3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA
4 APPROVING THE ONE YEAR SUSPENSION OF THE GARAGE SALE
5 PERMIT REQUIREMENT; PROVIDING FOR AUTOMATIC
6' REIMPLEMENTATION OF REQUIREMENT FOR GARAGE SALE
7 PERMITS AND ENFORCEMENT UPON THE EXPIRATION OF THE
8 STATED TIME PERIOD UNLESS EXTENDED; PROVIDING FOR
9! CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE.

11 WHEREAS, residents are required to apply in person at City Hall to obtain a Garage
12' Sale Permit and are accepted through the Development Services intake process; and
13 , WHEREAS, staff has researched Code violations for a twelve and a half year period ;
14! and found that no Garage Sale violations have been issued; and
15' WHEREAS, noting the absence of violations, staff is recommending suspending the
16' ; requirement for a Garage Sale Permit for a period of one year during which time a study of ,
17 ; ; violations will be monitored through complaints; and
18 ; WHEREAS, the City Commission has considered the recommendations and has

19 ; ! determined and finds that it is in the best interest of the citizens and residents of the City of
20 ; Boynton Beach, Florida to suspend the Garage Sale Permit requirement for a period of one
21 year. The requirement to obtain a Garage Sale Permit will automatically be re- implemented
22 ; i upon expiration of the suspension of the Garage Sale Permit requirement, unless extended by
23 ! ! the City Commission.

24 : NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF

26 , THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

28 ; Section 1. The foregoing whereas clauses are true and correct and are now ratified

29 a and confirmed by the City Commission.
30 Section 2. The City Commission of the City of Boynton Beach desires to suspend

1' the requirement for Garage Sale Permits for a period of one (1) year from the date of passage of
2; this ordinance on second reading. The requirement to obtain a Garage Sale Permit will
31 automatically be re- implemented upon expiration of the suspension of the Garage Sale Permit
4: requirement, unless extended by the City Commission.
5; Section 3. Each and every other provision of the City of Boynton Beach Code of
6 ' Ordinances not herein specifically amended, shall remain in full force and effect as originally

7' adopted.
8; Section 4. All laws and ordinances applying to the City of Boynton Beach in
9s conflict with any provisions of this ordinance are hereby repealed.

101 ; Section 5. Should any section or provision of this Ordinance or any portion thereof
11; ' be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
121 remainder of this Ordinance.
13 S Section 6. This Ordinance shall become effective immediately.
