3 AN ORDINANCE OF THE CITY COMMISSION OF THE
4 CITY OF BOYNTON BEACH, FLORIDA,
5 DESIGNATING THE PROPERTY KNOWN AS THE
6 OSCAR MAGNUSON HOUSE LOCATED AT 211 EAST
7 OCEAN AVENUE, WHICH IS MORE FULLY
8 DESCRIBED HEREIN, AS A LOCAL HISTORIC SITE;
9 PROVIDING A NON - SEVERABILITY CLAUSE AND AN
10 EFFECTIVE DATE.

12 WHEREAS, Chapter 4, Article IX, Section 6.C. of the City of Boynton Beach Land
13 Development Regulations provides for the designation and protection of historic sites in the
14 City of Boynton Beach; and
15 WHEREAS, the Oscar Magnuson House, a home which is a two -story residential
16 structure built c. 1919, is a fine example of the early Frame Vernacular style built in Boynton
17 Beach; and
18 WHEREAS, the Historic Preservation Board of the City of Boynton Beach prepared a
19 designation report for the designation of the Oscar Magnuson House as a historic site and held
20 a duly noticed public hearing in regard to the designation of the property as an historic site at
21 which no member of the public spoke in opposition to the designation of the property as an
22 historic site; and
23 WHEREAS, the Historic Preservation Board of the City of Boynton Beach on
24 December 10, 2012 recommended that the Oscar Magnuson House be designated a historic
25 site; and
26 WHEREAS, the City Commission of the City of Boynton Beach has conducted a
27 duly noticed public hearing in regard to the designation of the Oscar Magnuson House as a
28 historic site.
29 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF

I THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
2 Section 1. The foregoing whereas clauses are true and correct and are now ratified
3 and confirmed by the City Commission.
4 Section 2. The Oscar Magnuson House is located at 211 East Ocean Avenue,
5 which is legally described on the survey which is attached and incorporated into this
6 Ordinance as Exhibit "A ", and is hereby designated as the Oscar Magnuson Historic Site in
7 accordance with and under the provisions of Chapter 4, Article XI, Section 6.C., of the City of
8 Boynton Beach Land Development Regulations.
9 Section 3. It is the intention of the City Commission of the City of Boynton Beach
10 that this Ordinance and each and every of its terms be considered a part of a single whole and
11 that the Ordinance not be severable and that if a court of competent jurisdiction finds that any
12 section of this Ordinance is unlawful or unenforceable the Ordinance shall be unenforceable it
13 its entirety.
14 Section 4. This Ordinance shall become effective immediately upon its passage
15 and adoption.
