Section 1: That Section 21-35 of Chapter 21 of the
Codified Ordinances of the City of Boynton-Beach, Florida, is
hereby amended by adding a second paragr@ph thereto to read as
follows:
"A member of the plan who transfers to employ-
ment at the City of Delray Beach at the South
C~tr~l Regional Wastewater Treatment and
Disposal Facility and subsequently becomes a
me~ber of the City of Delray Beach pension p~lan
shall not be considered to have terminated service
with the City for the purpose o~ determining
whether or not he has completed ten or more years
of service unless and until such member either
withdraws his contribution under this plan as
descrit~ed in Section 21-55 but for the purpose
of determining the amount of annuity described
in Section 21-47 or 21-50 such service after
transfer shall not be counted."
Section 2: Separability: Each of the provmsions of
this ordinance are separable, including word, clause, phrase of
sentence, and if any portion thereef shall be declared invalid,
the remamning portion shall not be affected but shall remamn in
full force and effect.
Section 3: Repealing Provision: Ail ordinances or
parts of ordinances in conflict herewith are hereby repealed.
S.ectioa 4: Authority to Codify: Specific authority
is hereby granted to codify and incorporate this ordinance into
the City's existing Code.
Section 5: An effective Date: This ordinance shall
become effective in the manner and at the time provided by law.
