Accept the FY 2012 -13 Budget Status Report of the General Fund & Utility Fund for the two (2) month period ended November 30, 2012 Commissioner Segal asked for further clarification of the data. Tim Howard, Director of Finance, explained the report includes the status of the revenue and expenses as of the end of November. The revenue is lower this year. It is the timing effect of property tax distribution that was received in December this year. The difference will level out next month. The expenditures reflect the annual payment for the pension contribution that was larger in 2013 than 2012. The information on the Utility Fund shows a snapshot of the status compared to last year. Commissioner Holzman wanted to know the actual amount of the pension contribution. Mr. Howard reported last year the contribution was $9 million for all three plans and this year the contribution was $11.2 million. 7 Meeting Minutes Regular City Commission Boynton Beach, FL February 19, 2013 Ralph Skarecki, 1331 Federal Highway, commented the political season is evident by the media coverage and voice of the homeowners. He did not support Commissioner Holzman, but felt it was unfair of him to sit and have to listen to what has been asserted. He contended Boynton Beach was getting dirty and pointed out there had been a boat trailer parked on SE 13 and SE 3rd for over three months, on a sidewalk, at an intersection. He was dissatisfied that safety was not a concern and that employees going to the Dunkin Donuts had not seen the violation and has not mentioned the problem. The representatives should tour the City more often to see the problems. He supported the Commissioners for giving their time to the City, but contended the City was getting dirty and should be cleaned up to make Boynton Beach a better city. Mr. Skarecki indicated, on Gateway between 1 -95 and Federal Highway, many of the houses are in poor condition and there is a trench in one front yard that has been there for over two months. He realized the City was attempting to renovate the downtown area, but if the City continues to deteriorate, it would not get any better. He suggested Boynton Beach was a boating community and a boat supplier with a store may attract more boaters with money to spend. They can add cash flow to the community. Mr. Skarecki advised he was offended by the re- naming of Veterans Park to Ocean Avenue Park. The Park should have been named after someone who served for the City or a veteran who died for this country. The Commission took the politically correct route and merely named it Ocean Avenue Park. He supported the City Manager and suggested she be given her raise and the City could move forward. Ms. LaVerriere had managed a four person council and should be given her raise. Sunny Garcia, 1631 NW 3rd Lane, did not know who got rid of the landscapers, but the medians needed attention. The hedges are very high and someone could get hurt and the City sued. He demanded all the hedges be trimmed as soon as possible. No one else coming forward, Mayor Hay closed public audience. 5. ADMINISTRATIVE A. Attorney Cherof advised the application had not been filed for the site plan as a hotel and there is nothing for staff involvement until the application is made. At that point, the issue would be evaluated. Ed Breese, Principal Planner, acknowledged an application had been filed, but it was on hold pending responses by the developer to staff comments. There were approximately 149 staff comments. Mayor Tayor appreciated and thanked the residents for coming to the meeting and relating the background and history for the benefit of the new Commissioners. Mayor Taylor commented he did feel there may have been an error in judgment when the vote was originally taken. As Mayor at that time he accepted full responsibility for the decision. He would work to correct the problem. Commissioner Hay commended the residents on their organization and presentation. No one else coming forward, Mayor Taylor closed public audience. 5. The Committee duplicates what staff has already done and consumes extensive time -from staff to assist the Committee. There has also been a problem getting volunt to serve on the Committee. One of the possibilities is to disband the Committee; Attorney Cherof poin$ out there was an Ordinance on the agenda that would reduce the membership from seven to five members. He recommended the appointments to the Financial Advisory Committee be tabled for now. 9 Meeting Minutes Regular City Commission Boynton Beach, FL April 16, 2013 Commissioner Casello inquired if the qualifications were always in place, how did the Committee function for so many years. Attorney Cherof explained when the Ordinance was first adopted, creating the Committee in 2010, it was decided the members should hold a certain level of professional experience, rather than expressing personal opinions. The qualifications could be satisfied by any one Committee member. Currently, five of the seven members had to have at least one of the qualifications. The amendment would reduce the number of members from seven to five and they should all have at least one of the qualifications An additional category could be added that would be equivalent experience in business or whatever. The original intent was to have professionals on the Committee so the opinions had some professional basis. Mayor Taylor emphasized his position that it was duplication of work and makes additional work for staff. The committee could always be reinstated at a later date. Commissioner Fitzpatrick understood the qualifications were individually required, not all qualifications for one applicant. Attorney Cherof agreed the applicants did not have to have all the qualifications, rather any one. Motion Commissioner Merker wanted to table the matter to do more research. The motion failed for lack of a second. Vote On the original motion the vote was 2 -3 (Commissioners Merker, Fitzpatrick and Casello dissenting). Attorney Cherof read Proposed Ordinance No 13 -008 by title only, on first reading. Motion Commissioner Fitzpatrick moved to approve as read except under Section 3, B.1, except saying all the regular members on the Committee, shall say three of the five regular members of the Committee shall have one of the following qualifications. The motion dies for lack of a second. Commissioner Casello asked if the Chair of the Financial Advisory Committee would be allowed to speak. Mayor Taylor agreed. Don Scantlan, 13 Cedar Circle, Chair of the Financial Advisory Committee since its inception, agreed the intent of the change was to reduce the size of the Committee because of the difficulty in having a quorum to meet. He disagreed on two issues. It 17 Meeting Minutes Regular City Commission Boynton Beach, FL April 16, 2013 was never the intent that any one member have all the qualifications and he disagreed with the demand on staff time. Mr. Scantlan explained the research projects typically require the same effort from staff that is required to develop the budget. Nothing burdensome has been brought on the staff, other than recording the minutes and attendance by the Committee's liaison. Every advisory board has those demands on staff. The members are asked to meet with not only staff but also do independent outside research with other municipalities and residents. The Committee exists to serve the Commission and attempt to be another data point. The budget process is difficult The staff has their perspective, the community has their perspective and the Commission has their perspective Mayor Taylor agreed and commended Mr. Scantlan for his work as Chair The people have volunteered their time and put an honest effort into the topics. He personally believed that staff was doing the same things as the Committee and the Commission ought to be doing what the Committee was doing. Mr. Scantlan corrected the fact the Commission had implemented some of their suggestions and several recommendations were to maintain the status quo that was the ultimate outcome. Motion Commissioner Merker wanted to table the item until the next meeting. The motion died for lack of a second. Attorney Cherof explained the Committee would remain the same with no change. 14. Vice Mayor Hay seconded the motion' Vote The motion passed unanimously. 9 Meeting Minutes Regular City Commission Boynton Beach, FL June 4, 2013 Vice Mayor Hay stressed speed bumps are very difficult for emergency vehicles to negotiate and timely respond to emergencies. There does need to be a balance of speed and safety issues. Mr. Zech felt there could be other alternatives to slow the traffic. Jan Garside, 1902 SW 17 Avenue, pointed out that 22 Street from Woolbright to 19 Avenue to Congress is a route taken to avoid the intersection at Woolbright and Congress. Residents have been concerned with crossing the streets because of the traffic speeds. She felt it was a major issue and suggested table bumps be utilized that would slow down the traffic. Commissioner Fitzpatrick recalled over 22 years as a paramedic he had made over 5,000 calls to Leisureville. Speed bumps become a problem getting to the calls and transporting to the hospital. Every speed bump generates significant pain for the patient. Campanelli Drive is the short cut to Bethesda Hospital and in emergency situations every second counts. With regard to the hedge, Commissioner Fitzpatrick thought since the hedge was on private property it would be the community's issue rather than the City. Diane Lawrence, 1907 SW 22 Way, had approached the Board of Directors for Leisureville who indicated the hedge was City property. She suggested graded speed bumps could be used and ambulances could traverse those. Mayor Taylor informed everyone that Commissioner Fitzpatrick had served for over 20 years as a paramedic for the City of Boynton Beach. It is important that bids be obtained. Kofi Boateng, Utilities Director, responded the same company had built three other tanks and those would be put out to bid. The tank being repaired is one of a kind in the country and requires specialized engineering and construction methods. August 20, 2013 INDIVIDUAL SPEAKERS WILL BE LIMITED TO 3 MINUTE PRESENTATIONS (at the discretion of the Chair, this 3 minute allowance may need to be adjusted depending on the level of business coming before the City Commission) Shirley Cassa, 217 SW 14 Street, spoke against the building of a hotel on West Ocean Drive. There are currently 10 hotels in the City of Boynton Beach. The view from the proposed hotel would be the rear of a bowling alley and their parking lot, the rear entrances for the shopping center businesses and directly into the condominiums of private residences in Palm Beach Leisureville. The entrance from Ocean Drive was not acceptable. A two -lane, local road would be transformed into a four -lane highway with the turning lanes involved. The Lake Boynton Estate area where 8 Street begins and on through Palm Beach Leisureville is all residential and would be affected. Their concerns should be considered. Many conditions could be imposed on the developer to ensure safety and quality of life. The options include no hotel, maintain the two -lane road, place a gate in the residential community, and /or signage to prohibit thru traffic. In her view, the developer's plans were unacceptable and she requested the Commission's assistance. Commissioner Merker revealed he had taken a guided tour with Ms. Cassa of the area. They were working with the City for wise use of the budget dollars to invest in the neighborhoods so they can help themselves and bring the property values up. The alternative would be to continue status quo and the trajectory would not be good if nothing is done. He was excited to see neighborhood cleanups and working on community parks. It would be an investment that would return for the City in the future. Doug Brueggermann, 713 SE 4 Street, expressed concern about the future of the Old High School. He asked everybody to come together to save the treasure and not tear down any Boynton history. Audrey Gerger, 331 NW 1 Avenue, President of the Garden Club and with the Historical Society supported preserving history and did not want the Old High School torn down. She did want to see landscaping done in her area to make it the first historical district. She would be doing petitioning in the future. She had suggested traffic circles be installed to slow down traffic in the area. A "Yard of the Month" would be selected by the Garden Club and any entries would be appreciated. The butterfly garden at the Children's Museum was another project that would involve community service hours for students who would assist. She is a commercial real estate agent and understood the concerns about the hotel. She opined the residents may have to accept it and adjust to the situation. Landscaping could be utilized. Commissioner Merker had stated he was against the hotel and had toured the area and understood the concerns. He was available to fight with them emotionally, but a legal opinion would have to prevail. The Commission can only do so much. He continued to do what he could to assist them. She announced on February 8, 2014 the second Barrier Free 5K Race/Walk /Run would be held in Hunter's Run. The barrier free park is open to people with all abilities. Another major piece of playground equipment needs to be purchased and the proceeds from the event would be donated for that cause. It would cost $35 a person to participate in the challenge. Elliott Williams, 8892 Livingston Way, invited the Commission and City Manager to the 18 blessing of the animals at St. Joseph's Episcopal Church, October 6 with the services at 4 p.m. There would be a demo of the canine units from Boynton Beach and Delray Beach and the Mounties from the Sheriff's Office. The golf course is one of the City's greatest amenities. Ron Tapper, Golf Course Manager, indicated there were 11 dubs in the County involved. The competition is expanding every year. The Links team has won for three straight years. He thanked Mark Frederick for his initiative to put the teams together with the other clubs. There are nine players on the team. Mayor Taylor was very proud of the entire team. Ms. LaVerriere commended Mr. Tapper for the fantastic job he has been doing. 4. The Education and Youth Advisory Board made $1,100 that would be divided between community funds and the Bob Borovy Scholarship award. Ms. Wilkinson also reminded everyone about the Barrier Free 5K Walk/Run on February 8 to be held at the Barrier Free Park on Congress Avenue. Barrier Free indicates the Park is open to anybody of any abilities. All equipment is wheel chair accessible. The Park is not finished and the funds raised would be used to help finish the Park. The Realtors of Palm Beach are main sponsors of the event. Ray Whitely, from Boynton United, added to Mayor Taylor's remarks that his organization was humbled to be part of the Team of Hope. There was an individual with several degrees that could not get a job that received assistance. Finding employment makes a person less likely to commit crime. Mr. Whitely thanked Mayor Taylor for the opportunity to serve Boynton Beach in another capacity. Mayor Taylor advised many job applications are ignored because the applicant has to reveal if there is a criminal record. West Palm Beach and Lantana have now taken that question off their applications to at least open a door of opportunity for an applicant. Two teams won the Super Bowl in the League and were invited to play in the National Championship held in Tampa. The teams went to the competition and the 8 and under team came in 4 out of 16 teams in the division. The 10 and under team took first place as National Champions. Mayor Taylor commended the players and noted they should be proud of themselves and how they represent the City of Boynton Beach in an exemplary manner. Keep up the good work. Janet Morgano, 803 NE 3rd Street, spoke for the single parents, those with disabilities and others living pay check to pay check that have issues with the water billing cycle. In July, September and December she received two bills in one month. Customer Service explained the area was short on meter readers causing the issue. It is difficult to handle living on a limited budget. She hoped things could be changed. She had asked for a change in date, but still gets assessed late fees. Mayor Taylor advised the issue would be reviewed and a response sent to Ms. Morgano. Commissioner Casello had also received similar complaints. He understood the billing cycle was being revamped. Ms. LaVerriere suggested the second bill may be a reminder notice. The bills were somewhat unclear on the due date and when it would be considered past due and a late fee assessed. The language was changed to clarify the specific dates. There are 16 cycles and the billing time cannot be altered with over 30,000 customers. There would be a change in the template of the water bill over the next 30 days. Ms. LaVerriere agreed to examine the account and contact Ms. Morgano. Analysis was done of the programs, facilities, communication, work flow and delivery of services to the community. It is critical to understand the strengths and weaknesses of the organization. There needs to be an action plan established that is reflective of the challenges to accomplish the established goals.
