O77-03ORDINANCE NO. 77-3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 66 OF~ARTICLE IV OF THE MUNICIPAL CHARTER OF SAID CITY TO CLARIFY THE N~ANING OF "PUBLIC RECORDS" AND TO ADD SECTIONS 66.1 AND 66.2 TO PROVIDE, RESPECTIVELY, FOR A DEFINITION OF "PUBLIC RECORDS" AND FOR DELIVERY OF SUCH "PUBLIC RECORDS" TO THE CITY CLERK WITHIN TEN DAYS AFTER ~c~CEIPT THEREOF; PROVIDING FURTHER FOR SAVINGS AUSE, REREALING PROVISIONS, AUTHORITY TO CODIFY, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. Florida Statutes, to and WHEREAS, pursuant to Chapter 119 of the all public records as defined in said chapter are required be delivered to the designated custodian of a municipality; ~tEREAS, mnder the Municipal Charter of the City of Boynton Beach, the City Clerk of said City is designated as the cust6dian of all public records of said City; and W~EREAS, a "Central Files" has heretofore been established by said City for the stormng and maintaining of such public the City of Boynton Beach for the efficient daily records of the City; and WItEREAS, the City Council of deems it essential and appropriate operation of the municipal government of said City to require that all such public records of the City be delivered to the City Clerk as such custodian within ten days after recezpt of such public records for the placing thereof in the said "Central Files". CITY NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE OF BOYNTON BEACH, FLORIDA: Section 1: That Section 66 of the Article IV of the Mu~i- Florida, ms hereby City Clerk to attend all~ cipal Charter of the City of Boynton Beach; amended to read as follows: "Sec. 66. Same--Dutmes of clerk. It shall be the duty of the meetings of the City Council, and to keep a correct mznute of all their proceedings, in a book kept for that purpose; the City Clerk shall be the custodian of papers, books and public records of the City and of the seal of the czty, and shall attest and affix the seal of the city on all instruments and documents requiring the same." Section 2: That Article IV of the Municipal Charter of the City of Boynton Beach, Florida, be and is hereby amended by adding Section 66.1 to read as follows: "Sec. 66.1. Same--Definition of public records. 'Public records' shall mean all documents, papers, letters, maps, books, tapes, photographs, films, sound recordings or other material, regardless of physical form or characteristics, made or received pursuant to law or ordinance or in connection with the transaction of official business by the City." Section 3: ~hat Article IV of the Municipal Charter of the City of Boynton Beach, Florida, be and is hereby amended by adding Section 66.2 to read as follows: "Sec. 66.2. Same--Delivery of public records to city clerk. All public records of the City as defined in Sec. 66.1 shall be delivered to the City Clerk as custodian of such public records within ten days after receipt by an5 City efficial or employee of the City." Section 4: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase, or sen- tence, and if any portions thereof shall be declared invalid, the remaining portions shall not be affected, but shall remain in full force and effect. Section 5: of ordinances in Section 6: hereby granted to codify and incorporate this ordinance Repealing Provisions: Ail ordinances or parts conflict herewith are hereby repealed. Authority to Codify: Specific authority is in the City's existing Code. Section 7: Effective Date: This Ordinance shall become effective in the manner and at the time provided by law.
