13-014 ORDINANCE NO. 13 -014 2 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE 89 -38 BY AMENDING THE FUTURE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN FOR A PARCEL OWNED BY THE BOYNTON OLD SCHOOL PARTNERSHIP AND LOCATED AT 125 EAST OCEAN AVENUE; CHANGING THE LAND USE DESIGNATION FROM PUBLIC AND PRIVATE GOVERNMENTAL /INSTITUTIONAL (PPGI) TO MIXED 1 USE (MX); PROVIDING FOR CONFLICTS, SEVERABILITY, AND 1 AN EFFECTIVE DATE. 1 WHEREAS, the City Commission of the City of Boynton Beach, Florida has adopted 14 a Comprehensive Future Land Use Plan and as part of said Plan a Future Land Use Element 1 t pursuant to Ordinance No. 89 -38 and in accordance with the Local Government 16 Comprehensive Planning Act; and 1 WHEREAS, the procedure for amendment of a Future Land Use Element of a 1 Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been followed; and 1 WHEREAS, after two (2) public hearings the City Commission acting in its dual I i 2 ( capacity as Local Planning Agency and City Commission finds that the amendment 2 j hereinafter set forth is consistent with the City's adopted Comprehensive Plan and deems it in 2 the best interest of the inhabitants of said City to amend the aforesaid Element of the 2 Comprehensive Plan as provided. 21 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE 2 CITY OF BOYNTON BEACH, FLORIDA, THAT: 2 Section 1: The foregoing WHEREAS clauses are true and correct and 2 t incorporated herein by this reference. 2 Section 2: Ordinance No. 89 -38 of the City is hereby amended to reflect the 2 following: \ \apps3 city cbb \auto\Data\ 179 \Items \171\2476\ 3251 \Ordinance- _OId_High_ School_ Commercial_ Center_- _Land_Use doc I ' 1 That the Future Land Use of the following described land located at 125 East Ocean 2 Avenue changing the land use designation from Public and Private Governmental /Institutional (PPGI) to Mixed Use (MX): Lots 4,5, and 6, Block 14, SAWYER'S ADDITION TO THE TOWN OF BOYNTON BEACH, as recorded in Plat Book 1, Page 69, Public Records of Palm Beach County, Florida, LESS the right -of -way for Seacrest Boulevard as shown in Road Plat Book 5, Pages 179 -183, Public Records of Palm Beach County, Florida. Containing 1.939 acres or 84,445 square feet. 1 1 Section 3: That any maps adopted in accordance with the Future Land Use Element of the 1 Future Land Use Plan shall be amended accordingly. 1 Section 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. 1 4 Section 5: Should any section or provision of this Ordinance or any portion thereof be 1 declared by a court of competent jurisdiction to be invalid, such decision shall not affect the 1 (1 remainder of this Ordinance. 1 Section 6: This Ordinance shall take effect on adoption, subject to the review, challenge, 41 ' 10 or appeal provisions provided by the Florida Local Government Comprehensive Planning and 1 t Land Development Regulation Act. No party shall be vested of any right by virtue of the 2 adoption of this Ordinance until all statutory required review is complete and all legal challenges, 2 including appeals, are exhausted.
