify the action taken by the South
Central Regional Wastewater Treatment & Disposal Board on November 8, 2012, as set forth on
the attached Exhibit "A" and authorizes the Interim City Manager and City Clerk to execute said
Ratifications.
Section 3. This Resolution shall take effect immediately upon passage.

RATIFICATION OF SOUTH CENTRAL REGIONAL
WASTEWATER TREATMENT AND DISPOSAL BOARD
ACTION OF NOVEMBER 8, 2012
WHEREAS, the South Central Regional Wastewater Treatment and Disposal Board did on
NOVEMBER 8, 2012, (Agenda Item K1) by a vote of 6 -0, PROVIDED AUTHORIZATION TO
APPROVE THE SEVENTH AMENDMENT TO THE INTERLOCAL AGREEMENT BETWEEN
THE CITIES OF BOYNTON BEACH AND DELRAY BEACH. SECTION 3 POWERS AND
PROCEDURES SUBSECTION (A)3 "A QUORUM FOR THE PURPOSE OF TRANSACTING
BUSINESS SHALL CONSIST OF NOT LESS THAN TWO (2) MEMBERS OF THE CITY
COMMISSION OF BOYNTON AND NOT LESS THAN TWO (2) MEMBERS OF THE CITY
COMMISSION OF DELRAY".
WHEREAS, said Board action requires ratification by the City of Boynton Beach
and the City of Delray Beach.
NOW, THEREFORE, the City of Boynton Beach hereby ratifies said Board action
independently
The above action is hereby ratified in open session by the City of Boynton Beach this

SEVENTH AMENDMENT TO INTERLOCAL AGREEMENT
THIS SEVENTH AMENDMENT TO INTERLOCAL AGREEMENT is made and entered
into this 8th , day of November , 2012 by and between the CITY OF
BOYNTON BEACH, FLORIDA, a municipal corporation, hereinafter referred to as
"BOYNTON ", and the CITY OF DELRAY BEACH, FLORIDA, a municipal corporation,
hereinafter referred to as "DELRAY"
WITNESSETH.
WHEREAS, BOYNTON and DELRAY pursuant to Section 163.01, Florida Statutes,
have heretofore entered into that certain Interlocal Agreement dated the 26 day of
December, 1974 ( "Interlocal Agreement "), establishing the South Central Regional
Wastewater Treatment and Disposal Board (the "BOARD "), as amended by, First
Amendment dated May 27, 1981, by Second Amendment dated September 15, 1983, by
Third Amendment dated October 19, 1995, by Fourth Amendment dated February 18, 2003,
by Fifth Amendment dated September 7, 2004, and by Sixth Amendment dated January 9,
2006, and,
WHEREAS, the BOARD desires to amend Section 3 Powers and Procedures, by
amending Subsection (A) 3 to provide that a quorum for the purpose of transacting business
shall consist of not less than four (4) members comprised of not less than two (2) members of
the City Commission of BOYNTON and not less than two (2) members of the City Commission
of DELRAY
NOW, THEREFORE, be it agreed and resolved as follows.
That certain Interlocal Agreement entered into on the 26th day of December, 1974, by
and between the City of Boynton Beach, Florida, and the City of Delray Beach, Florida is
hereby amended as follows -
1 Section 3. Powers and Procedures Subsection (A) 3., is hereby amended in its
entirety to read as follows.
"(A) 3 A quorum for the purpose of transacting business shall consist of not less
than four (4) members comprised of not less than two (2) members of the City
Commission of BOYNTON and not less than two (2) members of the City
Commission of DELRAY."
2. This Seventh Amendment shall become effective upon ratification by a majority vote
of the City Commission of BOYNTON and the City Commission of DELRAY,
3. This Seventh Amendment shall be filed with the Clerk of the Circuit Court in the
Fifteenth Judicial Circuit in West Palm Beach, Florida.
4. The Interlocal Agreement as heretofore amended shall remain in full force and
effect, altered only to the extent of this Seventh Amendment
