Mr. Jones reported that the lowest bid was received from Wrecking Corpo-

This is a plan to encourage reduction of .taxes within the municipalities.
Mr. Effron moved to proceed with the preparation of appropriate resolu-
tion and have the City Manager sen~t a letter to PaLm Beach County Munici-
pal League requesting the Florida League of Cities to consider this item
at their October meeting· seconded by M~S. Jackson. Motion carried 5-0.
OLD BUSINESS, conrad.
N. E. 10th Avenue Drainage (Mr. Arabic)
Willie Miller asked how long they would have to live with the conditions
on N. E. 10th Avenue. He has lived there 40 years and nothing has been
done about the sim-eot. He also inquired about Railroad Avenue.
Mr. Archie stated that the money is in the budget for this, and the rea-
son it has no~ been done yet is the fact that two easements are not
available. Mr. A~chie stated that Ooe Tomberg said that he would defin-
itely give his easement: and only one easement is stopping the project.
This projefit should be accomplished before the budget runs out.
This item was continued until later in the meeting.

Kr. Kirston stated that it would be an attractive building~ one story
for 4 families. He does not believe that a one story quadruplex can
have a harmful effect on the neighborhood.
Mr. Archie brought out the fact that the parcel as it is presently zoned~
R-1AA: is spot zoning in a strip of R-2A.

to distance requirement~ - Sale, of Alcoholic Beverages
~r. Hotlingsworth: Attorney for Boynton Liquor, stated that the pz~posed
change will result in favored ~£eatment to package stores located in

shopping centers over all pac'kage stores in the community: particularly
those which are presently operating package stores and on premises sales
in conjunction. He further stated that this ordinance would benefit one
group: Wa!greens. He explained in detail his client's objections to
the o~dinanee, and stated that if the ordinance is adopted it would be
detrimental to local businesses. He felt the only justification for
considering this ordinance is because Walg~eens cannot do what they want
under the existing Ordinance, He urged the Council to leave the law as
they now have it.
John Dell, Attorney for Walgreens ~ stated the des/me to see the Ordinance
amended because they would like to put the store into business. He com-
mented on the State Statute that limits the number of lioenses by popu-
lation: and in order to get a license you have to pur-chase one from a
going business.
Mr. Dell stated that the law does support this amendment. The ordinance
does spell out what will qualify as a shopping center. He stated that
the ordinance would be beneficial ~o the community: and there is no legal
reason why this amendment should not be allowed.
Mrs. Jackson requested that the attached be made a part of the minutes
and read same in full. She moved that the considering of this ordinance
be rejected. She withdrew the motion to hear M~. Schupler~s comments.
Mr. Sahuplem: Attorney for Mr. Wasko~ ov~er of the license wishing to be
transferred: stated that he had come before this Council in good faith
with no violation of any law. He stated his reasons in favor of the or-
dinance: pointing out a similar case in ~{iami.
Mrs. Jackson moved to reject the reading of the ordinance. Motion died
for lack of second.
M~. Effron moved to have the reading of the ordinance~ seconded by Mm.
Blanchette. Motion carried 4-1. Mrs. Jackson voted
~ip. Moore read Ordinance ~71-28. lip. Effron moved that Omd. [~-71-28 be
passed on first ~eading~ seconded by ~h3. Blanchette.
John Arehie asked Mrs. Jackson if she wrote the remarks she had just
read and asked to be made part of the minutes. She assured him that she
did do so - strictly on her own~ and then paid to have them typed.
Mr. Ef£ron stated that he was amazed that no residents o£ the City had
come forward /n favor of this license request: and fumther~ that he was
completely satisf/m~ that ~e was no similarity between the two li-
census ~n question.

Mayor Wallace said he bad checked further with the Beverage Board since
this subject came before Council, and he assured those present that to
his knowledge there definitely had been no violation of the Sunshine Law.
He further stated that as long as he served as Mayor he would continue to
bring all matters to Council for their deliberation and decision.
Mr. Btanehette said he had voted twice against this request because he
personally felt it was against the Code of Ordinances, but to rectify
it an ordinance should be dra~n up to bring Boynton Beach up to 1971
instead of leaving it back in 1960. That is the reason he asked that
this ordinance be prepared. He concurred with Mayor Wallace that the
Sunshine law had not been broken, and there was certainly no pay-offs
as the remarks made by Mrs, Jackson had indicated.
The motion carried 4-1. Mrs. JackSon voted ~no~.

Mr. Archie moved to instruct the City Manager to pursue this and have it
done within this fiscal year~ seconded by Mr. Blanchette.
Mr, Hopkins reported on the status of the project at this time, showing
60% ~ompletion. There are only 5 men on the street crew with a lot o~
men on vacation. He suggested to contract this out or employ temporary
personnel and obtain a backhoe to complete the job.
The motion carmied 5-0.
The City Manager was instructed to work out Something for temporary re-
lief of the situation Wednesday A. M.
Mr. Hopkins~ suggestions were discussed.
Mr. Arehie moved to have the Purchasing Agent, Harold Hopkins and the
City ~.~nager draw up the specifications for a backhoe on emergency basis
and go out for bid immediately; seconded by Mr. Blanehette. Motion car-
ried 5-0.
NEW BUSINESS
Plan for Entrance Si~ks - S~qui~le Hill Apavtments
Mrs. Jackson asked who maintains entrance sigms in the City? The City
Attorney stated that it depends on v~ether it is on private property or
the right of way.
Mr. Fuller stated that this is something that comes along all the time
and should be clarified.
