O78-32 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, ADOPTING BY P~EFERENCE CHAPTER 17-5 OF THE RULES OF THE STATE OF FLORIDA, DEPARTMENT OF POLUTION CONTROL WITH REGARD TO OPEN BURNING AND FROST PROTECTION FIRES; PROVIDING FURTHER FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA; Section 1: Chapter 17-5 of the Rules of Florida -~ 3. Department of Polution Control relative to open burning and frost protection fires, a copy of which ~s attached hereto an~ made a part hereof, are hereby adopted by ~e~erence and S~Rules shall here~ere be controlling within the city limits of the City of Boynton Beach, Florida. Section 2: Authority to__Codify: Specific authority is hereby granted to codify and ~ncorporate this Ordinance in the City's existing Code. Section 3: Sepa~abili~t~: Each of the provisions of this Ordinance is separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. Section 4: Repealing P~rovi~ion: All ordinances or parts of ordinances in conflict herewith are hereby re~Deated. The Depa~tanent may approve a fuel on condition that it be used for certain specified purposes and in a certain specified rearm er. (b} Outdoor heating devices: 1. Any person desiring to have an outdoor heatin~ device approved may submit a~ appllcziion. The application shall contal~ the following information: A. Hame, address' an(t telepI~ne number applicant; B. Trade name or o~her deslg~ati~n of the device; C. t~rlef description of the device; D. Type of fuel that is use~ in the de, ice; and, F~ The composition and quantity of air contamh'~tnts given off by tl-~ device when in operatiOm ~ The Depari~ent may require that a res!; ~f the performance of a representatlve device be conducied by the applicant. 3. The Del~xtment shall not approve any outdoor heating device which emi~ more five-tenths gram per minut~ of u~consumecl so}id cm-bonaceous magter or p~xticulate maker. 4. The Department may approve the device on specified conditions ~nd may limit; the approwal to a specL~ied period of time.
