3' A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 1 FLORIDA, APPROVING AMENDMENT NO. 1 TO
5 INTERLOCAL AGREEMENT BETWEEN THE CITY OF
6 BOYNTON BEACH AND PALM BEACH COUNTY
7 REVISING THE COMPLETION DATE FROM
8 NOVEMBER 30, 2014 TO SEPTEMBER 1, 2015 FOR
9 OYER PARK BOAT ACCESS CHANNEL DREDGING;
10 ' AUTHORIZING THE MAYOR AND CITY CLERK TO
11 SIGN AMENDMENT NO.; AND PROVIDING AN
12 EFFECTIVE DATE.

14 WHEREAS, on February 5, 2013 the City of Boynton Beach entered into an
15 Interlocal Agreement with Palm beach County for the Specific purpose to allow the County to
16 perform dredging of the boating channel from the City's Oyer Park boat ramps to the
17 Intracoastal Waterway; and
18 WHEREAS, the City dredging project was a small component of a much larger
19 dredging project in the general vicinity of the Boynton Inlet and even though the City work
20 has been largely completed for some time, the overall project has not reached final completion
21 and thus the Interlocal Agreement must be amended to extend the completion date from
22 November 30, 2014 to September 15, 2015; and
23 WHEREAS, the City Commission of the City of Boynton Beach upon

241 recommendation of staff, deems it to be in the best interest of the citizens and residents of the
25 City of Boynton Beach to approve and authorize the Mayor and City Clerk to execute

26 Amendment No. 1 to Interlocal Agreement with Palm Beach County for the County to design,

27 ° perform and manage channel dredging at Oyer Park extending the deadline for completion
;
28 from November 30, 2014 to September 1, 2015.
29 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

1 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
2 being true and correct and are hereby made a specific part of this Resolution upon adoption
3 hereof
4 Section 2. The City Commission of the City of Boynton Beach hereby approves
5 and authorizes the Mayor and City Clerk to execute Amendment #1 to the Interlocal
6 Agreement with Palm Beach County for the County to design, perform and manage channel
7 dredging at Oyer Park to extend the deadline for completion from November 30, 2014 to
8 September 1, 2015, a copy of said Agreement is attached hereto and made a part here as
9 Exhibit "A ".
10 Section 3. That this Resolution shall become effective immediately upon passage.

INTERLOCAL AGREEME
BETWEEN
PALM BEACH COUNTY AND THE CITY OF BOYNTON BEACH
AGREEMENT #R2013 -0166
Boynton Boat Club Access Channel Dredging
AMENDMENT NO. 1
THIS AGREEMENT, entered into on the 5th day of February, 2013, is hereby amended
as follows:
• Article 4 is hereby amended to extend the completion date of the Agreement from
November 30, 2014 to September 1, 2015.
• Article 15 is hereby replaced with the following: Equal Opportunity. The COUNTY and
the CITY agree that no person shall, on the grounds of race, color, sex, age, national
origin, disability, religion, ancestry, marital status, familial status, sexual orientation,
gender identity, gender expression, or genetic information be excluded from the benefits
of, or be subjected to any form of discrimination under, any activity carried out by the
performance of the Agreement.
• This Amendment may be executed in one or more counterparts each of which shall be
deemed to be an original and all such counterparts shall constitute one instrument.
All other terms and conditions of the Agreement shall remain unchanged.

IN WITNESS WHEREOF, the County of Palm Beach, Florida has caused this
Agreement to be signed by the Chairman of the Board of County Commissioners and the seal of
said Board to be affixed hereto and attested by the Clerk of said Board, pursuant to authority
granted by said Board, and the City of Boynton Beach has caused this Agreement to be signed in
its corporate name by its mayor and its corporate seal to be affixed hereto, attested by its City
Clerk, the date and year first above written.
