Simon, City Attorney Frank Kohl, City Manager Robert Federspiel, Qnheh~f of City Attorney Tereesa Padgett, City Clerk OPENINGS Mayor Roberts called the meeting to order at 7:30 P.M. He asked all to rise for the invocation given by Mr. Wilton Shelton, Minister of Music and Education, 1st Baptist Church, followed by the Pledge of Allegiance to the Flag, led by Vice Mayor DeLong. Council decided to place an additional item on the Agenda regarding the forthcoming meeting on the Regional Wastewater Treatment Plant. Announcements Mayor Roberts read a Proclamation designating April 19, 1975 as Pati-iot's Day, with a request that all citizens in the City fly the national flag from sunrise to sunset. The Mayor then read a Proclamation designatingMay. 3-4, 1975 as Festival of the Arts Weekend. It was noted that Mr. Bob Federspiel was substituting for the City Attorney, Mr. Simon. Mr. DeLongcomplimented the City Manager for his perserverance in fiuallygetting the traffic light working on 23rd Avenue and U. S. He alsocommended the City Manager about the dressing of the sand bank atithe public beach which was doue by the General Services Department under thesupervision of Fred Patrick along with the City's bulldozer operator, Frank Moore. Mr. DeLong noted that Boynton Beach was the first City in the County to have been gra~ted a temporary perm/t to operate the land fill operation, which speaks well for the supervision of the City Manager and General Services Department. The Mayor asked all those wishing to speak ab~at items on the agenda to give their names to the City Clerk so they could be called at the appropriate time. MINUTES Regular City Co~acil Meeting - April 1, 1975 Mrs. Jackson referred to page 4, paragraph 2 -- the last line should read ...'~r. Kohl return in a few weeks with a report." Mr. Strmad requested a clarification of the correction on page 2, paragraph 6 regarding the Minutes of Special City Council Meeting of March 25, 1975 (paragraph 2, page 2). The sentence should read, '~rs. Jackson noted that Hardrives was going to charge the City $10,800 if the temporary road was left there." Mr. Strnad referred to page 3, paragraph 1 for clarification of the next to last sentence, which should now read -- "The Mayor said he's also received phone calls from some who are also opposing the closing the perimeter road around the south end of the ball field." On page 9, p~agraph 1, the spelling of Mr. Eckert's name should be corrected in lines 2 and 4. Mrs. Jackson referred to page 18, paragraph 2, the word "included" to "spelled out ..." last line -- change Mr. Harmening corrected pageil3, 1st sentence of the last paragraph to read -- '~r. Kohl said about three weeks ago he had a meeting with Mr. Cicione, Fred Singer, Herb Kahlert, the Assistant County Engineer and County Engineer respectively, Tom Clark and Jack Bar~ett, aud the money for this road was discussed." Mrs. Jackson moved to adopt the Minutes of April 1, 1975 as corrected, seconded by Mr. Harmening. No discussion. Motion carried 5-0. .Special City C~mcil Meeting - APril 3, 1975 Mrs. Jackson moved to adopt the Minutes of April 3, 1975 as written. Mr. Strnad seconded. No discussion. Motion carried 4-0, with Mr. Harmening abstaining as he was not present. - 2- MINUTES OF REG-U-LAR GITY COUNCIL MEETING OF THE CIT~ OF BOYNTON BEACH, FLORIDA, HELD AT CITY MALL, TUESDAY, APRIL 15, 1975. PUBLIC AUDIENCE Mr. Tom Beattf% 210 N.W. 20th C~urt, came forward to state that nothing had been done regarding recent complaints about the neighborhood park. It was explained that policemen from the B&E Squad had spent considerable tim~ at the park (Rolling Green) to observe the activities there without being seen, and it was found that nothing was out of order. There was considerable discussion between Mr. Beat~ amd Council amd also with Mr. O'Lalessandro, who had complained,at the last meeting, and the gentlemen were advised they could review the Police Department's report in the City Manager's office. Mr. DeI~ag moved to dispense with the matter and be guided by the report of the Police Department and any further ~r complaints along these lines should be directed to the of the City Manager. Mrs. ~ackson seconded. No discussion. Motion carried 5-0. BIDS Two (2) Police Motorcycle Radios Fir. Kohl noted that this item was deleted from the March 18th Agenda as it hadn't been advertised. The Tabulation Committee recommended acceptance of sole bid frem MotoroIa, Inc. in the amount of $2,954.00. Funds are available in Account 860-99. All requirements have been met and Mr. Kohl concurred with the Tabulation Committee. Mr. Harmening moved to accept the City Manager's recommendations, seconded byMr. DeLong with the request that same be spread upon the Minutes as above. No discussion. Motion carried 5-0. Mr. DeLong moved to dispense with the regular order of business as it was too early for the Public Hearing at 8:00 P.M. Mr. Harmening seconded. No discussion. Motion carried 5-0. Mr. Startzman, the City's liaison man on the above project requested Council be polled as to a meeting with Delray Beach representatives om Monday, May 5, 1975 at 7:~ P.M. Council agreed unamimously and it will be decided later where the meeting will be held. Mr. DeLong moved to return to the re~alar order of business, seconded by Mr. Harmening. No discussion. Motion carried 5-0. -3- MINUTES OF REGULAR CITY COUNCIL MEETING OF THE CITY OF BOYNTON BEACH, FLORIDA, HELD AT CITY HALL, TUESDAY, APRIL 15, 1975. PUBLIC HEARING - 8:00 P.M. Beynton-Delray Seventh Day Adventist Church, 130-138 S.E. 27th Avenue - Conditional Use to Allow Addition of School Rooms to be Built om Existin~Chureh Mrs. Jackson wished to clarify that this addition was to be for Sunday school ro~ms. The:bMayor asked if anyone wished to speak in favor of this matter. Mr. Blen Shaver, 301 S.E. 5th Street, Delray Beach, representing the Church in question, came forward to speak in favor of this request and read a Petition indicating theire were no objections to the addition. The Petition was signed by 64 neighbors living within approximately 300 feet of the area. Mr. Shaver requested that the City c~ancil authorize the Building Department to grant the building permit without further delay if possible. The Mayor asked if anyone wished to speak in opposition to this item. No reply. Mr. Harmening moved to instruct the Building Department to grant the Church the permit for conditional use to allow the addition of Sunday school rooms to he built on the existing church. Mr. DeLong seconded. No discussion. Motion carried 5-0. Mr. DeLong requested that the Minutes reflect the recommendations of the Planning & Zoning Board (copy attached -- from the Minutes of April 8, 1975). Mr. Federspiel them read Ordinance No. 75-16 re the above on first reading. Mrs. Jackson clarified with Mr. Shaver that this addition was for Sunday school rooms (Sabbath school rooms) specifically and had nothing to do with the existing day school Discussion ensued among Council as to whether the wording in th~ Ordinance shonldbe changed and Mr. DeLong felt the previous motion to expedite' the building permit was incorrect as this was not an emergency ordinance and there had to be a second reading. Mr. DeLong moved to reconsider the previous motion, seconded by Mr. Harmening. No discussion. Motion carried 5-0. Mr. DeLong moved that the motion in question he stricken, seconded by Mr. Strnad. No discussion. Motion carried 5-0. -4- ~MINUTES OF REGULAR CITY COUNCIL MEETING OF THE CITY OF BOTNTON BEACH, FLORIDA, HELD AT CITY HALL, TUESDAY, APRIL 15, 1975. Returning the discussion to the public hearing, Mrs. Jackson moved to accept the recommendations of the Planning & Zoning Board as reflected in their Minutes of April 8, 1975 and to grant conditional use to allow the addition of Sunday school rooms to be built on the existing Boynton-Delray Seventh Day Adventist Church (copy of said Minutes attached). Mrs. Jackson' requested a change to be made in both the title and body of Ordinance No. 75-16 to include the words "SabbaWa school rooms''. With said change in mind, .Mr. DeLong moved that Ordinance No. 75-16 he adopted om first reading. Mrs. Jackson sec~mded. No discussion. Mr. Shaver was concerned about how much longer a wait there would be ~efore the building permit would be granted and it was explained that there would be a three-week span before the second reading of the Ordinance and a ten-day waiting period beyond that. This is a matter of procedure and falls under City and State law. Mr. Shaver was told that he would not have to worry that Council would change its mLnd and also that he would be notified accordingly. Other Discuss Amendment to Charter - Section 145 & 146 - Re: Recall Provisions (Mayor Roberts) Mayor Roberts noted that he had proposed this last year and Mr. Simon suggested it being a new item, it should be tested for a while. Mr. Roberts felt Section 145 and 146 should now be updated accordingly. He said there were three other chapters that follow this (Chapter 112) which should also be reviewed and amended. Mrs. Jackson moved to follow the Mayor's suggestion and amend Section 145 and 146, seconded by Mr. Harmening. Motion carried 5-0. ldr. Consider Support of Naples Resolution - Re: Reconsider Present Electric P~wer Rate I~crease ~ayor Roberts)~ Mayor Roberts felt that a letter should be semt from the City indicating full support of the above Resolution. Mrs. Jackson moved that a letter be sent backing up the Naples Resoluti~a and Mr. DeLong seconded with the inclusion that a copy be sent to the County L~ague of Municipali~s:. Mrs. Jackson agreed and included that a copy be sent to the Florida League of Cities also. Mr. Harmening f~rther clarified that the Resolution sent out by the City of Naples addresses itself primarily to the recent action of the PubLic Service Commission in which they were goimg to allow the electric utility companies to raise their rates during the summer which is the peak period and it was felt by those in Naples that this was a method to allow the electric utilities to,ss.along their financing costs for new construction. This Resolution might be effective in n*t:allowing this and also allow the construction industry to absorb the /mpact of these new facilities rather than the present constmaer. Mr. Harmening wished to go on record as being opposed to that portion of the rate increase called the "s,~mmer rate increase" in any letter. Motion carried 5-0. OLD BUSINESS Discuss Recreational Facilities - Councilm-~ Str--.d Mr. Strnad noted that there were no proper boat ramps into the City fresh water canals. He felt the City should put in a boat ramp in the B~ynton Canal at 8th Street. The area is in poor condition now and he felt there should be a cement ramp installed. Mr. DeLongmoved to instruct the City Manager to report back to the City Council regarding the feasibility of Mr. Struad's suggestion. -7- · MINUTES OF REGULAR CITY COUNCIL MEETING OF THE CITY OF BOYNTON BEACH, FLORIDA, HELD AT CITY HALL, ~ESDAY, APRIL 15, 1975. Hr. Kohl advised that he already has plans drawn and he has written to the State and the Florida Flood C~ntre~l~fr~m ~w~om he has received approval. Progress Report of Proposed Zoning Map The May~r noted it was hoped to get the new zoning map completed within the next three weeks and discussion e~sued as to the procedure of reviewing the Zonimg Ordinance and map and adopting Mr. Joe Kelly, Chai~ of the Plm~img & Zoning Board reported on the progress of the new zoning and felt the Beard's work wonld be e~mpletedwithin the next weekand a half. The noted that before the Ordinance was re~d, of advertis~would be required and also themap should available for people to c~ne in and see. Mr. Jack Barrett, Building Official, discussed the timing involved to get everything in order before a public hearing is held and the map and Ordinance are ready to be reviewed. Council wanted to he certaimeverything: would be ready before the residants began leavimg for vacation. The Mayor noted that the reading of the Ordinance would take a full night and it was decided this would be done on Thursday evening, May 8, 1975, with the zonin~map on display. After establishing that the map and Ordinance should be advertised for two weeks at the same time, it was decided to have a public hearing for the new zoning map on May 13, 1975 and May 14, 1975.for the north and south sections of the City respectively. Hr. Kelly said he would keep Council posted as to the re~aining progress. Hrs. Jackson moved to have the first reading of the Zoning Ordinance om May 8, 1975 at 7:30 P.M. in City Hall. Hr. Status Report on Property Adjacent to Municipal Boat Ramp Park., Mr. Kohl advised that in June, 1974 the City Council asked the City Manager to look into the feasibility of purchasing parcels of land frontimg om U.S. 1, contiguous to the City's Municipal Boat Ramp Park. When the Gity inquired about assistence, it was trying to purchase the back half om the waterfront. After many months of not being able to c~me up with a solution, Mr. Goldberg, who owns the parcel of land in question has submitted three alternatives te the City. T~is tract cf]and is rectangular in shmpe with s~me 202.8 feet frontage on U. S. I and a depth of 1,056 ft. to the waterfront -- approximately 4.734 acres. This parcel of land has improvements cousisting of small cottages; sw~ming pool and shuffleboard c~arts. Fir, Geldberg realizes approximately $35,000.08 rental income per year from the cottages. }fr. Kohl attached proposals s~hmitted by Mr. Goldberg to his report which was before C~ncil. This parcel of ]~nd could be acquired with $100,~00.00 payment ~ith either a first or sec~ad mortgage. Mrs. Jackson questi~ned the exact location ef the parcel and it was stated te be known as Inlet Village, which is north of the Valentine Cou~ts. Status Report on ClOSi~ of $,H. 3rd~St`reet (High Pt. ) Mr. Kohl read the letters re=sired fr~ the Presidents of H~h Point's various sections concerned with the closing of S.W, 3rd Street. The }~ayor clarified that this does not, refer to the sectiom closed off by DOT, but to the new road te~bebuilt next te the pump house. Mr. Kohl also read a letter from M~. Perry Gessna, Utilities Director, on this subject. - - MINUTES OF REGULAR CITY CODNCIL MEETING OF THE CIT~ OF BOYNTON BEACH, FLORIDA, HELD AT CITY HALL, TUESDAY, APRIL 15, 1975. Mr. Bill Elam, referred to S. was in error. P. O. Box 23, BoyntonBeach, noted that the question W. 3rd Street amd not S. E. 3rd Street~ T~e agenda Hrs. Padgett advised that several people requested to speak on this item and it was decided to wait until the motion was made. Mrs. Jackson moved to close the south entrance of S. W. 3rd Street and reopen the north end of 3rd Street around the ballpark to connect with 15th Avenue at Seacrest. Mr. DeLong seconded. Under discussion, Mrs. Jackson noted that the residents of High Point made a compromise in the interest of the health and welfare of everyone. Mr. DeLeng felt it didn't make any difference where an entrance or exit was because if work had to be done, equipment would have to get in. Mr. BeLong felt the proper motion should he to have the City Attorney draft the appropriate Resolution for closing the s~ath entrance of S. W. 3rd Street and opening the north end, making it a public right of way and also the City Engineer should be znstruct~ to c~ange the street maps accordingly. A man in the audience objected to the opinions of the presidents of the organizations as not being in accord~with all residents. Mayor Roberts said he had received a n~mber of phone calls from people objecting to the closing of 3rd Street on the south end and going into 23rd. However, the majority appears to be in favor of closing the 23rd Av~a=e Exit; Council doesn't have much choice but to go along with it. Mr. Arth~rMeig~280 Main Boulevard, said the residents of Main Boulevard are mostly effected by this ball park and he felt that changing the streets as proposed above would cause a safety hazard and he asked for Council's consideration before a vote by Council was taken. Mr. Meigh~sp ke in opposition to the votes cast by the various sections and Mayor Roberts noted that the condominium documents set the requirements about votes. After further dis- eussionbetweenMr. Me~ghand Council, Mr. DeLOng noted that the north s~eet that cuts throngh behind the hail park could be posted to indicate no thru traffic and the Mayor said the area wi11 be landscaped as far as the lights are concerned so as not to be a nuisance to the residents. Mr. DeLong then read a communication from Mr. Flushing, Assistant to the City Engineer addressed to Mr. Kohl, dated February 13, 1975, re the entrance to S. W. 3rd Street from S. W. 23rd Avenue, stating that the subject entrance would not be opened by the ~OT under the present conditions. The DOT would like to eliminate the S. W. 3rd Street entrance which was felt would also eliminate a potential traffic hazard. The Mayor called a brief recess to allow those wishing to leave to do so -- at 9:16 P.M. The meeting was re-called to order at 9:22 P.M. The meeting opened with some discussion about changing the number of a previously read Ordinance No. 75-18 to be in sequence (see notation, last paragraph, page 6). Mrs. Jackson moved to change Ordinance No. 75-18 to No. 75-17, seconded by Mr. DeLong. No discussion. Motion carried 5-0. NEW BUSINE$$ Preliminary Approval of Plat for Yach~mm~'s Cove Mr. Kohl referred to an action of the Pla~ing & Zoning Board on the above project at their meeting of February 11, 1975, at which time Col. Trauger made a motion to feeble-.end final approval to City Council of the plat for Yachtman's Cove, seconded byMr. Walker. Motion carried 7-0. Mr. Kohl has the signed plat in his office, except for tonight when it is at the meeting. This has been forwarded to the City Attorney to prepare the appropriate Ordinance in the event Gouncil approves this request. Mr. Kohl Said the delay on this request was due to the fact that the developer had not presented the Mylar print whichMr. Kohl received on )th. Estimated cost has been submitted and bond shall be that amount. The City Attorney has been advised of this. Mr. Kohl asked if Council wanted the bond prior to issuance of !the building perm/ts or prior to recording. Mr. Kohl requested approval f~r the Mayor's execution of the Mylar prints. After Council determined that the bond should be ssuing any buildingpermit. Mr DeLong moved to acee~t preliminary approval of plat for Mr. Struad seconded. No discussion. Motion 5-0. Proposed Ordinance No. 75-18 - Re: Final Approval of Plat for Yachtman' s Cove Mr. Federspiel read the above Ordinance in its entirety em first reading. Mr. BeLong moved for the adoption of Ordinance No. 75-18 on first reading with the inclusion that although it does not say spacifically in the Ordinance, that there will he no issuance of building permit until such time as the performance bond has been posted. Mr. Strnad sec~aded. Mr. Harmening felt the bond should he posted Before recording because there might be a possibility that the land improvements -- sidewalks, curbs, etc. mi§hr not he dome so he thought the Council's previous action may have been incorrect. Radio Tower (Mr. Ben Johnston) Mrs. Jackson asked Mr. Barrett if this was m~mething temporary and Mr. Barrett said it was almost two years. Regarding some things which were not in line, Mr. Barrett sent a letter out on/ii, arch 20th giving 15 days to correct them. They were corrected within five days, however, there is now some heavy equipment back again. Mr. Barrett had a copy of a letter received from Mr. Johnston's attorney, John Ross Adams, whom he had tried to reach by telephone but has not as yet been able to do so. The Mayor said it was not a requirement for a m~,her of the Building Department to he present at CAB meetings and if there was a wish for policy to be changed, it should come before Council. Mrs. Jackson suggested if any Board wished to bring a matter to Council's attention, a letter should be written to the attention of the Mayor so it could appear on the Agenda. Mr. DeLong moved to have the City Manager send a memo to all Boards stating that any problems shonld he referred to the City Mana§er, who in turn would notify Council where the appropriate action may be taken. He also said the CAB shenld send in a request to amend the presont CAB Ordinance whereby there is a representation by those it was felt necessary should be present at CAB meetings. Mrs. Jackson stated in the form of a substltute motion that it was not the prerogative of the City Manager to send a memorandum to the Boards, hut that such a letter should he sent from the Mayor on behalf of Council.
