O78-07ORDINANCE NO. 78-7 AN ORDINANCE OF THE CITY OF BO!rNTON BEACH, FLORIDA, AMENDING ARTICLE V~, SECTION 21-93, PROVIDING FOR SURVIVOR-BENEFITS'UNDER MUNICIPAL FIREMEN'SRETIREMENT FUND, AND PROVIDING FURTHER FOR AUTHORITY TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISION, AN EFFECTIVE DATE AND FOR OTHER PURPOSES~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Article VI, Section 21-93, of the Codified Ordinances of the City of Boynton Beach~ Florida, is here by adding thereto the following subsection: by amended "(g~ If any Member with at least ten (10) years of continuous service shall die prior to retirement or other termination o~ employment with the City, a death benefit shall be payable to the deceased Member's spouse. The benefit shall equal 2%% of average final compensation for each~year of continuous service. It shall be payable in equal monthly installments commenc!ng the first day of the month following the data'-of death and ceasing upon the death or remarrmage of the spouse." Section 2: Authority to Codify: Specific authority ms lereby granted to codify and incorporate this ordinance in the City's existing Code. Section 3: Separability: Each of the provisions of this ordinance is separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remamning portion shall not be affected but shall remain in full force and effect. SectiOn 4: Repealing Provision: All ordinances or )arts of ordinances zn conflict herewith are hereby repealed. Section 5: An Effective Date: This ordinance shall become effective in the manner and at the time provided by law. First reading this ~- day of February, A.D., 1978.
