Still tabulating mequests from Department Heads. The intent is to try our best to hold the line. Also~ that a meeting has been set up by Phil Lewis concerning 1-95 on August 18 at Florida Atlantic University~ further ir~ormation about time and building number will be given at a late~ time. Mr. Jones reported that we have bmd a series of meetings with our neighboring co~unities and Jim O'Meara has been invited to Ocean Ridge as Goodwill Ambassador. He com~mended b~. Jim O~Meara repo~ted the plans for the Labor Day Weekend~ with the C~ty Manager and Recreation Director ~or Boynton Beach. There will be a bicycle jamboree~ sky diving contest and other events to take place within the City limits. The idea is to keep people off the highways. The Slogan: "Don't roam - enjoy your holiday at home? He also commended the Parks Department ~or the e>~cellent job the~ have done a~ the north end leading into the City. He has received many compliments on how nice it looks. Moses Sehup!er~ Attorney: West Palm Beach~ asked to speak on Item A, Administrative. Jones stated that Norman Michael might ~nt to speak on Item Administrative. Harry Baumgardner~ Lymph S. Griffin~ and James Tassey asked to speak on Item B~ Public Hearing. Harry LeFort~ 2152 N. E. 1st Way~ stated that he has reported illegal signs for $ years and has reported to this Council~ and asked ~y nothing has been done. Mayom %[altace stated that in the legal interpPetation action has been taken against people that have beer_ ir~ violation. It is his under- standing that most o~ the signs ace legal. Discussion followed and Mayor Wallace asked specifically what signs and where Mm. LeFort mentioned ~wo signs - those at the old Howard Johnson site. Mayor Wallace suggested that Mr. LePo~t make a list of the s~s ~ and it would be looked into. Tho~s Canavan still feels that a fee should be charged at the Beach and a suitable change made. He suggested that i~ Council does not wish to ach upon it then put it be£ore a referendum vote to the tax- payems. -2- MI~ZTES REGULAR CITY COUNCIL ~ETING AUGUST 5~ 1971 BUSINESS Reques~ of Frederick L. R. Hi!l~ City Prosecutor ~. Hill requests the appointment of a City Prosecutor ad litem. He stated that he has not missed a court date in 6 months~ but in case theme is a calendar conflict another attorney should be available. l~r. Hill recon~nended that Larry LaValte from Boca Raton be appointed; he does not know of another attorney in the City that would be inter- ested in accepting the position. He stated that it would be wise to act on this~ in view of the jury trials. Mrs. Jacl~on asked if there was any reason why the City Attorney could not act in the absence of the Prosecutor. Mr. Moore answered no~ but feels that there still should be another attorney. Mm. Amchie moved that this be taken under consideration by the Council~ seconded by Mr. B~f~on. Motion ear~ied 5-0, BIDS Award - Sewage Works,, Project - Lift Station No. 18 & Force Main No. 18 A ~letter was received from Russell & Z×on~ Consulting Engineers, showing bid tabulations and mecom~ending award to Crabtree Construction~ based on low bid of $72~766.45~ 150 days. Mr. Jones concurred with this recom- mendation. Mrs. Jackson moved that the bid of $72~766.45~ 150 days~ from Cmabtree Construction be acceuCed~ seconded by Mr. Blanchette. Motion carmied 5-0. PUBLIC HEARING Peninsular Properties - Letter of Withdrawal Representatives of Peninsular has requested to withdraw the request~ re-do it~ and then re-submit it to the Planning & Zoning Board~ and back to Council at a later date. Mr. Archie moved to accept the withdrawal of Peninsular P~operties~ sec- onded by Mr. Effron. Motion carried 5-0. Mayor Wallace stated that the Planning and Zoning Board requested Site Plan Approval. It is part of the new Master Plan and asked if they could be held ~o this. The City Attorney stated that he did not feel that it could be invoked involuntarily. Mr. Kost stated that he will agree to Site Plan Approval. Easement for Utilities and Road Purposes located in Acreage Section 4~ lying East of Sun Wah Restaurant, 30t0 South Federal Highway~ Boyn~on Beach~ Between Bamboo Lane on the South and Mockingbird Lane on the North Applicant - Jimmy Chin ~. Baumgardner~ 820 Bamboo Lane~is concerned with the protection of his well~ which is located on the easement. He is also concerned with the protection of the tree that beautifies the area and helps hide the restaurant. Lyman Griffin is concerned with his deed. He stated that his deed states he must have access through an alley. City Attorney stated that if this is a matter of private easement then the City has nothing to do with it. ~. Archie stated that there is not enough information to act on. Mr. Griffin is also concerned with the progress o~ the area. He does not want it to effect him that much. James Tassey is also concerned with the protection of his well~ and questioned ~uture use of Mr. Chin's adjoining property. Mr. Sharpe~ representing Mr. Chin, reported that this reqaest came about due to the complaints of the people in the area at busy times for the ~estaurant. Mr. Chin is willing to mark off the parking lot to pre- serve the wells so that they will no~ be disturbed. The tree is in the right o£ way and would haw to come down. It is not Mr. Chin~s intent to harm his neighbors or their wells. Mr. Archie moved to have the City Manager look into these questions~ and be ready to discuss it in the Workshop Thursday: seconded by Mr. Effron. Motion carried 5-0. LEGAL Ord. $71-2! - Chan~e in zoning from R-1 to R-2, Moncur Request The variance was approved by the Board of Adjus~r~ent. City Attorney read Ord. ~71-21. Mr. Effron moved that Ord. ~71-21 be passed on second readinq~ seconded by Mr. Blanchette. Motion carried 5-0. Mrs. Jackson asked why the definitions in Chapter 5 and then again in Chapter SA. It seems repetitious. Mr. Fuller stated that we now have two state laws making the defini- tions in Chapter 5A obsolete, Now in the process of rewriting that se etlon. City Attorney read Ord. ~71-20. Mr. Arehie moved that Ord. ~c71-20 be passed on first reading~ seconded by Mr. Blanchette. Motion carried 5-0. Ord. ~71-22 - Providing additional pension benefits for Firemen Ord, ~71-24 - Providing additional pension benefits for Policemen Mayor Wallace suggested t~t s workshop be held to make aware the pos- sibilities as far as benefits are concerned. He recommended that the two Ordinances be deleted and brought back at a later date. Mrs. Jackson moved that Ords. ~71-22 and ~71-24 be deleted from the Agenda~ seconded by Mr. Effron. Motion carried 5-0. Ord. ~71-23 - Approvin~ Plat of Sutton Manor Mm. Moore mead Ord..--71-23. Mrs. Jackson moved that Ord. ~f71-23 be passed on second reading~ sec- onded by Mm. Blanohette. Requ.est. pf Zell Altman The request involves the M & R Harvest Shop: 205 N, E. 2nd Ave. On determining that the building does constitute a hazard, the Council has to decide whether to proceed with the abatement or to delay the procedure as Mr, Al~nan requested. The City Attorney stated that i£ someone knocked over one of the sup- ports the whole building zould come down. Mr. Todd, owner of the building~ explained how the building was dam- aged by the State Road Department. He sta~ed that the Attorney of- fered h/m about half the Attorney fee for settlement. He explained that the ease would come to ~ourt in November. He wants the building to remain for evidence. He stated that he is in financial difficulty and the building is mortgaged. --6-- MIi\~JTES REGULAR CITY COUNCIL MEET~G AUGUST 3, 1971 LEGAL, conrad. Re__quest of Zell Altman: conrad. Mrs. Jackson feels that it is a hardship~ and made a motion to delay any action on this request. A discussion followed. ~r. Archie moved that Zell Altman~s request ~e denied, and move ahead with the removal of the building as it constitutes a hazard to Boynton Beach~ seconded by ~. Effron. City Attorney suggested contacting the Attorney representing the Road Department regarding the decision of Council due to the existing con- ditions. Mrs. Jackson asked who would demolish the building? The City Attorney stated that if Mr. Todd fells to do it then the City would be authorized to do it~ and levy a lien against the land. Mr. Todd would have to pay the cost. ~. Arohie~s motion carried 4-1. Mrs. JacY~on voted '*no~'. OLD BUSIneSS policy, for reservation of civic center.- Resolution ~71-Z Mr. Frederick has requested that a policy be adopted to guide adminis- tration on the use of the Recreation Building and facilities. He sub- mitted a Policy for approval. M~. Archie moved that the policy be approved~ seconded by Mrs. Jackson° The City Attorney stated that so there is no question to the formality, it was slur~a~ized in the form of a resolution. Mr. ~{oore read Resolu- tion No. 71-Z. Mr. Archie moved that the resolution be adopted, seconded by Mr. Blan- ehette. Motion carried 5-0. DiScussion of front, footaq.e reg.uirements (Mrs. Jackson) ~s. Jackson explained that the Board of Adjustment has to sit through cases where people have 50 foot lots that were platted back in I925, and want to build on them. As long as the Board of Adjustment has this problem and various areas are set up as 50 foot lots she would like to see the Ordinance changed so that a lot that was platted 50 foot could be built on. -7- MINUTES REGULAR CITY COUNCIL AUGUST 3, 1971 C OLD BUSt%.~ESS, conrad · Front footage requirements ~ conrad. The matter was discussed and no action was taken. Proposed Fire Trainin~.~. Area (Mr. Blandnette) The item for the fire tTaininq area in the Goolsby Tract was tabled because of the incoming Recreational Director. Mr. Blanchette moved that it be taken off the table, seconded by ~s. Jackson. Motion carried 5-0. The idea of using the area as a dual purpose for the Recreation Depart- ment and the Fire Department was discussed. Chief Wright explained that one of the recommendations of the South- eastern Underwriters Association is to have suitable training grounds. He stated that the Volunteers could do the work and they are trying to raise the money with such activities as bar-b-ques. It was suggested that more information on how~ how much end when be obtained before making any decision. Ail this to be ~ormulated within 30 days. Discuss Attorney's letter of 3/29/71 re Fiscal A~.ent Bids (Mrs. gac?~son) Mrs. Jackson questioned if it were necessary to go out for bid for fiscal agent. Mr. l,{oore stated he did not feel it was required. She further questioned the need for a referendum in order to borrow money~ and re~erred to Chapter 169 of the State State/res. Mr. Moore suggested that she put her request in writir~g. BUSINESS Use of commercial alarm system Mr. Jones repomted ~receiving a proposal for a ~ype of alarm system in the Fire House and the New Police Complex. The Fire Chief and Police Chief have sho~ interes= in this type of system. The City Attorney has stated that it is monopolistic in nature~ and suggested obtaining competitive bids. This pmoposal would be at no cost to the City to install, but a fee would be charged the subscribers for maintaining the system. Mr. Archie moved that this ~ ~rned over to the Purchasing Agenu to obtain competit~e bids, seconded by ~.~. Btanchette, Motion carted 5-0. -8- M~qUTES REGULAR CiTY COUNCIL ~-.ET~G AUGUST 3, 1971 A DM/aYISTRATtVE Request fora Transfer of Bevera,..qe License Wafmng l.illler~ Attorney rom Ap~ticant~ explained that they are re- questing a tmansfer of a beverage license from Club Continental Walgmeen~s for a pacl~ge store only. Clyde Wolmetl~ as a concerned citizen, stated that it would be a vio- lation o~ the Ordinance to allow the transfer. There is a limit on the distance between t%.~o stores ~o~ a license of this type~ and there is a restaurant with a similar license across the street on U. S. 1. He would like to see the request denied. Mr. P~5aittimore agreed with ~,~. Wommetl that the transfer would be a direct violation o~ the City Ordin~n~ce. The distance has been measured fmom %galgreen~s to Nyman~s. Ms. %~nittimore represented Boynton Liquor Store. He further stated that he spoke with the District Supervisor of the Bevemage Dept.this date and it was his opinion that the licenses in question are similar. ~.[r. Schupler= representing Fir. Waskow: Club Continental: pointed out the advantages to the City if this transfer is granted and Walgree~-{~s is permitted to have a package sto~e. Mms. Jackson moved that the request be denied: seconded by M~. Blan- chette · Mr- E£fmon asked Mr. Moore if the licenses under discussion are similar. Mr. ~oore stated in his opinion they are not similar type licenses. He further stated that he did not feel the distance requirements are ap- plicable because the license requested to be transformed is a general quota type package store license which comes under the general quota authorization of the State Statutes. Nyman~s license is a special type license that can only be utilized in conjunction with the rest- au~ant operation. If the mestaumant closed they could not sell bev- erages on the premises. He ~urther stated that he did not feel the distance requirements would be upheld in court if tested. Mr. ~,Thittimore~ representing Boynton Liquor Store, asked the Council to check With the "experts" to verify the similarity of the t%~o li- censes · Mrs. Jackson read a portion of Sec. 3-2!(a) of the Code o£ O~dinances. The motion carried 3-2. Mr. Archie and ~. Ef~ron voted ~'no'~. Application for Refunding Agreement, SanitamV Sewers - Mm. Ray Sohn. At a previous meeting Council indicated refunding agreements should be approved at Council level. Total amount to be refunded is g2:000.00. Mr. Arohie moved to enter into the agreement with Icc. Archie moved that C, Stanley Weaver be appointed ~o the Planning Zoning Board: seconded by Mr, Blanchette. Mayor Wallace and Mms. Jackson voted for Albe~t Wehrell. Mr. Effron~ ~. Archie and Mr. Blanchette voted for Stanley Weaver. Stanley Weaver was appointed to the Planning & Zoning Board - 3-2 vote. Transfer of Funds for Community Promotion The Chamber has indicated a financial problem which eau be resolved with funds available to ~hem. Funds totalling $10~000 from the City budge~ was allocated for the Chamber which included the three follow- Lng items that were not used 1. $1~000 2. 5. 555 Industrial Im. formation Booklets Brochures Advertising - Aloft Magazine Mr. Jones recommended that this $2:655 be allocated to the Chamber for use in a contingency type ~und to cover those expenses which they cur- rently have which would include a $600,00 expenditure for the Labor Day weekend holiday at home pro,ram. Mr. Wallace stated that this would be with the stipulation that none of the funds be used for the im. terchange. Mr. jones stated that i~was not the inten~. Mr. Archie moved to accept the City Manager's recommendation, and t~ans- for funds within the ~ud~et: seconded by M~s. Jackson. Motion earmled 5-0. Request of Mitnor Corporation The City Attorney has recommended that Council take a good look at the agreement. Mr. Jones recommended that it be tabled until Workshop.
