As you are aware, both sec 166.021(4), F 5 and 100.3605, F.S. allow the City to amend the qualifying periods and dates of municipal elections (and the changes in terms of office necessitated by such changes in election dates) by ordinance and without the necessity of a referendum. Buff [ mailto :dbuff@abelleglade- fl.com] Sent: Tuesday, December 31, 2013 10:01 AM To: Glen Torcivia; Christy Goddeau; Jennifer Hunecke Subject: 2016 Election The date of our election, as is with many municipalities in Palm Beach County, is governed by the Laws of Florida, Chapter 83 -498, whereby it states our election will be held the second Tuesday in March and qualifying will be held no earlier than noon on the last Tuesday in January nor later than noon on the second Tuesday in February. With that being said, the County Supervisor of Elections (SOE) has made the following requests: 1. Should the 2016 Presidential Preference Primary (PPP) be held the first Tuesday in March, the SOE requested all municipal elections scheduled January, February, and March be changed to coincide with the PPP, being March 1, 2016; and 2. Requested all municipal qualifying periods be advanced (moved ahead) by two months, not only for the 2016 PPP, but on a permanent basis. Being we are governed by the Laws of Florida, Chapter 83 -498, and should we have an election in 2016 (which we do not have one scheduled), how would we go about to honor the above changes? Realizing the 2016 election date change is a one -time change, I would think an ordinance would suffice, what are your thoughts? And, advancing the qualifying period, couldn't that also be done by ordinance? I look forward to your response. In the meantime, I hope all have a safe, happy, healthy, and prosperous New Year!!
