AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AME~ING SECTION 10A5 OF APPENDIX A, ZONING
GULATION OF THE CODIFIED ORDINANCES OF THE CITY
OF BOYNTON BEACH, FLORIDA TO REQUIRE CONCURRING
VOTE OF FIVE (5) M~4BERS OF BOARD OF ADJUSTMENT
TO TAKE A~FIRMATIVE ACTION; PROVIDING FOR AUTHORITY
TO CODIFY, SAVINGS CLAUSE~ REPEALING PROVISION, AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CiTY OF BOYNTON
BEACH, FLORIDA:
Section 1: That Section 10A5 of Appendix A, Zoning Re-
gulations, of the Codifisd Ordinances of the City of Boynton
Beach, Florida, is hereby amended to read:
"5. In exercising the abo~e mentioned powers, the ~oard
by the concurring vote of five (5) members may reverse
or, affirm, wholly, or partly, or may modify the order,
requirement, decision or determination appealed from
and may make such order, requirement, decision or
determination as ought to be made, and to that end shall
have all the powers of the official from whom the appeal
is taken. The concurring vote of five (5) members ~f
the Board shall also be necessary to effect any variation
of this ordmnance. No action shall be taken unless~fmv~
(5) members are present and voting."
Section 2: Specific authority is hereby granted to codif'
and incorporate this Ordinance in the City's existin~ Code.
Section 3: Separability: Each of the provisions of this
Ordinance is separable, including word, clause, phrase or sen-
~ence, and if any portion thereof shall be declared invalid, the
remaining portion shall not be affected but shall remain mn full
force and effect.
Section 4: Repealing Provision: All ordinances or parts
of ordinances mn conflict herewith are hereby repealed.
SectiOn 6: An Effective Date: This Ordinance shall be-
come effective in the manner and at tht time provided by law.
