3 A RESOLUTION OF THE CITY COMMISSION OF
4 THE CITY OF BOYNTON BEACH, FLORIDA,
5 APPROVING THE ONE YEAR RENEWAL OF THE
6 TOWING FRANCHISE AGREEMENT WITH BECK'S
7 TOWING AND RECOVERY, INC., AND ZUCCALA
WRECKER SERVICE, INC., WITH AN ANNUAL
FRANCHISE FEE OF $95,000 FOR EACH VENDOR;
1 1 AUTHORIZING THE CITY MANAGER TO SIGN A
111i RENEWAL AGREEMENT; AND PROVIDING AN
1 EFFECTIVE DATE.

14 WHEREAS, on September 21, 2010, the City Commission approved Resolution
1' R ! 0 -137 authorizing the City Manager to enter into a Franchise Agreement with the two top
11 ranked respondents to the RFP No. 055- 2110- 10 /CJD; and
1 WHEREAS, the RFP was for a three (3) year term with the option to renew for two
1; (2) additional one (1) year periods; and
1* WHEREAS, on November 5. 2013, City Commission approved Resolution R13-
21 126 for a one -year renewal period ; therefore, this will be the last extension available under
2 the RFP; and
2. WHEREAS, the City Commission of the City of Boynton Beach, upon
2 ; recommendation of staff, deems it to be in the best interests of the residents and citizens of
2L1 the City of Boynton Beach to approve the one year renewal of the Towing Franchise
24! Agreement with Beck's Towing and Recovery, Inc., and Zuccala Wrecker Service, Inc.,
261 with an annual Franchise Fee of $95,000 for each vendor.

21 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
2i; THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
24 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed

as being true and correct and are hereby made a specific part of this Resolution upon

3 Section 2. The City Commission of the City of Boynton Beach. Florida, hereby

Recovery, Inc., and Zuccala Wrecker Service, Inc., with an annual Franchise Fee of $95,000

Section 3. That this Resolution shall become effective immediately.

At the Commission Meeting of December 2, 2014, the City Commission approved the one year renewal to
the Towing Franchise Agreement with Beck's Towing and Recovery, Inc and Zuccala Wrecker Service,
Inc under the same Terms and Conditions, and franchise fee of $95,000.00.
This franchise fee is due in quarterly payments of $23,750.00, with the first payment due December 15,
2014. The remaining payments are due March 15, 2015, June 15, 2015, and September 15, 2015.
