A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AWARDING THE BID FOR LANDSCAPE
MAINTENANCE SERVICES TO TARE LANDSCAPING
IN THE AMOUNT OF $111,092.50; AUTHORIZING
AND DIRECTING THE MAYOR AND CIT¥ CLERK TO
EXECUTE A CONTRACT BETWEEN THE CITY OF
BOYNTON BEACH AND TARE LANDSCAPING, AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on October 20 1993, bids were opened for the annual
contract for landscape maintenance, Bid No. 068-722-93/CJD; and
WHEREAS, the City Commission of the City of Boynton Beach,
upon recommendation of staff, has deemed it to be in the best
interests of the citizens and residents of the City to award a
multi-award toboth TARE LANDSCAPING, and BLC LAWN MAINTENANCE as
the lowest responsible bidders;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach, Florida, hereby awards the bid to TARE LANDSCAPING, as the
lowest responsible bidder, and authorizes and directs the Mayor and
City Clerk to execute a Contract between the City of Boynton Beach
and TARE LANDSCAPING, which Contract is attached hereto as Exhibit
Section 2.

SERVICE CONTRACT
This agreement dated day of

by and between the CITY OF BOYNTON BEACH, PALM BEACH COUNTY,
FLORIDA, hereinafter called the Owner, and TARE LANDSCAPING (a
corporation organized and existing under the laws of the State
of FLORIDA) and hereinafter called the Contractor.
WITNESSETH: The Owner and the Contractor, for the
consideration stated herein, agree as follows:
ARTICLE I: SCOPE OF WORK
The Contractor shall perform all required work and shall
provide and furnish all labor, materials, necessary tools,
expendable equipment and all utility and transportation services
required for: ANNUAL CO~'r~ACT FOR LANDSCAPE MA~T=NANCE
Landscape various locations within the City maintaining a yearly
contract.
all in strict accordance with the specifications, including any and
all Addenda, and in strict compliance with the Specification
documents hereinafter enumerated.
It is understood and agreed that said labor, materials, tools,
equipment and service shall be furnished and said work performed
and completed under the direction and supervision and subject to
the approval of the Owner or its authorized representative.
However, the Contractor shall retain his identity as an independent
contractor and shall not be considered an agent of the Owner.

The Owner shall pay the Con=ractor as just compensation for
