R14-129 I RESOLUTION R14 -129 2 I A RESOLUTION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA, APPROVING AND AUTHORIZING THE CITY MANAGER TO SIGN A SETTLEMENT s AGREEMENT WITH THE PALM BEACH COUNTY DEPARTMENT OF HEALTH FOR IMPROVEMENTS TO THE OCEANFRONT PARK WASTEWATER ■ I TREATMENT PLANT; AND PROVIDING AN 1 I EFFECTIVE DATE. 1 1 1 WHEREAS, Boynton Beach Oceanfront Park is serviced by a 12,000 gallon per day I rotating biological sewage treatment plant that provides sewer services for the park 1 i restrooms and snack bar facilities; and 1 + WHEREAS, due to aging equipment and significantly lower influent flows, the 1 plant has experienced several short term operating issues which resulted in the effluent 1 ; nitrates exceeding the permit limit; and 1 WHEREAS, to avoid any potential impacts of negative results from monitoring 211 wells, the City has requested additional time to investigate the feasibility of replacing the 2 i plant with a new system designed to meet the low flow conditions and effluent 2 requirements; and 2 WHEREAS, upon recommendation of staff, the City Commission has determined 2 , that , f it is in the best interests of the residents of the City to approve and authorize the City 2 1 Manager to sign the Settlement Agreement between the City of Boynton Beach and the 1! 261 Palm Beach County Department of Health . 9 2f NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF 2131 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 2 , 11 C \i lsers \pramttol\AppData \Local \Microsoft \ Windows \Temporary Internet Fdes \Content IFS \QXDIPCBU\Reso_- 1 Settlement_Agreement with PBCHD OP plant doc 1 i II Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption 4 ' lV F; hereof. i' I Section 2. The City Commission hereby approves and authorizes the City I Manager to sign the Settlement Agreement with the Palm Beach County Department of 1 Health for improvements to the Oceanfront Park wastewater treatment plant, a copy of the I Service Agreement is attached hereto as Exhibit "A ". ;1 Section 3.
