Receipt of Plat of Mango Heights (on the table) Mrs. Jackson moved to take it from the table~ seconded by Mr. Archie. tion carried 5-0. Mo- Mr. Largent pointed out two items on the plat: (1) the cul de sac at the eastern end of the proposed 5th Avenue was only a 35' radius, and the latest plan is now changed to 100'2 to my satisfac- tion and recommendation. (2) the proposed 5th Avenue was 55~ deviating from the existing 5th Avenue at the west end of the Subdivision where it meets 5th Avenue, to be extended. In all good subdivision design if there is any deviation of streets there should be a deviation of 125' minimum and, being know- ledgeable on good practioe, I have to comment to you that I do not think this would be good practice in this City. You're changing the alignment of 5th Avenue for this subdivision. ~ayor Effron asked Mr. Carlton if it would present any problems Co change these two items. Mr. Carlton stated that to put 5th Avenue in alignment would mean the elimination of 17 lots. This would create a hardship. We have changed the cul de sac as Mr. Largent recommended. We cannot change the alignment as it is not economically feasible. There are other streets in the downtown area that are not in alignment. It is not incumbent on the developer to correct a mistake that has been in existence for many years° Mr. Effron agreed with Mr. Carlton's remarks. This City should have had a planner long ago. Last year~S Council and this Council saw fit to.hire a City Planner. He does not want to see past mistakes done over again. Mr. Carlton explained that the alignment would leave the developer with only 40 feet of depth. According to state laws we cannot record a plat that contains unusable land. He asked Council not to base their decision on something that is proposed. Mr. Blanchette stated that if someone is going to develop this area he hopes that it will be soon~ and we should ~ive some g~ound to good plan- ning~ and get this,area developed the way i~ is because of offset streets that are existing. -1- MINUTES SPECIAL CITY COUNCIL MEETING JANUARY 209 1972 Receipt of Plat of Mango Heights~ cont'd. Mro Effron asked if the drainage has been satisfied? Mr. Clark stated they are planning to drain onto Mr. Mur~.Y'~B p~operty. Through further discussion it was brought out that Mr. Murray does not own the property~ but only has an option on it. Council cannot accept this without a commitment to purchase this property. Mr. Carlton stated that the water has always gone onto this property. The oper has the right to do this. Palm Beach County SUDalV~Slon ~egu~u ~ term this ~'natural drainage~. The water is still going where it always was: although we may compound the amount o~ water, We are putting in a storm drainage system which would become part of your storm drainage system. Mr. Arehie asked if the developer would be v~il!ing to put money in escrow to tie into the 2nd Avenue system when the City budgets the money. Mr. Carlton stated yes~ if it is within a reasonable time. Drainage was discussed in detait~. Mr. Carlton stated that they would give the City a letter ~rom the o%~er of the 5 acre tract stating no objection to draining on this land. The Mayor stated he would check this out with the City Attorney. Then Mr. Arehie suggested eliminating the cul de sac and bringing 5th Avenue north and coming out on 4th Avenue with the traffic, thereby losing two lots but gaining same by eliminating the cul de sac. Mr. Carlton stated there would be no objection. This was discussed and Mr. Shaw~ who was objecting to the lights shining into his windows spoke on the idea. The plan was discussed ~urther in detail. The cul de sac will be elimin- ated and a road will be put in on the east end of the property running north to connect with S. W. 4th Avenue. Mr. Beyrer stated that he is disturbed with this because it is the same Murray of Murray Hills in Lake Worth. The same thing could happen here. Mayor E~fron stated that this will not happen here because the developer is required to post bond. Mr. Blanchette moved the tentative acceptance of the Plat as diseussed~ subject to escrow money and letter ~rom owner of 5 acre tract: seconded by Mr. Archie. (4) Authority to terminate Capital Finance Leases by investing fund money in our own equipment at 5% interest There are ~o dormant funds - Boynton Beach Memorial Park $ llD~ 000 Water & Se~ Deposits 104~ It was asked if Mr. A~tz has discussed v~ith the City Attorney as to whethez these trust funds can be used in this m~a~ner. Mr. Artz stated he has not. Mrs. Jackson moved to grant the request subject to the City Attorney's written approvals seconded by Mr. Roberts. Motion carried 5-0. (2) Authority to Invest in Boynton Beach B..onds and other federally ~uar- ant ced bonds Mr. Artz~s request is to invest in federal bonds and sell out as we need the money to incur expenses. It is not his intent to hold until m~turity. The request was discussed. Mr. Archie moved that the request be granted, seconded by Mrs. Jackson. Motion carried 5-0. (3) Authority to replace Atlantic National Bar~ as Truste~ with one of our local banks This is something that has to be explored over a long period of time. Mr. Artz is asking for authority to explore this to see if it can be done. Mayor Effron stated that the Pinance Director should talk to the Trust Department and tell them we are dissatisfied with the way they are handlin! this. Mr. Artz stated that he has talked with them, and they said to put it in writing. The Mayor~ City Attorney and Finance Director should ~o to the Bank and discuss this, and if this does not help other action should be taken. Mr. Archie moved to have the Mayor, City Attorney and Finance Director ~o to the Bank to represent the Council~ and bring back the results, seconded by Mr. Btanchette. Motion carried 5-0. B!anchette left the meeting. Request of Florida Pneumatic of Lantana (Bob Largent). Florida Pneumatic has proposed to develop 40 acres To the northwest~ con- tiguous to Boynton Beach. They are approaching Council with the thought of developing a 40 acre inductrial park. ~ney are asking Council if the City would be interested in annexing this park. The present site is in Lants_na~ and will have to be moved as it is in the 1-95 right-of-way. The biggest problems would be engineering and public works. It is zoned for light industry. Mr. Taylor stated that it would only be light industry: and that they do o~rn the land. Mr. A~chie stated that this is the type of annexation we are looking for~ in small pieces~ and start where our line is and ~o eonti~u~ous to the west. After discussion Council agreed to pursue this matter. Mr. Taylor was asked to send in a written request for annexation: and the procedure would get under way. Mr. O~Meara thar~ed the Council for listening to this request° Good indus- try is needed in Boynton Beach. R~signation o~ Vel Gabaldon, Prosecutor ad litem Val Gabatdon has resigned and Mr. Hill recommends Robert Thoma~ of Dave McKay's office~ in his place. Mr. Archie moved to accept the request with ~e~ret and appoint Robert Thomas in his place as recommended~ seconded by Mr. Roberts. Motion ca=- tied 4-0. Resignation of Fred Messer, Plumbing Board Mr. Archie moved that the resignation be accepted with regret, Ridgeway be appointed in his place~ seconded by Mrs. Jackson. carried 4-0. and John Motion Approval o~ Bills Police Complex George Davis M. J. Hemminger: Inc. $ 7~500.00 7,627.00 Mrs. Jackson moved the hills be paid, seconded by Mr. Roberts. tied 4-0. Petition Requesting Recreation Area in S. E. Section Mr. Fredericks reported he and Mr. Largent looked at this section of the City. It does indicate that there is a lack of space in the area. There are three areas which could be developed as park areas. The City owns no land in the area. Mr. Fredericks pointed out the three areas, and if they are looked into maybe something can be worked out for using the land for a period of time. Suggested leasing of Seventh Day Adventist's property for the time: if possible. Also 4 acres of ls_nd off S. E. 28th Avenue might be purchased. Recommendation of Mrs. Jackson Mrs. Jackson moved to send a resolution to the Legislative Delegation em- phasizing that we wish the assessing and collecting of taxes to be volun- tary for the City~ and that we pretest the abolishing of Municipal Courts~ seconded by M~. Archie. Motion carried 4-0. Applications for City Manager Mrs. Padgett asked how Council wishes to handle the interviews? A meeting should be held to dis~ass which applicants Council wishes to interview. A meeting was set for Tuesday~ January 25th~ at 7:30 P. M. Also to be discussed Tuesday nightis the suit of Milnor Corporation. Mr. Artz came forward~ and stated that $97000 worth of bills from Russell & Axon jus~ came in. These figures have not been documented. He does not recommend payment until they are. Council advisedMr. A~tz to ealtRussell & Axon~ and tell them Council will not approve these bills or any other bills for payment unless docu- mented. Water Meter Purchase When bids are advertisedit is usually one supply for a fiscal year. With regard to water meters~ can a supply be extended? Council does not feel this can be done, bids will have to be obtained. Mr. Roberts moved togo out on bid for water meters, seconded by Mrs. Jackson. Motion carried 4-0. Mr. Beyrer stated that the young man who spoke on Ridgewood Hills the othe~ night impressed him very much. Mr. Beyrer rode through the area and is quite proud of it. This young man seemed to have fears for the area. Pears of having sub-standard housing in the area. Council should give these people some protection. It was stated that these houses may be sub-standard compared to the houses there, but not sub-standard by the Building Cede. It can be pursued through the City Attorney as to which avenues to take. -5- MI~iTES SPECIAL CITY COUNCIL MEETING JANUARY 20~ 1972 Mr. Beyrer also thought it would be an advantage for the City to pass the resolution to conserve water. This could be used as a reason to cut down on density. Mr. Effron stated that action will be taken at the next meeting. Shell Station - Mr. Phillips Mr. Phillips has requested that Council hear from him in regard to his service station. Does Council wish to hear from him and any other service station o~¢ners? it should be at a time when the City Attorney is present. Meeting adjourned at 5:20 P. M.
