As required by Ordinance number 001-07, the following procedures are to be followed: Lj A City Commissioner has seven (7) days from the rendition of the Order to request the City Manager's Office to place the case on a City Commission Agenda for review. (Space provided below for transmittal purposes) u Said review must occur within thirty (30) days of the request for review. u Upon such review, the City Commission may take one of the following actions: a. Uphold the Code Compliance Board's recommendation in full. b. Over -rule the Board's decision in full. c. America's Gateway to the Gulfstream Meeting Minutes Code Compliance Board Boynton Beach, FL February 20, 2013 Based on testimony and evidence presented in the aforementioned case, Mr. Cole moved that a Cease and Desist Order be issued giving BNW Trading, Inc. until February 27, 2013 to bring the violations of the City of Boynton Beach Code sections as cited, into compliance. The Board has considered the gravity of the violations, the actions taken by the Respondents, and any previous violations by the Respondents, and hereby orders that a fine in the amount of $300 per reoccurrence, of the violations thereafter shall be imposed upon the Respondents. The motion was seconded by Mrs. Yerzy and unanimously approved. (This Cease and Desist Order is for the cooking on premises), Case No. 12-636 Ralph Lowe Property Address: 1619 NE 3`d Street Violation(s): CH 10 SEC 10-56 (A) (B) (D) Permit is required for enclosure and windows, Repair shutters, scrape and paint outside walls and sod bare areas of lawn, Officer Lewis presented the case as contained in the notice of violation. Ralph Lowe, explained the reason he had not taken care of the violations to date was due to economic issues. He indicated his situation has improved and he has an engineer working on the enclosure. He went to the Building Department to file a permit for the windows. He requested a little more time so he could complete all the items. Officer Lewis suggested tabling the case for thirty days until the permits are received. Motion Mr. Cole moved to table the aforementioned case to March 20, 2013. Mrs, Yerzy seconded the motion that unanimously passed. Case No. 10-2191 Countrywide Home Loans 206 NE 12th Avenue Diane Springer, Code Compliance Coordinator, presented the details of the case as contained in the original violation. This case came before the Board on September 15, 2010 and no one appeared. The compliance date was set for September 25, 2010 or incur a fine of $150 per day. The case complied on ,January 24, 2012 for a total of 485 days. All requirements for lien reduction had been met. Ms. Springer advised the current property owner contacted her about a month ago and indicated they never were aware until two days before closing when the title company did the final search and found two liens. She was told that if he pulled out of the deal, he would lose the deposit. Rather than lose the $6,000 deposit, she purchased the property with the liens on it, not 0 Meeting Minutes Code Compliance Board Boynton Beach, FL February 20, 2013 realizing how large the liens were. The property was brought into compliance by the Bank before the current owner purchased it, The Certificate of Title from the Bank was on September 28, 2011 and the Bank was in compliance on January 24, 2012. The property owners have taken this property which was an absolute mess and made it beautiful. Jude Altidor, 206 NE 12th Avenue, was the owner of the property. She advised she bought the house with the liens and was trying to take care of everything. She now needed to repair the air conditioner. She sold her home in her country when her mom passed away in order to purchase this property. She further advised everything in the house was repaired or replaced. W1111=4 Based on testimony and evidence presented in the aforementioned case and having been advised that the Respondent, Countrywide Home Loans, Inc. has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mr. Cole moved that this Board reduce the fines instituted in the aforementioned case by virtue of this Board's Order of September 15, 2010 to an amount of $634.12, including administrative costs. Mrs. Yerzy seconded the motion that unanimously passed, Case No. 10-2191 Countrywide Home Loans 206 NE 12th Avenue Diane Springer, Code Compliance Coordinator, presented the details of the case as contained in the original violation. This case came before the Board on February 16, 2011 and no one appeared. The compliance date was set for February 26, 2011 or incur a fine of $500 per day. The case complied on January 24, 2012 for a total of 331 days. All requirements for lien reduction had been met. The above case explanation applies to this case, as well. Judas Altidor, 206 NE 12`h Avenue, was the owner of the property. In response to a question from Chair Costantino, Ms. Altidor advised she purchased the property on April 27, 2012. Based on testimony and evidence presented in the aforementioned case and having been advised that the Respondent, Countrywide Home Loans, Inc. has complied with all lien reduction procedures set forth in Section 2-84 through 2-89 of the City of Boynton Beach Code of Ordinances, Mrs. Yerzy moved that this Board rescind the fines instituted in the aforementioned case by virtue of this Board's Order of February 16, 2011, and the lien imposed by this order be released, Mr. Cole seconded the motion that unanimously passed. a CODE COMPLIANCE BOARD CITY OF BOYNTON BEACH, FLORIDA CITY OF BOYNTON BEACH Petitioner, VS. COUNTRYWIDE HOME LOANS INC. Respondent(s). CASE NO. 10-2191 LIEN MODIFICATION ORDER THIS CAUSE came before the City of Boynton Beach Code Compliance Board on the Respondent's application for lien reduction on February 20, 2013, pursuant to Chapter two, Article five of the City Code of Ordinances. The Board having considered the application, all the facts regarding the specific code or codes the appealing party was in violation of, the date of the original board hearing, the date the affidavit of compliance was issued, the current lien amount and all pertinent information relating to the specific case and being otherwise duly advised in the premises, it is hereupon, ORDERED AND ADJUDGED that: 1. This Board has subject matter jurisdiction of this cause and jurisdiction over the Respondent. 2. The Respondent has met all the lien reduction procedures established by the City Code of Ordinances. 3. The lien imposed by the Board on September 15, 2010 on the Property located at 206 NE 12`x' Ave., Boynton Beach, Florida, with the legal description of: HAPPY HOME HEIGHTS LT 1 l BLK 8, according to the plat thereof as recorded in Plat Book 11, Page 30, of the Public Records of Palm Beach County, Florida, PCN: 08-43-45-21-20-008-0110 is REDUCED TO $634.12. The City shall prepare a release and satisfaction consistent with this Order. The release and satisfaction shall be recorded in the public records of Palm Beach County at the Respondent's expense. 6. This Order is not final until the time period for appeal under the Code has elapsed and if appealed is properly disposed by the City Commission. 7. In the event that the property owner does not comply with the Code Compliance Board order, as approved or modified by the City Con-imission, within ninety (90) days of Commission's action, the Lien Reduction Order shall be of no further force or effect, and the original lien shall remain on the property. No extensions of the ninety (90) day period shall be permitted, and no further action by the Code Compliance Board or the City Commission shall be permitted regarding lien reduction.
