O78-51ORDINANCE NO. 78-~1 AN ORDINANCE OF THE CITY OF BOYNTON BEACH~ FLORIDA AMENDING SECTION 20 (b) OF THE CODIFIED CHARTER OF SAID CITY ENTITLING PERSONS RECETV~NG PENSION OR RETIREMENT BENEFITS FROM THE CiTY TO SERUE AS CITY COUNCILMEN, PROVIDING FURTHER FOR A SAVINGS CLAUSE, REPEALING PROVISION, AUTHORITY TO CODIFY, AN EF- FECTIVE DATE AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEACH, FLORIDA: Section 1: That the sixth sentence of Section 20 (b) of the Codified Charter of the City of Boynton Beach, Florida; being a portion of Section 1, Chapter 67 1~19. Special Acts of Florida, which reads: "No person receiving pension or retirement benefits from the city may serve for compensation mn any city office or employment without waiving all such benefits while so serving." BOYNTON Be and the same is hereby amended to read: receiving pension or retirement benefits from the NO persons City may serve for compensation as a City employee without wamving all such bene- fits while so serving; however, this provision shall not prohibit a person receiving pension or retirement benefits from the City fro~ serving as a duly elected member of the City Council and being entitled to compensatioh ~the~efore. Section 2: Authority to Codify: Specific authority is hereby granted to codify and incorporated this Ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this Ordinance is separable, including word, clause, phrase, or sentence, and if any portion thereof shall be declared invalid, the rem&lnln~ portion shall no~ be affected but shall remazn in full force and effect. Section 4: Repealing Provision: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5: An Effective Date: This Ordinance shall become effective in the manner and at the time provided by Law.
