AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA AMENDING,SECTION4L~E.NDtX~
ZONTNG REGULATIONS OF THE CITY~ BOYNTON
BEACH, FLORIDA RELATIVE REQUIREMENT OF
BUFFER WALLS SEPARATING COMMERCIAL~AND/OR
INDUSTRIAL ~DtSTRICTS WHICH ABUT RESIDENTIAL
DISTRICTS; PROVIDING FOR AUTHORITYTo CODIFY,
SAVINGSCLAUSE, REPEALING PROVISION, AN
FECTiVE DATE AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF~THE CITY OF
BOYNTON BEACH, ~FLORIDA:
S_ection 1: That Section 4L, .Appendicitis-Zoning
Regulations ~f ~the City of Boynton Beach, F~orida be and the same
shall be amended to read:
"L. Buffer Walls: For new construction or major
~f~mcat~l~ns-~o e'xisting developments, where a
commercial and/or industrial district abums a re-
sidential district a solid decorative masonry wall
at least six (6) feet in height shall be located within
the required side and/or rear yards ex'cept with
respect to corner lots said buffer wall shall be re-
quired only on interior lot lines. Said buffer wall
shall not abridge any easement rights or be con-
structed over any existing utilites mn any easemenm
area. With respect to the C-1 (Office and Commercial
Professional District) the solid masonary wall may be
replaced with a dense vegetative buffer of at least
two (2) feet in height at the time of planting. Said
vegetative buffer to be maintained by the project
developer.
· -'Cunstruction of said decorative masonary wall or
pl.anting of said vegetative buffer shall be completed
przor to issuance of the Certificate of Occupancy for
the building or buildings sought to be built in
connection t-he rewi th."
Section 2: A, uthority to Codify: Specific authority is
granted to codify and incorporate this Ordinance in the
City's existing code.
~ection 3: Separability: Each of the provisions of
this Ordinance is separable, including word, elause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4: Repealing Provision: Ail Ordinances or
)arts of Ordinances mn conflict herewith are hereby repealed.
Section 5: Effective Datq: This Ordinance shall be-
come effective in the manner and at the time provided by law.
