O78-61_~- GEnE MOORE ORDINANCE NO, 78_-g% AN ORDINANCE OF THE CITY Of BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO, 75-19 OF SAID CITY BY REZONING A CERTAIN PARCEL OF LAND LOCATED IN SECTION-31, ToWN- SHIP 45~RANGE 43 EAST~ PALM BEACH COUNTY~ FLO~IDA~ MORE PARTICULARLy DESCRIBED HEREINAFTER, FROM LONE- AGRICULTURAL TO PLANNED UNIT DEVELOPMENT (PUD) DISTRICT WITH LAND USE INTENSITY (LUi) OF 4,1; PROVIDING FOR SAVINGS CLAUSE~ REPEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHER PURPOSES, WHEREAS, THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, :LORIDA, HAS HERETOFORE ADOPTED ORDINANCE No, 75-19 IN WHICH A REVISED ZONING MAP WAS ADOPTED FOR SAID CITY; AND WHEREAS, FREDERICK ZEIGER, TRUSTEG HAS HERETOFORE FILED AN APPLICATION WITH THE CITY OF BOYNTON BEACH, FLORIDA; PURSUANT TO SECTION 31-1 OF THE CODIFIED ORDINANCES OF SAID CITY, FOR THE PUR- POSE OF OBTAINING REZONING OF CERTAIN PROPERTY CONSISTING OF APPRO~ MATELY i05,83 ACRES LOCATED WITHIN THE MUNICIPAL LIMITS OF SAID CITY, SAID PROPERTY BEING MORE PARTICULARLY DESCRIBED HEREINAFTER, :ROM ZONE-AGRICULTURAL TO PLANNED UNIT DEVELOPMENT (PUD) DISTRICT iS MORE PARTICULARLY SET FORTH IN SAID APPLICATION AND PLANS AND SPECIFICATIONS RELATIVE THERETO, INCLUDING THE PROPOSED DEVELOPMENT PLANS AND SPECIFICATIONS FOR SAID DEVELOPMENT, ALL OF WHICH ITEMS ARE NOW ON FILE IN THE OFFICE OF THE CITY PLANNER; AND WHEREAS, THE PLANNING AND ZONING BOARD OF THE CITY OF BOYNTON BEACH, FLORIDA, HAS HERETOFORE APPROVED SAID DEVELOPMENT PLANS AND SPECIFICATIONS AND HAS RECOMMENDED APPROVAL THEREOF BY THE CITY COUNCIL SUBJECT TO CERTAIN CONDITIONS; AND WHEREAS, THE CITY COUNCIL HAS THOROUGHLY EXAMINED THE AFORE- ~AID DEVELOPMENT/ PLAN AND SPECIFICATIONS RELATIVE THERETO~ AND HAS RECEIVED FAVORABLE RECOMMENDATIONS AND APPROVAL OF SAID PROJECT FROM THE CITY MANAGER AND CITY PLANNER; AND WHEREAS, THE CITY COUNCIL DEEMS IT TO BE IN THE BEST INTEREST, OF THE INqABITANTS OF THE SAID CITY TO AMEND THE AFORESAID REVISED ZONING MAP AS ~EREINAFTER SET FORTH, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BbYNTON BEACH, FLORIDA: SECTION 1Z THAT THE FOLLOWING DESCRIBED LAND LOCATED IN SECTION 31, TOWNSHIP q5 SOUTH, RANGE 43 EAST, CITY OF BOYNTON BEACH PALM BEACH COUNTY, FLORIDA, BE AND THE SAME IS HEREBY REZONED FROM ZONE-AGRICULTURAL TO PLANNED UNIT DEVELOPMENT (PUD): SEE ATTACHED SCHEDULE SECTION 2: SHALL BE AMENDED SECTION 3: THE AFORESAID REVISED ZONING MAP OF THE CITY ACCORDINGLY, THAT THE APPLICATION OF FREDERICK ZEIGER, TRUSTEE OWNER OF THECABOVE DESCRIBED TRACT OF LAND~ FOR REZONING OF SUBJECT TRACT IS HEREBY GRANTED FOR THE PURPOSE OF PERMITTING THE DEVELOP- MENT OF SAID LAND AS A PLANNED UNIT DEVELOPMENT (PUD) IN SPECIFIC ACCORDANCE WITH DEVELOPMENT PLANS AND SPECIFICATIONS THEREFORE NOW ON FILE IN THE OFFICE OF THE CITY PLANNER IN THE CITY OF BOYNTON BEACHj FLORIDA~ AND ALL REQUIREMENTS, TERMS AND CONDITIONS ESTAB- LISHED AND SET FORTH IN MINUTES OF THE MUNICIPAL PLANNING AND ZONIN BOARD AND THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH PERTAINING TO THE REVIEW AND APPROVAL OF SAID APPLICATION WHICH MINUTES ARE HEREBY MADE A PART HEREOF FOR REFERENCE. EXCEPT AS PROVIDED HEREINj THE APPLICANT SHALL PROCEED IN STRICT ACCORDANCE WITH ALL ORDINANCES OF THE INCLUDING~ BUT NOT LIMITED TO, ITS BUILDING, SUBDIVISION, PLANNING AND ZONING CODES, SECTION 4: ~ EACH OF THE CITY Of BOYNTON BEACH ELECTRICAL, PLUMBING, PROVISIONS OF THIS ORDINANCE IS SEPARABLE, INCLUDING WORD~ CLAUSE, PHRASE OR SENTENCE, AND tF ANY PORTION THEREOF SHALL BE DECLARED INVALID, THE REMAINING PORTION SHALL NOT BE AFFECTED BUT SHALL REMAIN IN FULL FORCE AND EFFECT, SECTION 5: REPEALING PROVISION: ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH ARE HEREBY REPEALED, SECTION 6: AN EFFECTIVE DATEI THIS ORDINANCE SHALL BECOME EFFECTIVE IN THE MANNER AND AT THE TIME PROVIDED BY LAW, FIRST READING THIS ~ DAY OF DECEMBER~ A,D,, 1978, SECOND~ FINAL READING AND PASSAGE THIS /~ DAY OF DECEMBER, 1978.
