10 WHEREAS, Shannon Skiba and the City of Boynton Beach executed a Second
11 i 1 Mortgage under the City's first time homebuyer assistance program in the amount of
12 11 $58,930.00 loan for the purchase of the property located at 293 Meadows Drive, Boynton

13 11 Beach, FL 33426 (the "Mortgaged Property "); and

14 WHEREAS, Shannon Skiba has received an offer to sell her home through a short

15 i' sale process in order to avoid foreclosure of the Mortgaged Property; and
16 11 WHEREAS, the City has no interest or funding available to purchase the Mortgaged
17 1i Property from Ms. Skiba; and
18 ; 1 1 1 WHEREAS, the City Commission deems it appropriate to authorize and approve a

19 1; Waiver of the City's Right of First Refusal for the Mortgaged Property.
20 1 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

WAIVER OF RIGHT OF FIRST REFUSAL
The CITY OF BOYNTON BEACH, FLORIDA (the "CITY "), a Florida municipal corporation, being
the owner, holder and beneficiary of a right of first refusal on any sale or resale or transfer of
the real property located at 293 Meadows Drive, #29C, Boynton Beach, FL 33426, hereby
acknowledges that it has been offered the following described and pursuant to its right of first
refusal, on the following basic terms, and the CITY hereby waives its right to exercise such right of
first refusal on the following described transaction.

OFFEROR /BUYER: Shane R. Thoene
DATE OF CONTRACT: September 5, 2012

ACCEPTING THE OFFER OF S4,000 AS
SETTLEMENT OF , THE CITY'S SECOND
MORTGAGE AS A RESULT OF A PROPOSED
81 SHORT SALE FOR SHANNON SIQBA BASED ON
g THE CITY'S SHORT SALE POLICY FOR FIRST
11 TIME HOMEBUYER ASSISTANCE PROGRAM;
11 AND PROVIDING AN EFFECTIVE DATE.

1 WHEREAS, with the assistance of the City of Boynton Beach's first time
1 homebuyer assistance program Shannon Skiba purchased her home for $190,000 in May
1; of 2007; and
t WHEREAS, the City of Boynton Beach's second mortgage in the amount of
1: $58,930 is a zero interest (0%) lien that runs concurrent with the first mortgage; and
1. WHEREAS, rather than be foreclosed upon, the homeowner was able to secure
21 a buyer for the property and her bank has agreed to a short sale in the amount of $72,000;
21 and
22 WHEREAS, the proposed settlement offer is in accordance with the City's Short
23 Sale Policy for the City's First Time Homebuyer Assistance Program; and
24 WHEREAS, the City Commission of the City of Boynton Beach upon
25 recommendation of staff, deems it to be in the best interest of the citizens and residents
26 of the City of Boynton Beach to accept the offer of $4,000 as settlement of the City's
27 second Mortgage as a result of the proposed short sale for Shannon Skiba.
28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
29 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
1 Section 1. The foregoing "Whereas" clauses are hereby ratified and
2 confirmed as being true and correct and are hereby made a specific part of this
3 Resolution upon adoption.
41 Section 2. The City Commission of the City of Boynton Beach, Florida
5 hereby accepts the offer of $4,000 as settlement of the City's second Mortgage as a result
6 of the proposed short sale for Shannon Skiba.
7 Section 3. This Resolution will become effective immediately upon passage.
