13-001 I 1 ORDINANCE NO. 13 -001 2 3 AN ORDINANCE OF THE CITY COMMISSION OF THE 4 CITY OF BOYNTON BEACH, FLORIDA, 5 DESIGNATING THE PROPERTY KNOWN AS THE 6 BOYNTON HIGH SCHOOL LOCATED AT 125 EAST 7 1 OCEAN AVENUE, WHICH IS MORE FULLY 8 DESCRIBED HEREIN, AS A LOCAL HISTORIC SITE; 9 , PROVIDING A NON- SEVERABILITY CLAUSE AND AN 10 EFFECTIVE DATE. 11 12 WHEREAS, Chapter 4, Article IX, Section 6.C. of the City of Boynton Beach Land 13 Development Regulations provides for the designation and protection of historic sites in the 14 City of Boynton Beach; and 15 WHEREAS, the Boynton High School, a two -story school building built in 1927, is 16 designed mostly in the Mediterranean Revival style but also shows elements of the up and 17 coming art Deco style which flourished in the early 1930s; and 18 WHEREAS, the Historic Preservation Board of the City of Boynton Beach prepared a 19 designation report for the designation of the Boynton High School as a historic site and held a 20 duly noticed public hearing in regard to the designation of the property as an historic site at 21 which no member of the public spoke in opposition to the designation of the property as an 22 historic site; and 23 WHEREAS, the Historic Preservation Board of the City of Boynton Beach on 24 January 14, 2013 recommended that the Boynton High School be designated a historic site; 25 and 26 WHEREAS, the City Commission of the City of Boynton Beach has conducted a 27 duly noticed public hearing in regard to the designation of the Boynton High School as a 28 historic site. - 1 - I 1 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 2 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 3 Section 1. The foregoing whereas clauses are true and correct and are now ratified 4 and confirmed by the City Commission. 5 Section 2. The Boynton High School is located at 125 East Ocean Avenue, which 6 is legally described on the survey which is attached and incorporated into this Ordinance as 7 Exhibit "A ", and is hereby designated as the Boynton High School Historic Site in 8 accordance with and under the provisions of Chapter 4, Article IX, Section 6.C., of the City of 9 Boynton Beach Land Development Regulations. 10 Section 3. It is the intention of the City Commission of the City of Boynton Beach 11 that this Ordinance and each and every of its terms be considered a part of a single whole and 12 that the Ordinance not be severable and that if a court of competent jurisdiction finds that any 13 section of this Ordinance is unlawful or unenforceable the Ordinance shall be unenforceable it 14 its entirety. 15 Section 4.
