R14 -095 2 3 A RESOLUTION OF THE CITY OF BOYNTON BEACH 4 DECLARING AND CONFIRMING THAT CERTAIN 5 AREAS REMAIN SLUM OR BLIGHTED AREAS AS 6 DEFINED IN CHAPTER 163, PART III, FLORIDA 7 STATUTES; DECLARING A NEED FOR 81 REHABILITATION OF SUCH AREAS; PROVIDING 9 FOR SEVERABILITY; AND PROVIDING FOR AN 10 j EFFECTIVE DATE. 11 12 ; j WHEREAS, the Legislature of the State of Florida enacted Part III of Chapter 163, 13 G 1 Florida Statutes, (The Community Redevelopment Act of 1969, referred to as "The Act "); and 14 15 WHEREAS, the City Commission of the City of Boynton Beach, pursuant to the Act 16 has created the Boynton Beach Community Redevelopment Agency; and 17'1,1 18 { I WHEREAS, the City Commission, pursuant to the Act, has previously adopted and 19 amended the Community Redevelopment Plan; and 20, 21 WHEREAS, the City Commission, pursuant to the Act, has previously declared areas 221 Boynton Beach, as described in the Community Redevelopment Plan, as it has been 23' 1 amended from time to time, to be a blighted area as defined in the Act, and that the 24 rehabilitation, conservation or redevelopment, or combination thereof, of such area is 25 1 i necessary in the interest of the public health, safety, morals, or welfare of the residents of the 2611 City of Boynton Beach; and 2711 28 1 WHEREAS, the City Commission, pursuant to the Act, finds that the areas of 29 Boynton Beach described in the Community Redevelopment Plan, as it has been amended 30! from time to time, remain blighted as defined in the Act, and that the rehabilitation, 31 conservation or redevelopment, or combination thereof, of such area is necessary in the 32 interest of the public health, safety, morals, or welfare of the residents of the City of Boynton 331 Beach; and 34 35 j WHEREAS, the City Commission has determined that this resolution is for a proper 36 purpose and in the best interests of Boynton Beach; 37 38, NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE 391 CITY OF BOYNTON BEACH, FLORIDA THAT: 40 41 Section 1. The foregoing "Whereas" clauses are true and correct and are 42 hereby ratified and confirmed by the City Commission. 43 44 Section 2. The rehabilitation, conservation, or redevelopment, or a 2 combination thereof, of such area or areas as described the Community Redevelopment 3 i Plan, as it has been amended from time to time, is necessary in the interest of public 411 health, safety, morals and welfare of the residents of Boynton Beach. 5 61 Section 4. It is further resolved that the areas previously declared to be slum or 7 j 1 blighted areas have: 8'I 9 1 1 A. A street layout that is predominately defective and inadequate. 10 a B. A lot layout that is faulty in relation to size, adequacy, accessibility and usefulness. 11 1 C. Areas that suffer from unsafe and unsanitary conditions. 12 1 D. Areas that, to a significant degree, have deterioration of site and other 13 improvements. 14 1 E. Areas that have diversity of ownership which prevent the free alienability of land. 15 ■ F. Areas in which there exist faulty and inadequate street, parking facilities, 16 roadways, and bridges. 171, 18 Section 5. It is further resolved that the powers of the Community 19 Redevelopment Agency shall continue to be exercised in accordance with provisions of 20 , Florida Statutes, Chapter 163, Part III. 211 22 '1 Section 6. Should any section or provision of this ordinance or any portion 23 !I hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction 24 1 to be invalid, such decision shall not affect the remainder of this ordinance. 25` 26 Section 7.
