Minutes 09-11-72M~ES OF THE SPEC/AL CITY COUNCIL MEETING HELD IN CITY HALL, BOYNTON BEACH: FLORIDA, AT 2: 00 P. M., SEPTEMBER 11, 1972 FinS. Emily Jackson, Vice Mayor John L. Killgore, City Manager Mrs. Te~eesa Padgett, City Clerk Gene Moore, City Attorney Mrs. Jackson called the meeting to order at 2:07 P. M. This Special Meeting was called for the purpose of adopt/rig the budget and setting the millage. Mr. K/llgore answered two questions that were outstanding from the last meeting. A. Concerning the Question of Mm. Roberts regarding pay increases In my memorandum of August 30, 1972, paragraph 4, I again stated that I could not justify pay increases for the 40 positions listed on the attachment. This evaluation was based on the same type evaluation as all other employees. I am confident ~hat the action taken and recox~ended up until the memorandum was certainly within the guidelines of the Wage and SalaIs; controls. The action taken by Council to increase the above 40 positions may also be within the guidelines. I did not and will not reconmnend a pay increase to the City Council unless in my judgment it is fair and equitable. In my view and the evaluation of our Personnel Dimector the recommendations made were based on the position, not the person. To approve these positions for increase and then to ask for an IRS ruling would be exposing discrim/nation /n the fair ~nd equitable administration of salary and wages of our employees. B. Concerning the Question..of Mrs. Jackson regarding re-organ/zation i. To my knowledge, the Attor%~ey General was not requested to give an opinion on the re-organization. As to the comment on the entire budget being based on the re-o~gani- zation, this is not understandable since the only new positions rect£y a~t~ibutab!e to the change is the Ufcilities Direeto~ General Services and Hrban Development Director. The Hrben Development Director was not funded by Council so, therefore, that leaves only ~ positions. Even these two positions were needed regardless of title where the workload is incmeasing. The bal- ance of the new employees is needed to provide good service. Mr. Killgore recommended his original reco~mmendation on the 8.68 millage be adopted with the approval of a 25~ increase in saruitation fees. Mr. Archie moved to accept the City Manager's recommendation~ and set the millage at 8.68: which is a 1 mill reduction in taxes, and increase garbage ~ates 25~, which is a $. 50 a month increase, seconded by Mr. Blanchette. Uote was 2-2. Mrs. Jackson and Mr. Roberts voted ~no~. Mr. Robert s time question any pay raises for those that weme not given them. He did question the I. ~. S. rule, because of different booklets ~eceived. At that time he stated he would l~ke to check it out without any delay on an~thing else. stated that he would like to clarify that he did not at any ~ Mr. Roberts moved to keep the established millage at 9.68, and leave the garbage rates as they are~ seconded by Mrs. Jackson, after Mrs. e~ Mr. Blanchette stated that if we don't absorb the cushion with a oushion now~ we are going to feel it more next year. Mrs. Jackson stated she has done some checking in Rolling Green Ridge area, and those are the little homes affected by a garbage increase. Mr. Blanchette stated that this Council is for fair and equal partici- pation, all should pay the same garbage and sewer rates. Mr. Archie stated that he has not had any calls on the garbage rates, and it has been in the paper. This would be a $6.00 a year reduction in taxes. Anybody with an $11~ 000 home is going to break even or make a dollar or two. With an $8,000 home they are going to pay $5 a year more. The~e are empty lots that are paying for garbage, and it is not fair or equitable. Rober~ Beyrer pointed out that the millage will fluctuate from year to year, it is not pe~ent. The garbage increase will stay the seme~ or it only goes up. Mr. Beyrer asked if the $552,000 is really surplus or is it dedicated revenue? Mr. Kiltgore explained that it is a true surplus within the utility fund~ Mr. Beyrer stated that this utility budget is being loaded up for one purpose~ and that Mr. Killgore had stated that they need customers in this utility to make it pay. You are going to find you are going to spend one million to two million dollars for expansion and, if you want proof of it~ take a look at the $134,000 that you started to pay on a million dollars in 1971. That is what you are lead/ng up to. You are t~ying to Create a cushion in here to absorb that amount, but I don't think it is going to work. --2-- MINUTES SPECIAL CITY COUNCIL MEETING SEPTEMBER !1~ 1972 Mr. Arehie read an excerpt f~om minutes of a last year~s meeting (9/28/71) /n which Mrs. Jackson asked that her statement be made part of the reoozd. At that time M~s. Jackson favored a 1 mill ~eduction in taxes ~ this year she is not in favor of it. He asked for an explan- ation. Fms. Jackson stated that hem decision is based on the revenue sharing and the cigarette tax: and a 9~eat many ~acto~s that did not appear last year. That is why she feels that taxes and san/ration should remain the same until we get a etearer pictume. The vote on the motion was 2-2. Mr. Blanehette and M~. Archie voted Mr, Archie stated that he made the first motion to attempt to pass a realistic budget with a l m itl tax decrease. The Charter does state that we must act on this on the second Monday in September. He made the motion in good faith~ and it was seconded in good faith~ and it was blocked. Fm. Moore stated that this meeting was called pursuant to the action of the Mayor~ City Manager and himself. The Charter states that the budget shall be adopted on the second Monday in September. Failure to adopt a budget on this date can very well cast a shadow on the legality of any budget adopted by this City on a subsequent date. Mr. Roberts stated that he expected the budget to be adopted because he expected the full Council to be present. He carmot~ in good conscience~ vote for a budget that he does not agree with. Mr. Blanchette voted for the City Manager's recoF~endation. The Council did hire the City Manager to prepare the budget. Col. Weh~ell stated that Mr. Moore seems to castigate a certain two because they have a different opinion. It could be the fault of the other two. An unidentified individual in the audience suggested a compromise, since the Council was at an /mpasse with a 2-2 vote, Mr. Beyrer stated that the misconception presented is that this is only a few dollars. It is a million - 869 thousand over last year. We have had a 2~mit!ion dollar increase in two years under this Council.
