FAN ORDINANCE OF THE CITY OF BOYNTON BEACH,
LORID~, AMENbINGSECTION 21-35, 2~-42 AND
21-55.1 OF cHAPTER 21 OF THE CODIFIED
ORDINANCES OF SAID CITY PERTAINING TO THE
MUNICIPAL EMPLOYEES' PENSION PLAN, FOR THE
PURPOSE~OF CLARfFYING AND'AMENDING SAID
SECT~IONS; PROVIDNG FOR AUTHORITY TO CODIFY,
SAVINGS CLAUSE, REPEALING PROVISIONS, EFFECTIVE
DATE~NDFO'R OT~R pURPOsES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BO~qTON BEACH, FLORIDA:
Section 1: That Section 21-35 of Chapter 21 of the
Codified Ordinances of the City of Boynton Beach, Florida, is
hereby amended to read as follows:
"Section 21-35. Termination of membership.
Should any member separate from the service of the
City for any reason except his retirement, death or
termination after having completed 10 years of credited
service or after total and permanent disability he
shall thereupon cease to be a member of the plan
and his credited service at that time shall be
forfeited by him except as provided by Section
21-5~ of this article."
Section 2: That Section 21-42 of Chapter 21 of the
Codified Ordinances of the City of Boynton Beach, Florida zs
hereby amended to read as follows:
"Section 21-42. Return of accumulated employee
contributions. (a) Should any member cease to be
~n~mployee of the City of Boynton Beach for any
reason ~xcept his retirement, disability or death,
he shall be paid all of his accumulated contributions
snanding to his credit in the fund, as he shall
demand on forms furnished by the council in ac-
cordance with Section 21-53."
Section 3: That Section 21-55.1 of Chapter 21 of the
Codified Ordinances of the City of Boynton Beach, Florida, ms
hereby repealed.
Section 4: Authority to Codify: Specific authority is
hereby granted to codify and Incorporate this Ordinance in the
City's existing Code.
Section 5: Separability: Each of the provisions of
this Ordinance is separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid,
the remaining portion shall not be affected but shall remain ~n
full force and effect.
Section 6: Repealing Provision: All Ordinances or
parts of Ordinances in conflict herewith are hereby repealed.
Section 7: Effective Date: This Ordinance shall
become effective on the first day of June, 1978.
