BE 1T ORDAINED BY THE CITY FLORIDA: to regulate the parking and boats and/or boat t~ailers. and in the best interest of COUNCIL OF THE CITY OF BOYNTO] Section 1: Purpose: The purpose of this ordinance is storage of recreational vehicles and These regulations are intended for the citizens of Boynton Beach to pro- vide easy access to recreational vehicles while promoting the hea~th, safety and welfare of all the citizen~ of Boynton Beach. Section 2: Scope: These regulations are intended to ~e applicable in all residentially limits of Boynton Beach. Section 3: Definiti6ns: a. Recreation Vehicle: zoned areas within the City Any travel trailer, motor home, slide-in camper, or other unit built or mounted on a chasis, ex- cluding vans, designed without a permanent foundation, which is used for temporary dwelling or sleeping purposes and which may be legally driven or towed on a highway, and which body length does not exceed 35 feet and total body width does not exceed 8 feet or any boat or boat trailer included in this definition and all othei sport type recreational vehicles and the trailers used to store or transport all such recreational vehicles. b. Building Department: Building department shall mean such department or any division thereof created or established by authority of the City, and entrusted with the regulation, control, and supervision of all matters pertaining bo buildings and struc- tures of any nature and their appurtenances, roadways, sidewalk~, lighting, ventilation~and zonzng; and in the absence of such depart/Gent, it shall refer to the governing authority of the Cib~ o{.~Oy~sen-Beach. c. Governing A~thority~ ~Governing authority shall mean the City Council which is elected and qualified by and for the City. Section 4: Parking of Recreational Vehicles, Boats, and/or Bo~t TraiLer Permitted on Private Residentially Zoned Proper%y: a. Parking or storing of mecreation vehicles, boats and/or boat trailers on private property may be permitted under the following conditions: 1. That the recreation vehicle, boat and/or boat trailer may be parked or stored in a carport. 2. That the recreation vehicle, boat and/or boat trailer may be parked or stored on a driveway. 3. That the recreation vehicle, boat and/or boat trailer may be stored in the rear yard, not closer than five (5) feet of the rear lot line or in the side yard - not projecting beyond the front roof line. 4. That the recreation vehicle, boat and/or boat trailer must be owned and/or used by a resident of the! p~em~ses. 5. That the recreation vehicle, boat and/or boat trailer be currently registered and licensed by State and Federal law. 6. That no recreation vehicle, boat and/or boat trailer may be parked between the r~ght-of-way and the structure unless on a driveway or other hard surfaced area, such as asphalt~ paving stones, shell rock or concrete. 7. Section 5: Parking of Recreational Vehicles, Boats and/or Boa~ T~ailers - ~ublic Rights-Of-Way: a. Public Rights-Of-Way: No recreational vehicle, boat and/or boat trailer shall be parked or stored on any public right-of-way for a period exceeding one (1] hour. Section 6: Parking and Storage of Recreational Boats and/or Boat Trailers Vehicles: a. It shall be unlawful to occupy any recreational vehicle herein defined while said vehicle is parked or stored on private property unless such use is specifically permitted in the applicable zoning district. b. Construction trailers shall be permitted as in Section 4 (H) of Appendix A of the Boynton Beach Code. c. Mobile Homes as defined in Section 1, General Definitions, of Appendix A of the Boynton~Beach Code shall be mitted in applicable zoned districts. Section ~:! More Stringent Regulations to Ap~ly: a.
