Invocation was given hy Mrs. Rebecca Merkel, D. h. R., followed by the Flag Salute led by Mayor Wallace. ..MINGTES - Regular Meeting, December 7~ 1971 Mrs. Jackson made a correction on Page 8, the minutes state that Mr. Moore stated that the Mitnor request was neither granted nor denied. He also stated tP~t ~'this would have to be resolved in the courtB~: which was not included in th~ minutes~ and should be. ~' Mr. Effron asked about the motion (Page 5)~ made by Mr. ~chie concerning the Police Complex. Mr. Arohie stated that the motion i~: co~rect in the minutes. Mr. Archie moved to accept the minutes of December 7th as corrected, sec- onded by Mr. Effron. Motion carried 5-0. Mayor Wallace requested a few item changes on the AgeP~a. Mrs. Jackson moved to have the Special Meeting of December 23rd at 2:00 P. M., seconded by Mr. Archie. Motion carried 5-0. Dedication of Police Complex - Resolution. 7!..-WW The Resolution will dedicate the Police Complex to Dr. Nathaniel Marion Weems. Mrs. Jackson moved to read the Resolution~ seconded by Mr. Blan- chette. MotiOn carried 5-0. Mayor Wallace read Resolution No~ 7t-WW. Mrs. Jackson moved to adopt Resolution No. 71-WW, seconded by Mr. Motion carried 5-0. Mayor Wellace presented Dr. Weems with a copy of the Resolution. Dr. Weems expressed his gratitude and stated that it has been wonderful serv~ing the people of Boynton Beach. REGULAR CITY COth~CIL ~ETING DECEMBER 21: 1971 At this time Mayor Wallace recognized Jim O~Meara. Mr. O'Meara stated that his good friend with him: Mr. Fred Caposse!a~ has been honored in leaving the City of New York. He further stated that he followed Mr. Capossela from race tracks throughout the country, and never had a winner. Mayor Wallace presented Mr. Capossela with a gold key to open many days in the beautiful sunshine City of Boynton Beach. Mr. Capossela expressed his thanks~ and stated all he could say is ~'It is now Post Time'~. He stated that it was a very wonderful Christmas parade, originally there was to be 42 units; it ended up with 94 units. He eXpressed thanks to the City of Boynton Beach. Mayor Wallace expressed thanks on behalf of the Council and the City for the fine job Mr. O'Meara did on the parade. Rev. John White asked to speak on Old Business, Item G. Bob Cotlier: 915 S. Federal Highway~ asked if Council had any response to% the letter he sent in? Council felt they should be given a chance to take this under advisement. Robert Beyrer asked to speak on Old Business, tromP. He also, on beha]f of the two organizations he represents, expressed to ¥~s. Jaekson~ con- gratulations and best wishes on hex election. It reflects the feelings of the people for her activities in the two years past. He also extended to Mayor Wallace tha~<s for the two years he has served. Mr. Jones stated that by buying through the State the City can affect con- siderab!e savings. He recommended purohasing through the State - S One :' Channel Radios at $498~ and 8 Two Channel at $545, total of $7,254. Hospkins, Jr. (on the table) Mr. Archie moved that the item be memoved from the table, seconded by ~. Blanchette. Motion caz~ied 5-0. Charles Pronrath and George Hoskins, Jr. appeared on behalf of the request. The building is an old fashioned gas station that Mr. Hoskins would like tc turn into a furniture store. These gentlemen presented Council with a sit, plan that was approved by the Planning & Zoning Board. M~. Wallace asked why the plan was not signed by the Planning $ Zoning Board if it was approved? Charles Ayers of the Planning & Zoning Board stated that it was approved and the failure to sign it was an oversight on the part of the Chairman. The City Planner also stated the plan was approved. Mrs. Jackson asked what guarantee is there that it will not revert back to a gas station? The new reGulations state that if a gas station is proposed within a thou- sand feet of another gas station then it would take Council approval. It was not known at this time i~ thi~ abandoned station is within a thousand feet of another gas station. C-1 would all~ a furniture store, but C-2 is needed to al!~; outside dis- plays. A garden effect is planned to display the fuz~lit-ure. Robert Beyrer, Sterling Village~ stated that he attended the Planning & Zoning Board meetings and it was introduced as a Workshop Meeting, and now it appears it was a Special Meeting. He stated that he would investigate this. If it was a workshop meeting it is a question as to whether the Board has the z~ight to pass on it. If the furniture sto~e does not succeed and he finds it necessary to sell it: it could be used as a gas station with major repairs. Mr. ~eyrer u~ ~h~ COU/~it ~ th~ l~t. Jackson could not see how a furniture store with outside displays would improve the main highway. Mr.~tated that the best way to sell outdoor furniture is to dis- play it outside in a garden type area. Mr. Moore stated that the City can not put any restrictions on the deed, but ca/] allow a conditional use of the p~ope~ty witho%%t changing the Mr. Hoskins agreed to have either a conditional C-1 or a restricted C-2. They have no use for it as a gas station. Mr. Archie moved to 9rant a conditional use in C-l, and an Ordinance be drawn up: seconded by Mrs. Jackson. Mayor Wallace stated it is just a technicality, but the plan was not signed. Motion carried 4-1. Mayor Wallace voted ~no". N. E. 10th Avenue Paving Mr. Jones stated that the maintenance of loth Avenue is a County respon- sibility, and the City has suffered from it. He reconmmended that: A project be initiated immediately to obtain 60 foot ri~dt~f way and to construct a 40 foot street with cttrbs, 9utter, sidewalk and additional drainage as needed. 2. Offer to assume responsibility for main=chance as soon as the construction is completed. Offer to share up to 5~ of the cost, not to exceed $50,000. 4. Apply for Pederal aid. 5. Advise County of these actions. 6. If HUD grant is approved, would be used with funds with the City and County. Mr. Blanehette asked how many buildings would be in the right of way? Mr. Az~Lhie asked what kind of HUD funds are we talking about? This will have to be looked into further, and might not be applicable for this purpose. Mr. Jones reconmmends that funds be allocated, and request the County to do the same. Vernon Thompson asked ~ow much time will this take? Mr. Jones thought it would be about a year. Mr. Thomson stated that this has been talked about for the past 20 years. Something should be done now within the next 6 months. ~ew 9~aite asked what happened to the first project to pave half of the road, then the other h~]f? He also stated that one of the problems on 10th Avenue is housing, for some time now they have been promised a housing au- thority. John Stevens stated that for 30 years people have been waiting to get some- thing done. He suggested doing one side, then the othe~ and get something done. Mr. Archie suggested putting a sidewalk on one side of the street only. It was decided to turn this over to the City Manager to handle adminis- tratively. Mr. Archie stated that 3 or 4 months ago this Council agreed to paving on 8th Avenue and nothing has been done, he asked why? The City Manager stated that they have had some trouble getting the con- tractor to move in. Mr. Thompson stated that the comment is made that it is not in the budget, he asked nOt to use this as an excuse and do it for the taxpayers. Mr. Effron asked who has the responsibility to obtain necessary rights of way for a County road? Mr. Moore stated that maintenance and responsibility is that of the County~ whic~ apparently they are not going to assttme. False Arrest Insurance Arrest insurance for Police officers would be $35 per officer per year;for each employee of the Ree~eation Dept. it would be $10 a year. Mrs. Jackson moved to accept the recommendation of the City Manager, sec- onded by Mr. Blanchette. Motion carried 5-0. ADMINISTRATIVE Applications for Permit to Solicit t. Boynton Beach Junior Woman's Club 2. Palm Beach County ~nit, American Cancer Society Mr. Archie moved to approve the applications to solieit~ seconded by Mr. Blanchette. Motion carried 5-0. Police Firing Range Improvements in the amount of $8,870 are still needed to get the range into operating condition. A right of way will be required for an Overpass at N. W. 22nd Ave. and the State Road Department has agreed to pay $77200. This could be used to complete construction on the Police Range. Once it is operating it would probably be self-supporting. Eventually it could become a recreation facility. Chief Huddleston stated that he has the NAR instructors lined up, and had hoped to start firing in 5or 4 weeks. Up to now 90% of the work has been donated, and we have run out of sources. We would like to have the public use these facilities under the supervision of the Police Dept., but the primary concern is the trainin§ of Police personnel. Mrs. Jackson mOved to transfer $7,200 from unappropriated surplus~ sec- onded by Mr. Blanehette. Mayor Wallace asked, since this was the first proposal has anyone gone back to DOT for more money? Mr. Moore felt that there should be an independent appraisal. Mayor Wallace feels the money should be transferred from ........... way. Motion carried 5-0. Mr. Archie asked about insurance for the area? The Chief stated it is insured. Recommendations of Finance Directo~ 1. Purchase of NCR - 400 Magnetic Ledger - Accounting Machine Mr. Artz stated that the primary advantage to this machine is it is a much faster method~ and would have a visible record of the budget. This would also cut down on the time the auditors are here. M~. Archie asked if he is requesting permission to go out for bid? Mr. Artz stated he would like to stay with NCR. Mr. Effron moved to accept Mr. Artz~s request, seconded by Mrs. Jackson. Motion carried 5-0. 2. Policy regarding Signature Cards Mr. Artz recommends that since all of our money is insured we should have two different signatures required on each account in the same savings and loan. He suggested combining two of six authorized signatures in nine different pairs so that we can have nine funds insured for $20,000 each. A resolution will have to be drawn up to this effect. 3. Policy regarding delinquent accounts Mr. Artz recommends placing a lien against property owners who do not pay their utility bills within sixty days. The lien would be released when t~ bill is paid in full. This will motivate people to pay their bills. Council approved of this recommendation. Request of Fire Chief to Trans£er Vehicle The Fire chief requests permission to transfer Rescue ~10 Fire Department Vehicle to the Police Department. Mr. Effron moved to grant approval of this transfer~ seconded by Mrs. Jackson. Motion carried 5-0. Request of Junior Women's Club Request is to park a truck in the City Hall parking lot to collect news- papers for recycling. Proceeds would go to the annual Beauty Pageant. Mr. Archie moved to grant the request of the Junior Women's Club, seconded by Mrs. Jackson. Motion carried 5-0. PropOsal of Cemetery Board The Cemetery Board reeon~ends that the unfinished roadways in Boynton Memorial Park be slurry sealed at a cost of approximately $455~ and the black dirt in the westward portion be levelled at a cost not to exceed $675. Mr. Blanehette moved to approve the recommendation of the Cemetery Board, seconded by Mr. Archie. OTHER Mr. Archie stated that a petition was received from Sterling Village requesting something be done about a gas station on South Federal Highway. A copy should be sent to the gas station: and request ap- propriate action. If nothing is done another action should be t~<en. Request of Archdiocese Mr. Tucker~ Mr. Rieley and Mr. Fitzgerald represented the Archdiocese of Miami. Mr. Fitzgerald stated in regard to the Ordinance limiting height of bui~dings~ at the time of application for Permit there was no restriction to height. On November 23 an Ordinance was passed~ at <~'~ the time it was considered the Archdiocese came forward with a request to be given a Permit for a 7-story building. It was stated by a member of Council that this was not the time to request a Permit~ but only to consider the Ordinance. The request for a building permit was turned down. Mr. Fitzgerald further stated that it is preferred not to go to court with this: but rather to come hack to Council to again make the request. It is felt that the Ordinance does not affect the Archdiocese because the application was made prior to the Ordinance. P~.
