TO OPEN BURNING AND FROST PROTECTION FIRES;
PROVIDING FURTHER FOR AUTHORITY TO CODIFY,
SAVINGS CLAUSE, REPEALING PROVISION, AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA;
Section 1: Chapter 17-5 of the Rules of Florida
-~ 3. Department of Polution Control relative to open burning and
frost protection fires, a copy of which ~s attached hereto an~
made a part hereof, are hereby adopted by ~e~erence and S~Rules
shall here~ere be controlling within the city limits of the
City of Boynton Beach, Florida.
Section 2: Authority to__Codify: Specific authority
is hereby granted to codify and ~ncorporate this Ordinance in the
City's existing Code.
Section 3: Sepa~abili~t~: Each of the provisions of
this Ordinance is separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4: Repealing P~rovi~ion: All ordinances or
parts of ordinances in conflict herewith are hereby re~Deated.
Section 5: An Effective Date: This Ordinance shall
become effective in the manner and at the time provided by law.

2. The Department may require tha~ samples
be made by the applicant and may require that
samples of the fuel be submitted for tesiing to the
Department of Ag~icuiture'and Consamer Services.
3. The Department shall not approve any fuel
whlch emi~ excessive visible emlssiom~ when burned
in the proper manner.
4. The Depa~tanent may approve a fuel on
condition that it be used for certain specified
purposes and in a certain specified rearm er. (b} Outdoor heating devices:
1. Any person desiring to have an outdoor
heatin~ device approved may submit a~ appllcziion.
The application shall contal~ the following

3. The Del~xtment shall not approve any
outdoor heating device which emi~ more

4. The Department may approve the device on
specified conditions ~nd may limit; the approwal to a
specL~ied period of time.

(2) If the burning site is situated in a rural area
or is adjacent to or near forest, grass, woods, wild
lands or marshes, the Division of Forestry shall be
notified and consulted prior to any burning.
(3) All open burning under this section shall be
eonducte~t in the folIowlng manner:

and operating practices, the gyps, quantity,
compositio~x and amount of air contaminants to be
released to the atmosphere;
(d) The schedule of burning operations, if

(e) The exact location of requested open
burning;
(f) If appllgable, reasons why no method other
than open burning is feasible; and,
(g) Evidence that the proposed open burning
has been approved by the fire cont~col authority

conditions which protect the ambient air from
pollu~ants and contaminants to the greatest exten~,
