PRESENT: Robert Effron~ Mayor Mrs. Emily Jackson~ Vice Mayor John Archie~ Councilmen David Roberts~ Councilman Harold Blanchette~ Councilman Travis E. Killgore~ City Manager Mrs. Tereesa Padgett, City Clerk Gene Moore~ City Attorney Mayor Eff~on called the meeting to order at 7:35 P. M. He then intro- duced members of Co~ncil and City officials. The Invocatio~ was given by Gene Wright, Fire Chi~e~., followed by the Flag Salute led by William Sullivan: Personnel Off~cer. Mayor Effron announced that the Public Hearing tonight on the estab- lishment of the Site Flan Review Boa~dwill be held at 8:00 P. M. The Mayor then awarded 6ertificateS of Appreciation to long-time em- ployees of the City. The following employees received Certificates: Frederick Mitchell HaroldMiller George T. Davis Evelyn Butler 15 years 10 years 10 years !0 years MINU~ES - Regular Meeting - November 21, 1972 Mr. Archie moved to accept the minutes of November 21 as written, sec- onded by Mrs. Jackson. Motion ca, tied 5-0. PUBLIC AUDIENCE Ezell Hester, 1106 N. W. 1st Street, stated that Mr. Killgore has been a good Manager. The reason he was not liked by some was because they couid not tell himhowto r~u the City. The people in this City do not like any professional people, that is one reasOn why they don't like Mr. Killgore. He feels Mr. Killgo~e is one of the best City Managers the City has had. Mr. Hester gave the example that 3rd Street had been in the planning stages~ and he has seen Mr. Kill- gore out on that street when it was full of water~ and the st-~eets are paved now. He is sorry to lose Mr. Killgore. He hopes the new City Council will choose someone to l~unthe City effectively. John Stephens: 715 N. W. 4th Street, expressed his appreciation to a.llmembers of the Council and the City Manager for completion of 5rd Street, and hopes the work will soon begin on 4th Street. Gary Winter, po/nted out that there are single women that dontt drive ca~s: but have sons or daughters that come down and no provision ~s been made for them to go to the beacb~ Seine arrangement should be made so that'th~ visitors have an opportunity to take them to the beach. ~iayor Effron stated that as long as a person can show proof of prop- ez~cy ownership they are entitled to a regular beach permit. O. T. McLean asked to speak on the Election I~w violation when it comes up. BIDS One Automatic Addressing Machine & Form Feeder Mr. Killgore recc~mended that the bid be awarded to Addressog~aph Division, at a total of $5~525.36. Mr. Archie moved to accept the City Manager's recommendation, and award the bid to Addressog~aph Division: seconded by Mm. Blanchette. Motion carried 5-0. LEGAL Resolution 72-X - Estabtish/ng official signatores for Federal Grant Mr. Moore stated that this is the resolution requested by H. U. D. to indicate that the signatores were authorized. Mr. Arcb/e moved to adopt Resolution 72-X~ which we have all read~ seconded by Mrs. Jackson. Mayor Effron stated t~t the City Manager informed h/m o~ a telephone call from Mm. Cassell with H. U. D. in regard to our g~ant, and what brought this about was a review by the Legal Department. Alt that was lacking was this resolution verifying the signatores. Motion carT/ed 5-0. Violation of Election Laws O. T. McLean made several comments about the United Boynton Civic League, and cited what he believed to be violations of the election laws. He stated that this 9-~oup represents and controls some 5~000 to 4,000 votes, as has been evidenced by this election just fin/shed~ -2- MINU~ES RE~dLAR CITY COUNCIL MEETING DECEMBER 5, 1972 Violation of Election Laws, cont'd. which puts the City Council under the complete control and domination of the United Civic League. The people who have been put into office through the action and support of the Civic League are the ones who should be taking exception to the violation of the election laws. These violations are plain, apparent, and specifically in violation of State Statute. He stated that he spent his money to get copies of the law, so he would not break any election laws. Mc. McLean stated that he had been re~used admission: as well as newspaper reporters, to a meeting the League held for th~ Candidates for the Council, which should be an open meeting. AS far as these election laws not being prosecuted is concerned - Mr. McLean questioned the statement that had been made previously that the Council has no right to act or speak on this question; and stated that the Council has the power of enforcement. M~. McLean also Stated ~.2potitieal advertisement had appeared in a newspaper that was not licensed to publish in the City. ~en queried~ Mrs. Padgett stated that thez~ had been a request for an application several weeks ago, but she was not sure if a license had been issued. Mr. McLean stated the paper has been published illegally. He stated instances where he saw John White and Joe DeLong violate the law at the pol!s, and showed a pietume he had taken of a car with a bumper sti'eker on it at the polls. Mr. McLean then stated that if Judge Tomberg and Robert Collier will meet with him, he will withdraw all s~its again.~c them. P~BL!C HEARING Site Plan Review Board and Community Appearance Board Mr. Archie stated that he would not want to be appointing anyone to these Boards. The appointments should rest in the hands of the ones that are going to control the City. Mayor Effron stated that this was advertised as a Public Hearing~ and asked i~ anyone would like to speak for or against the Site PlenRe- view Board. We have talked about this all year - of the necessity and need for this type of Board. A1 Bi9eiow: PaLmtand Development Corporation, stated he is in favor of Site Plan approval. He has lived in Florida for 15 years. He has lived with site plan approval in various counties. He is going to be a ~esident of this City regardless of what other people may think. It is good to eontrol environment and type of const-~uction. A site p!an~has been submitted to the City Council for approval, No one wished to speak in favor or against the Site Plan Review Board. M~. Archfe moved to table the item until the new Council takes over~ seconded by Mr. Blanchette. Motion aaz~ied 4-1. M~s. Jackson voted Mm. A~chie questioned Mrs. Jackson's vote, Mrs. Jackson answered that this has been hanging on long enouqh~ and would like to see this and the Appearance Board Ordinance passed now~ on first reading. Mr. Arehie pointed out that it is only in draft form. M~s. Jackson then stated it could be adopted in concept. Community Appearance Board Mayor Effron stated that this is another Board that we have talked about for quite some time, and have had a very active ~roup working on the draf~c. Mrs. Fry stated that she is disappointed because it has been worked on for a long time, and it is a much needed ordinance. She urged Council to speedily do something about our Community Appearance. She then thanked the members of her Committee ~no worked so hard this year on this oz~inance. Mayor Effron stated that this is a Public Hearing to give people a chance to speak for or against the draft of the o~dinance. ~s. Jackson then stated that the Charter World was a Public Hearing and we voted on it. Mrs. Castello stated that according to the minutes of September 57 Council agreed to have a Public Hearing on Charter World, and it was v~itten up as a Special Meeting. Mayor Effron stated that nevertheless, this is a Public Hearing. Mr. Archie stated that there is nothing w~ong with voting at a Pub- lic Hearing. Mr. Roberts asked that both ordinances be p~epared, and brought back to the next meeting. Danny O'Brien stated that the ordinance calls for registered landscape architects. He wonders if this re- quirement can be filled. M~s. Fry stated that there is a registered !andseape architect on the Ccmmzittee at the present time: Col. Ca~n Reid. Mr. O'Brien stated that the appointment is for 3 yea~s~ and if Col. Reid should move away, could the requi~aent be filled? Mrs. Fry stated that she could not answer the questlor~ at this time. Mayor Effron asked if it was necessaz~ for the wo~d t~register~ to be in there, or put ~re~istered or non~reqiste~ed~. F~s. Fry stated that it is amenable to all changes that need to be made. M~. Archie moved the item be tabled, seconded by Mr. Blanchette. Motion carried 5-0. Report on Election Returns ~rs. Jean Pipes repoz~ced for the North Precinct, as per attached. M~s. Erna Weaver reported for the South Preeinct~ as per attached. Mr. Blanchette moved to accept the Election Report and declare the top three as duly elected~ seconded by M~. Roberts. Motion carried 5-0. Mayor Effron recognized the three n~v Council members for the two year term of 1973-1974, Joe DeLong, Ed Harmening, and Forrest Wallace. Mr. DeLon9 introduced his wife, Grace. Mr. Moore stated that since the Library Referendum passed, it will be necessary to adopt Resolutions 72-AA and 72-BB that have been eircu- tated~ and implement the sale of Bonds. Mrs. Jackson moved to adopt Resolutions Nos. 7R-AA and 72-BB, seconded by P~. B!anchette. Motion carried 5-0. Violation of Election Laws, cont'd. Mr. Roberts asked Mr. McLean what his address is, the letter report- ing the violation does not have an address on it. _MINUTES REGULAR CITY COUNCIL MEETING DECEMBER 5~ 1972 Violation of Election Laws, cont'd. Mm. McLean answered that his address is 906 and 911 South Federal High- way~ and the address is on the envelope. Mm. Roberts asked which address he lives at. Mr. McLean answered that he lives at both addresses. Mr. McLean then stated that the ~eason he is withdraw/rig the suita.~-~' gainst ~r. Tomberg and Mr. Collier is because he is going to devote all h/s money to attacking the Civia League. Discussion followed between Mr. Roberts and M~. McLean- Mr. McLean stated he was quoting the League and the newspapers when he spoke of 5:000 or 4~ 000 voters~ and also using an est:imate of the num- ber of living units in the various tendon/n/urns; he had no exact fig- utes. He stated that about 25% of the people amc controlling the City and the balance of the rog/stored voters have no way of knowing what is going on in City Hall~ because they a~e busy earnin~ a living. He believes if all the citizens oould be info~med of what is going on, and the effect it will have on them, they would come out and vote~ and would get othe~s out to vote. See eo~ection ~Wi~s. Jackson~ asked the members of the audience who live in single fam- ily ~esidences to stand. Mr. McLean stated, more than 50%o stood up. A condominium owner in the audience stated that they have private streets which they maintain in the City and also pay their share of taxes. She requested Mr. McLean to get more information as to what they are doing for this City, before he knocks condominiums. Mr. McLean stated he m~ prepared to debate at the proper t/me. Defense of Suit on Pa/roland Mr. Moore stated that the City has been servedon this matter~ and the City has 20 days in which to file an answer~ if Council detenmines it necessar~ to do so. Mr. Archie moved to instruct the City Attorney to defend the City in the case, seconded by Mr. Blanchette. Motion ca~ied 5-0. Mrs. Jack- son and Mr. Roberts abstained. Mr. Roberts stated that.Mr. Holl~ngsworth wanted him to convey the message that he has no mntemest tn serving as the City Attorney Boynt on Beach. BUSn SS Resignation of Gene Moo~e, City Attorney (Tabled) Mr. Archie moved to remove the item from the table, seconded by B!anchette. Motion carried 4-1. Mms. Jackson voted ~no~. MINUTES REGULAR CITY COUNCIL MEETING DECEMBER 5~ 1972 Resignation of Gone Moore, City_~A~_tt_o~_ney,cont'd, Mr. Archie moved to accept the City Attorney's recommendation, effec- tive December 517 1972, seconded by Mrs. Jackson. Motion carried 5-0. Resignation of City Manager Mr. Archie stated that he has asked Mr. Killgore on his own to re- consider, holding off until the 31st of Deeember~ and hopes he will give him an answer tonight° We are tmlking abo~t having a Council- Manager form of government~ without having a manager for four weeks. He would like to see Council reconsider, and allow him to stay on until December 51st. We have already agreed he will get three weeks vacation and one month*s severance pay. In the meantime~ advertising can be done Co~ a new City bL3na.ger~ so you can interview someone im- mediately ~hen the new C0{uaeil is swo~n in. Mr. KiilDore agreed to stay until December 31st, but under no circum- stances would he stay any longer than that. Mr. Roberts stated that a'~ion has been made for the vacation and sev- erance pay, and the~e could be a change in the motion by the new Coun- cil. Mr. A~chie suggested Mr. Artz d~aw up the check now~ so that the Mayor can sign it. Mr. lrehie moved to reconsider the former motion to accept the resigna- tion, seconded by Mr. Blanchette. Motion carried 5-2. Mrs. Jackson and Mr. Roberts voted ~no~. Mr. Amebic moved that the resignation of the City Manager be accepted as of December 31, 1972~ and the same pay be given - one month's sev- erance pay and three week's vacation pay~ seconded by Mr. B!anehette. Mayor Effron stated that one good reason for this extension is the sewer grant application. H.H.D. has now received funds for the fiscal year~ and Mr. Killgore had a conversation with Mr. CasselL It is very possible we m~ght get 75%, but we have got to keep on top of it. There are other pending matters in the City. Under discussion, Mr. Roberts stated that he had accepted Mr. Xi!lgore's resignation as he had asked~ and as it was recommended by the Mayor. Me saw no reason to grant an extension. Motion carried ~-2. Mrs. Jackson and Mr. Roberts voted ~no~. Mrs. Jackson requested that Mrs. Padgett prepare mailboxes for the three new m~mbers of CoUnoit so that they will be getting the same mail, and will be kept up to date on what is going on. Mrs Jackson stated that the advertising should be left up to the new Council. Mr. Archie stated that the word could be circulated around Florida that the City is looking for a City Manager. .Mr. Roberts seconded the motion, and it caz~ied 4-1. M~so Jackson voted ~no~t. Conditional Approval of Mango Heights Plats (On the Table) This item remained on the table. Paving Casa Loma Blvd. - Marina Area (On the Table) Mr. Archie moved to remove this item from the table, seconded by Mayor Effron, after he handed the gavel to Mrs. Jackson. Sir. Archie stated that this is very worthwhile~ and is one of the largest industries in the City of Boynton Beach. The street needs repaying, and we should go ahead with the original proposal. There is a little more to it than saying go ahead and put through 2nd Avenue, which is a County street. The City is not going to spend City tax- payers' money for putting through a County street. Mr. Arc/cie suggested going ahead with the repair and repaying of Casa Loma Blvd. at approximately $26,000, ~hich~Ti~ i.n .the. bud~e~c,~ Motion carried 5-0. Mrs. Jackson stated that Mr. A1 Topet's plan is a fine plan: but it is a long range plan. Mr. Arehie moved to go out to bid for repair and repaying of Casa Loma Blvd., at a cost of approximately $26~ 000~ seconded by Mrs. Jackson. Motion carried 5-0. Fire Hydrant Charges in Ocean Ridge (On the Table) Mrs. Jackson moved that this item be stricken from the Agenda for the present time, seconded by Mr. Ar~hie. Motion carried 5-0° Final Plat of Block }4: Boynton Ridge Council reviewed the Plat~ and Mr. Killgo~e explained that it is a mat- ter of changing a couple of lots. Mr. Moore read Ordinance No~ 72-34. Mr. Arehie moved to pass Ord. No. 72-54 f~om first to second reading~ seconded by Mr. Blanehette. Motion carried 5-0. -8- MINUTES REGULAR C1T¥ COUNCIL MEETING DECEMBER 5~ 1972 NEW BUSINESS Recommendations to the 1985 PriRoipal Street & Highway System Plan Mr. Killgore stated that the following three changes have been recom- mended to the 1985 Principal Street ~ Highway System Boynton West Road - S. R. 804 4 Lanes~ instead of 2 Lanes, from Seaboaz~ to Sunshine Parkway 2. N. E. 22nd Avenue in Boynton Beach should be identified on the Plan. Other possible changes, such as 4 laning of Seacrest should be considered. Mr. Killgore stated that the recommendations can be forwarded ac- cordingly. Mrs. Jackson moved to approve the recommendations and forward them aceordingly~ seconded by Mr. Archie. Motion carried 5-0. Request from the Town of Hypoluxo Mr. Kitlgore stated that a letter was received from the Town of Hypoluxo requesting our Police Department to provide police services to the Town. He then read the report from the Police Chief regarding this matter. Mr. ~illgore recommended that the request be denied, based on the port by Chief Huddleston. Mr. Roberts moved that the request be denied, seconded by Mrs. Jackson. Motion ca,tied 5-0. ADMINISTRATIVE Request for Extension of Retirement Date M~. Archie moved to grant the extension for Mr. Harmon Fretz to Decem- ber /2, 1975~ seconded by Mrl Blanchette. Mr. Roberts questioned whether or not Mr. Fretz's health would permit himto work another year. F~. Killqore stated that we are trying to keep him eligible for his retirement, but we would not want him to come back until the dootor okayed it. Acceptance of Cremation of Bond Coupons Mr. Killgore requested official action to accept cremation of Bond Coupons by Morgan GuarantyTrust Company for the record. Mr. Archie moved to accept the cremation of bonds, seconded byMrs. Jackson. Motion carried 5-0. Transfer of Funds Mr. Kitlgore recommended that this item be stricken from the Agenda. M~s.
