AN ORDINANCE OF THE CITY OF BOYNTON BEACH~ PLOR~LA~
AMENDDNG SECTION 25 B-8~ OF THE IODE OF ORDINANCES
DP SAID CITY~ PROVIDING FOR EXCEPTION TO REQUIRE-
MENT OF ERECTING~SAFETY ENCLOSURES FOR POOLS LOCATED
IN IOMMZRCIAL~ CONDOMINIUMS OR COOPERATIVE APARTMENT
COMPLEXES~ PROVIDING FOR SAVINGS CLAUSEs REPEALING
PROVISION~ AUTHORITY TO CODIPY~ AN EFFECTIVE DATE AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH~
FLORIDA:
Section 1: That Section 2~ B-8 of the Codified Ordinances of
~the City of Boynton Beach~ Florida providing for safety enclosures
for pools located within said municipality, be and the same is hereby
amended by adding the following subparagraph:
~?Section 25 B-8. Safety Enclosures.
(f) Ail pools connected with commercial ventures, such as
motels~ or situated in recreational areas located in condominium~
mo~l~&rative apartments~ or commercial rental apartment complexes, and
otherwmse guarded or under reasonable surveillance by competent and
responsible personnel~ shall be excluded from the requiremenEs Df this
section; however~ the owners of such operations shall be requ~ed to
maintain adequate liability insurance policies covering said poois in
the amount o~ not less than g%G0~000.00'~$~00~000.00 coverage~ if
they choose not to erec~ a safety enclosure as described hereinabove?
Section 2: Separability: Each of the provisions of this
ordinance are separable, including word~ clause: phrase or sentence~
and if any portion thereof shall be declared invalid, the remainmng
portion shall not be affected but shall remain in full force and
effect.
Section 5: Repealing Provision: Ail ordinances o~ par~s of
ordinances in conflict herewith are hereby repealed.
Section 4: Authority ~o Codi~: Specific authority is hereby
granted ~o codify and incorporate this ordinance into the City:s
existing Code.
Section 5: An Effective Date: This ordinance shall become
effective in the manner and a~ the time provided
