AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA AMENDING SECTION ll.iC, APPENDIX A,
ZONING REGULATIONS OF THE CODIFIED ORDINANCES
OF THE CITY OF BOYNTON BEACH, FLORIDA
RELATIVE NON-CONFORMING LOTS; PROVIDING FOR
A SAVINGS CLAUSE, REPEALING PROVISIONS, AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
BE'.iT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA:
Section 1: That Section ll.iC, Appendix A, Zoning
~egulations of the Codified Ordinances of the City of Boyn~on
Beach, Florida be and the same is hereby amended to add thereto
the following subsection:
"4. In the event title to any non-conforming lot or
lots described in this section is conveyed to an individual owner
or owners subsequent to the effective date of this amendment, the
exceptional provisions of this section shall not be applicable to
said lot or lots, and prior to issuance of a building permit for
construction of improvements on any of said lot or lots~ the owner
shall be required to purchase, or acquire, additional adjacent
property to meet minimum lot requirements established by ordinance
Dr in the alternative, to obtain a variance or special exception
from the municipal Board of Adjustment for the use of subject
property."
Section 2: Separabilit~,: Each of the provisions o~
this ordinance is separable, including word, clause, phrase or
sentence, and if any portion thereof shall be declared invalid, th~
remaining portion shall not be affected but shall remain in full
orce and effect.
Section 3: Repealing Provision: All ordinances or
arts of ordinances in conflict herewith are hereby repealed.
Section 4: An Effective Date: This ordinance shall
)ecome effective in the manner and at the time provided by law.
First reading, this ~ --day of February, 1978.
Second, final reading and. passage, this ~/~ day of
February, 1978.
