I A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, APPROVING AND AUTHORIZING THE
CITY MANAGER TO SIGN A SETTLEMENT
s AGREEMENT WITH THE PALM BEACH COUNTY
DEPARTMENT OF HEALTH FOR IMPROVEMENTS
TO THE OCEANFRONT PARK WASTEWATER

1 WHEREAS, Boynton Beach Oceanfront Park is serviced by a 12,000 gallon per day
I rotating biological sewage treatment plant that provides sewer services for the park
1 i restrooms and snack bar facilities; and
1 + WHEREAS, due to aging equipment and significantly lower influent flows, the
1 plant has experienced several short term operating issues which resulted in the effluent
1 ; nitrates exceeding the permit limit; and
1 WHEREAS, to avoid any potential impacts of negative results from monitoring
211 wells, the City has requested additional time to investigate the feasibility of replacing the
2 i plant with a new system designed to meet the low flow conditions and effluent
2 requirements; and
2 WHEREAS, upon recommendation of staff, the City Commission has determined
2 , that

it is in the best interests of the residents of the City to approve and authorize the City
2 1 Manager to sign the Settlement Agreement between the City of Boynton Beach and the

2f NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF

Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
being true and correct and are hereby made a specific part of this Resolution upon adoption

I Section 2. The City Commission hereby approves and authorizes the City
I Manager to sign the Settlement Agreement with the Palm Beach County Department of

Health for improvements to the Oceanfront Park wastewater treatment plant, a copy of the
I Service Agreement is attached hereto as Exhibit "A ".
;1 Section 3. This Resolution will become effective immediately upon passage.
