13-026 1 ORDINANCE NO. 13 -026 2 3 AN ORDINANCE OF THE CITY COMMISSION OF THE 4 CITY OF BOYNTON BEACH, FLORIDA, 5 DESIGNATING THE PROPERTY KNOWN AS THE 6 BOYNTON HILLS LIGHTS LOCATED ALONG 7 NORTHWEST 1 STREET, BOYNTON BEACH, 8 WHICH IS MORE FULLY DESCRIBED HEREIN, AS A 9 LOCAL HISTORIC SITE; PROVIDING A NON - 10 SEVERABILITY CLAUSE AND AN EFFECTIVE DATE. 11 12 WHEREAS, Chapter 4, Article IX, Section 6 of the City of Boynton Beach Land 13 Development Regulations provides for the designation and protection of historic sites in the 14 City of Boynton Beach; and 15 WHEREAS, the Boynton Hills Lights comprise four ornamental light poles, each of 16 which is situated within a circular landscape island in the Boynton Hills Subdivision, and are 17 manufactured by Westinghouse Electric from Hollowspun concrete in the "Sheridan" style; 18 and 19 WHEREAS, many similar lights were installed in the city from the 1920s onwards; 20 however, it appears that only five now remain: the four subject lights and one at the Boynton 21 Beach High School, although not currently working, the lights appear to be unaltered and in 22 good condition; and 23 WHEREAS, the Historic Preservation Board of the City of Boynton Beach prepared a 24 designation report for the designation of the Boynton Hills Lights as a historic site and held a 25 duly noticed public hearing in regard to the designation of the property as an historic site at 26 which no member of the public spoke in opposition to the designation of the property as an 27 historic site; and \ \Apps3 City Cbb\Auto\Data \185 \Items \177\2572\ 3411\ Ordinance_ -_ Historic _Designation(Boynton_Hills Lights) Doc -1- 1 1 WHEREAS, the City Commission of the City of Boynton Beach has conducted a 2 duly noticed public hearing in regard to the designation of the Boynton Hills Lights as a 3 historic site. 4 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 5 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 6 Section 1. The foregoing whereas clauses are true and correct and are now ratified 7 and confirmed by the City Commission. 8 Section 2. The Boynton Hills Lights located along NW 1 Street at the rotary 9 intersections with NW 3 Court, NW 5 Court, NW 7 Court and NW 9 Court which are 10 shown on the location map attached and incorporated into this Ordinance as Exhibit "A ", and 11 is hereby designated as the Boynton Hills Lights Historic Site in accordance with and under 12 the provisions of Chapter 4, Article IX, Section 6.C., of the City of Boynton Beach Land 13 Development Regulations. 14 Section 3. It is the intention of the City Commission of the City of Boynton Beach 15 that this Ordinance and each and every of its terms be considered a part of a single whole and 16 that the Ordinance not be severable and that if a court of competent jurisdiction finds that any 17 section of this Ordinance is unlawful or unenforceable the Ordinance shall be unenforceable it 18 its entirety. 19 Section 4.
