R13- y 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, APPROVING AN EXTENSION OF AN AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH AND PHILLIPS AND JORDAN, INCORPORATED, FOR DEBRIS COLLECTION AND DISPOSAL 13 FOR THE 2013 HURRICANE SEASON UNTIL SUCH TIME AS A 9 REPLACEMENT AGREEMENT IS FULLY EXECUTED 10 BETWEEN THE SOLID WASTE AUTHORITY AND PHILLIPS 11 ! AND JORDAN, INC.; AUTHORIZING THE CITY MANAGER TO 12 EXECUTE THE NECESSARY DOCUMENTS WITH PHILLIPS 1 � ! AND JORDAN, INC; PROVIDING AN EFFECTIVE DATE. 15, WHEREAS, on July 3, 2007, the City Commission approved the piggy -back of a 1(i: three -year contract between Solid Waste Authority of Palm beach County and Phillips and 17 Jordan, Incorporated (a/k/a Phillips & Jordan, Inc.) of Robbinsville, North Carolina for 1f debris collection and disposal; and 19 WHEREAS, on July 6, 2010 via Resolution R10 -085, the City Commission 20 approved a three (3) year extension of the Agreement between the City of Boynton Beach 2 and Phillips & Jordan, Inc., through June 13, 2013; and 22 WHEREAS, due to the critical nature of this service, it is imperative to have a 2:1 contract in place in order to avoid delays should there be a hurricane /disaster /emergency 24 situation; and 210 WHEREAS, upon staff's recommendation, the City Commission deems it to be in 26 the best interest of the citizens and residents of the City of Boynton Beach to exercise its #: option to extend the Agreement with Phillips & Jordan, Inc., until such time as a i 20 replacement Agreement is fully executed between The Solid Waste Authority and Phillips 2P and Jordan, Inc., to be utilized as an insurance policy on an "as needed basis ". Each Whereas clause set forth above is true and correct and incorporated herein by this reference. Section 2. The City Commission of the City of Boynton Beach, Florida, hereby 41 approves an extension to the Agreement with Phillips & Jordan, Inc. of Robbinsville, North $ Carolina, until such time as a replacement Agreement is fully executed between The Solid Waste Authority and Phillips and Jordan, Inc., which shall be utilized as an insurance policy on an "as needed" basis for debris collection and disposal. 8 Section 3. The City Manager is authorized to execute the necessary documents S9 to advise Phillips & Jordan, Inc., of the City's decision to extend the Agreement. 1( Section 4.
