GENERAL RULES & PROCEDURES FOR PUBLIC PARTICIPATION AT
CITY OF BOYNTON BEACH COMMISSION MEETINGS
THE AGENDA:
There is an official agenda for every meeting of the City Commissioners, which
determines the order of business conducted at the meeting. The City Commission will
not take action upon any matter, proposal, or item of business, which is not listed upon
the official agenda, unless a majority of the Commission has first consented to the
presentation for consideration and action.
Consent Agenda Items:
These are items which the Commission does not need to
discuss individually and which are voted on as a group.
Regular Agenda Items:
These are items which the Commission will discuss individually
in the order listed on the agenda.
Voice Vote:
A voice vote by the Commission indicates approval of the agenda item.
This can be by either a regular voice vote with "Ayes & Nays" or by a roll call vote.
SPEAKING AT COMMISSION MEETINGS:
The public is encouraged to offer comment to the Commission at their meetings during Public
Hearings, Public Audience, and on any regular agenda item, as hereinafter described.
City Commission meetings are business meetings and, as such, the Commission retains the
right to impose time limits on the discussion on an issue.
Public Hearings:
Any citizen may speak on an official agenda item under the section
entitled “Public Hearings.”
Public Audience:
Any citizen may be heard concerning any matter within the scope of
the jurisdiction of the Commission – Time Limit – Three (3) Minutes
Regular Agenda Items:
Any citizen may speak on any official agenda item(s) listed on
the agenda after a motion has been made and properly seconded, with the exception of
Consent Agenda Items that have not been pulled for separate vote, reports,
presentations and first reading of Ordinances – Time Limit – Three (3) minutes
ADDRESSING THE COMMISSION:
When addressing the Commission, please step up to either podium and state, for the record,
your name and address.
DECORUM:
Any person who disputes the meeting while addressing the Commission may be ordered by the
presiding officer to cease further comments and/or to step down from the podium. Failure to
discontinue comments or step down when so ordered shall be treated as a continuing disruption
of the public meeting. An order by the presiding officer issued to control the decorum of the
meeting is binding, unless over-ruled by the majority vote of the Commission members present.
Please turn off all pagers and cellular phones in the City Commission Chambers while the City
Commission Meeting is in session.
City Commission meetings are held in the Boynton Beach City Commission Chambers, 100
East Boynton Beach Boulevard, Boynton Beach. All regular meetings are held typically on the
first and third Tuesdays of every month, starting at 6:30 p.m. (Please check the Agenda
Schedule – some meetings have been moved due to Holidays/Election Day).

A. Approve the piggyback of the Town of Jupiter's bid for painting with Hartzell,
Inc. Bid JW 10-26 with the same terms, conditions, specifications and pricing
for painting of six (6) master lift stations per proposal from Hartzell in the
amount of $25,310.30.
B. Accept the written report to the Commission for purchases over $10,000 for the
month of December 2013.
C. Approve modifications to the Recreation & Parks Department's personnel
allocation and organizational chart for the FY 13/14 budget.

XPLANATION OF EQUEST
program recognizes innovations and excellence in municipal government.In
commemoration of Juan Ponce de Leon’s arrival to Florida in 1513, this year’s program
was themed, “History Happened Here: A Celebration of the Great History of Florida’s
Cities”. The “Teaching Your City’s History& Heritage” category focuses on municipalities
creating educational opportunities and forums where the city’s history is taught, shared
and celebrated.
The city’s phased heritage education program comprises informational brochures, two
heritage trails, an online interactive map, a celebration of stained glass designer Conrad
Pickel, and, if funding is awarded, a proposed Cultural Resources Smart Phone
Application. The entire program has been funded through grants and donations.

I, Jerry Taylor, Mayor of the City of Boynton Beach, on behalf of the City Commission and our
citizens, would like to formally and publicly commend the principal, teachers, staff and students
of Boynton Beach High school for achieving a level of excellence by earning an “A” rating.
The mission of the Boynton Beach High School is to graduate students who have achieved
academic excellence and have developed dignity, respect and personal responsibility in a safe
and caring learning environment. This extraordinary commitment to excellence begins at the
top with Principal Karen Whetsell, who through her leadership and support, empowered
teachers and staff to motivate and inspire students in achieving maximum performance. The
example set by Boynton Beach High School has had a positive impact on the entire community
and everyone involved deserves to be congratulated and rewarded for achieving their goals of
academic success that will help students realize their personal dreams.
Boynton Beach High School offers top Choice Programs and innovative teaching techniques.
Their Academies offer an $8 million Performing Arts Center with a state of the art Black Box
Theatre. Embry-Riddle Aeronautical University has partnered with them to offer unparalleled
studies in aviation and aeronautics. The Information Technology Academy, Culinary Academy
and Early Childhood Academies offer industry certification as well as preparation for college and
career. The Advanced Placement and Honors classes provide a challenging foundation for
college bound students.

that violates the most basic human rights and deprives victims of their freedom; and
WHEREAS, human trafficking occurs when a person is recruited, harbored, obtained, or
exported through force, fraud, or coercion for the purposes of sexual exploitation, forced labor,
involuntary servitude, debt bondage and other methods of slavery; and
WHEREAS, human trafficking affects as many as 27 million people worldwide, including an
estimated two million children who are trafficked for child labor and sexual exploitation; and
WHEREAS, victims of human trafficking suffer emotional, psychological and physical horrors at
the hands of their captors who instill fear to keep them enslaved; and
WHEREAS, human trafficking is the fastest growing criminal enterprise in the world today, and
is tied with arms smuggling as the second largest international criminal industry; and
WHEREAS,human traffickers view Florida as one of the most attractive destinations and transit
points for their victims, and Florida accounts for the third-highest call volume to the National
Human Trafficking Resource Center.
NOW, THEREFORE, urge all residents to increase their awareness and understanding of human
trafficking and commit to protecting the vulnerable and ending human trafficking through
continued prevention, prosecution, education and awareness. I, Jerry Taylor, by virtue of the

ARTal’FRESCO is the first of six satellite exhibitions promoted by
XPLANATION OF EQUEST
ArtPalmBeach International Art Fair which runs from January 23 - 26, 2014 in the Palm Beach
County Convention Center and supported by the Cultural Council of Palm Beach County.
ARTal’FRESCO is a one night art, fashion and cultural exhibition which will feature
unique art experiences including live, interactive painting in artist’s studio settings; plein
air painting; contemporary sculpture installations; a glass blowing demonstration;
painting and photography exhibitions; and video projection. Participants will be
entertained by the South Florida Symphony Brass Ensemble; Illuminated Performance
by Philosifires; Fusion: Fashion and Art’s Living Sculptures and graffiti artists painting
on “ActivistArtistA Bay Gates” doors and walls.
A bus tour sponsored by the City of Boynton Beach in collaboration with the CRA and
local businesses will bring ArtPalmBeach patrons and visitors to Boynton Beach. The
tour will travel from Palm Beach County Convention Center to visit the Art in Public
Places, Avenue of the Arts and then to BBAD for the ARTal’FRESCO exhibition.

ART al’FRESCO IS THE FIRST OF SIX SATELLITE EXHIBITIONS FOR
ARTPALMBEACH 2014
BOYNTON BEACH, FL
--- The artists at the Boynton Beach Arts District (BBAD) will host the
first satellite exhibition for ArtPalmBeach, Jan. 24, from 7:00 p.m. - 1:00 a.m., at 401 - 422 West
Industrial Ave., Boynton Beach. Organized by Lee Ann Lester, ArtPalmBeach is an International
Art Fair held Jan. 23 - 28 at the Palm Beach County Convention Center.
A county-wide group of artists, led by Rolando Chang Barrero, Craig McInnis and Freddy
Hennevelt, known as ArtSynergy PBC, collaborated with Lee Ann, to create six satellite
exhibitions throughout the county. Supported by the Cultural Council of Palm Beach County, the
exhibitions consist of six “Loops” - ART al’FRESCO in Boynton Beach, Worth Avenue Gallery
Walk in Palm Beach, Continuum in downtown West Palm Beach, ArtX in West Palm Beach’s
Historic Northwood Village, South Dixie Antique Row Gallery Walk in West Palm Beach and
LULAʼs Art POP in Lake Worth.
ARTal’FRESCO in Boynton Beach is a one night art, fashion and cultural exhibition which will
feature unique art experiences at BBAD, including live, interactive painting in artist’s studio
settings; plein air painting; contemporary sculpture installations; a glass blowing demonstration;
painting and photography exhibitions; and video projection. Participants will be entertained by

participating in 2015 International Kinetic Art Exhibit and Symposium. Boynton Beach

Symposium. The "Kinetic Art, Year in Review" presentation is open to the public.

the Contract between the City of Jupiter and Hartzell, Inc. for the contract period
October 11, 2010 to October 10, 2013 with the right to extend the Contract on an annual
basis for an additional three (3) years. The City of Jupiter extended the contract for the
period October 11, 2013 to October 10, 2014 per the attached change order #1 dated
June 11, 2013.
The City obtained a proposal from Hartzell, Inc. based on the Town of Jupiter contract
(W10-26) with Hartzell Inc. with the same terms, conditions, specifications and pricing to paint the
City of Boynton Beach six (6) Master Lift Stations (LS356, LS319, LS317, LS316, LS309 and
LS801) for an estimated dollar value of $25,310.30.
The City of Jupiter complied with public bid requirements that are equal to or exceed the City of
Boynton Beach's requirements.

The City of Boynton Beach has 160 sewer stations of which 6 are considered master
stations. Those stations convey sewage water collected from homes and businesses
within the City’s service area to the South Central Regional Wastewater Plant for
processing and treatment. The master stations are scattered throughout the City of
Boynton Beach and they are in plain view of the public and in some cases they are
located next to businesses and residences. These structures have not been painted in
more than ten (10) years; painting them to match our fire houses and our ground
storage tanks will look esthetically better and will improve the City’s image.
The City has obtained a proposal from Hartzell, Inc. to paint six (6) master lift stations
based on the City of Jupiter’s Contract #JW-26 in the amount of $25,310.30.

TO A CANVASSING BOARD CONSISTING OF THE CITY
CLERK OF THE CITY OF BOYNTON BEACH AND THE
PALM BEACH COUNTY SUPERVISOR OF ELECTIONS TO
CANVASS RETURNS FOR THE MARCH 2014 MUNICIPAL
ELECTION; PROVIDING FOR CONFLICT, SEVERABILITY,
AND AN EFFECTIVE DATE.
WHEREAS
, City Commission has determined that inclusion of the Supervisor of
Elections as a member of the City election canvassing board will enhance the integrity of the
election process, provide expertise not otherwise available to the City, and therefore serves the
interest of the electors and public at large; and
WHEREAS,
the Palm Beach County Supervisor of Elections has requested that the
Supervisor of Elections be specifically designated and authorized to canvass City of Boynton
Beach election returns for the March 2014 municipal election, and
WHEREAS
, the City Commission has determined that the responsibility to “canvass the
returns” as that phrase is used in section 2-43 of the City Code and section 144 of the City
Charter of elections is a ministerial and non-legislative function that can be delegated; and

CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1.
The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
being true and correct, and are hereby incorporated herein and made a part hereof.
Section 2.
The City Commission hereby delegates the responsibilities to canvass the
returns of the 2014 City municipal election to a canvassing board comprised of the Palm Beach
County Supervisor of Elections and the City Clerk of the City of Boynton Beach. The canvassing
board’s authority extends to cover all returns for all elected positions on the City Commission

and City Charter amendment referendum questions. The canvassing board’s authority extends to
runoff elections, if necessary.
Section 3.
If any clause, section, or other part or application of this Resolution shall be
held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional
or invalid part or application shall be considered as eliminated and so not affecting the validity of
the remaining portions or applications remaining in full force and effect.
Section 4.
The City shall indemnify and hold harmless the members of the canvassing
board in the event either or both are the subject of litigation arising from their duties as canvassing
board members.
Section 5.
This Resolution shall become effective on passage.

Palm Beach County Day in Tallahassee is an annual event

that offers elected officials of Palm Beach County and its municipality’s the opportunity
to meet face-to-face with the legislators of Florida State Government to share ideas and
express the needs and concerns of their citizens. Per Resolution No. R07-150, each
member of the Commission must obtain concurrence of a majority of the members of
the City Commission for approval of travel expenditures. Deadline for registration is
February 1, 2014.

Attending Palm Beach County Day

has the potential to educate and inform state legislators on the issues and concerns of
local government and the impact of state legislation on local communities. The City’s
lobbyist, Ballard Partners, Inc. will facilitate meetings between our elected official(s) and
state legislators in an effort to advance the legislative priorities for the city that have
been approved by the Boynton Beach City Commission.

Registration for elected officials is $120 per attendee. A minimum

required 2-night stay at the host hotel is $174 per night for a total cost of approximately
$500 per person (registration & hotel), not including travel expenses. There is currently

event.

$500 depending on departure time per person. Mileage reimbursement rate is $0.56

At its July budget meetings, Commissioner Fitzpatrick
XPLANATION OF EQUEST
suggested that the City consider acquiring property from Palm Beach County adjacent
to Lake Ida. Although acquisition of this parcel was not specifically budgeted, the
Commission left this matter open for future review.
The land referenced is approximately four acres in size and is essentially landlocked in
that the property is not accessible to the public from a public roadway. The land is
bordered by water to the east (Lake Ida) and south (L30 Canal), I-95 to the west and
privately owned land to the north. The nearest public roadway, Diane Drive, is just over
2,000 feet to the north.
Palm Beach County has advertised this land for sale. The land is likely of value to only
two entities, government or the private property owner to the north of the subject parcel.
Palm Beach County staff has determined there to be no public purpose for this land and
has therefore deemed this land surplus and is seeking its sale. It is the County’s belief
that the property owner to the north would be an interested party to purchase this land
at market value in order to expand upon private development possibilities on this land,
formerly BE Aerospace. Staff will note that property has been the subject of several
residential redevelopment proposals over the last few years.
City Staff met with County Parks and Recreation staff this past fall to discuss possible
shared public use of the referenced County parcel. City staff proposed using this land to

accommodate bridge access over the L30 Canal in order to provide pedestrian and
cyclist access from Boynton Beach to Lake Ida West Park. City staff believed this
access could be combined with a new sidewalk/path that could be constructed when the
former B/E Aerospace land was redeveloped into residential properties. Even though
there is no guarantee that the private developer would grant this access, staff
recognized that if the County land parcel is sold to a private party that it would be more
difficult to compel the land developer to provide this access. However, it is important to
note that despite City staff recreation goals, County Parks and Recreation staff did not
share the City’s vision and did not support access to Lake Ida West Park from the north
side of the L30 Canal.
Commissioner Fitzpatrick has continued discussions with County Commissioners to
determine if they may have an interest to either partner with the City in a recreation
endeavor or if the County would consider selling the city the land parcel below market
value in order for the land to remain in the public domain for future public use.
Commissioner Fitzpatrick has prepared an outstanding overview of the issues and
recommended future actions. His document is attached as an attachment to this report.

Section 1. The foregoing Whereas clauses are true and correct and incorporated
herein by this reference.
Section 2. Ordinance No. 13-014 is hereby rescinded. The land use on the property
will revert to Public and Private Governmental/Institutional (PPGI).
Section 3. That the Land use Map of the City is amended to reflect this rescission.
Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

Section 5. Should any section or provision of this Ordinance or any portion thereof be declared
by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of
this Ordinance.
