3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA APPROVING AND AUTHORIZING THE CITY
5 MANAGER TO ACCEPT AND SIGN THE PROPOSAL DATED
6 FEBRUARY 14, 2013 WITH MARINE ENGINEERING &
7 CONSTRUCTION, INC., OF BOYNTON BEACH, FL TO
8 PROVIDE BARGE SERVICES FOR THE JULY 4 FIREWORKS
9 DISPLAY FOR THE YEARS 2013 THROUGH 2017 FOR AN
10 ANNUAL EXPENDITURE OF $15,000; AND PROVIDING AN
11 EFFECTIVE DATE.

13 WHEREAS, in previous years the CRA has handled the 4 of July fireworks event
14 but during the budget process for fiscal year 2012/13 it was determined that the event would
15 revert back to the City's responsibility; and
16 WHEREAS, as part of the fireworks display, the City is required to provide barge
17 services; and
18 WHEREAS, several companies were contacted but only the proposal from Marine
19 Engineering & Construction, Inc., and a verbal approximation from another company in the
20 amount of $27,000 to $30,000 were received; and
21 WHEREAS, the City Commission of the City of Boynton Beach upon
22 recommendation of staff, deems it to be in the best interest of the citizens of the City of
23 Boynton Beach to approve and authorize the City Manager to accept and sign the proposal
24 dated February 14, 2013 with Marine Engineering & Construction, Inc., of Boynton Beach,
25 FL to provide barge services for the July 4 fireworks display for the years 2013 — 2017 for
26 an annual expense of $15,000.00.
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
28 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

1 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
2 being true and correct and are hereby made a specific part of this Resolution upon adoption
3 hereof.
4 Section 2. The City Commission of the City of Boynton Beach, Florida does
5 hereby approve and authorize the City Manager to accept and sign the proposal dated
6 February 14, 2013 with Marine Engineering & Construction, Inc., of Boynton Beach, FL to
7 provide barge services for the July 4 fireworks display for the years 2013 — 2017 for an
8 annual expense of $15,000.00, a copy of the proposal is attached hereto as Exhibit "A ".
9 Section 3. This Resolution shall become effective immediately upon passage

ITEM DESCRIPTION AMOUNT
Marine Engineering and Construction agrees to provide barge
crane crew and tugboat services to the city of Boynton Beach
for their July 4 fireworks display for 2013 -2017 under the
following terms and conditions: 11
Equipment will arrive at the staging area provided by the city
of Boynton Beach on the morning of July 3.
2. All construction equipment and supplies will be removed and
temporarily stored at city staging area. Crane will remain on
barge but will be moved to the end to allow for the most
useable space for display.
3. Once fireworks are set up barge will be moved to show area
in the Infra Coastal Waterway at request of the City and or
Fireworks company. At this time the barge will be properly
anchored. After show barge will be moved back to staging
area to prepare for removal of fireworks equipment and
reloading of barge on July 5, MEC barge will be swept clean
of all debris by contract fire works company

For the attached services Marine Engineering will charge:
2013 - 15,000
2014 - 15,000
2015- 15,000
2016- 15,000
2017 - 15,000
Terms are as follows:
1. 50% of yearly fee due by June 1 of that year
Balance due on or before July 4
2. MEC agrees to honor the reduced rate of 15,000 per event
for the term of 5 years. The City may not cancel this
agreement for July 2013 but may cancel subsequent years if
the City Commission does not appropriate funds for a City 4
of July fireworks celebration during the City's annual
adoption of the City's budget. If for this reason the city
wishes to cancel any remaining years of the agreement a
5,000 cancellation fee will apply at which time the agreement
will be voided. The City will notify Marine Engineering &
Construction, Inc. whether funds have or have not been
appropriated no later than November 1" of each fiscal year
and cancellation payment will be made on or before this date.
