Minutes 12-02-70MINUTES OF REGULAR CITY COUNCIL MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA: WEDNESDAY~ DECE~fBER 2~ 1970 at 4:30 P. M~ PRESENT: Michael V. Michael, Councilman Mrs. Emily Jackson, Councilwoman Leonard Nylund~ Cotulcilman C. Q. Jones, Jr., City Manager Gene MOore, City Attorney Mrs. Tereesa Padgett, City Clerk ABSENT: Thomas A. Sub, ers, Mayor Forrest L. Wallace, Vice Mayor In the absence of both the Mayor and Vice Mayor, Councilman Miehaet presided. Councilman Nylund ted the Pledge of Allegiance to the Flag, and Gene Wright gave the Invocation. Receipt of Election Returns The attached election returns were certified by the City Clerk as sub- mitred by Mrs. Bruli for the North Preeiuet and Mrs. Weaver for the South Precinct. The three highest were designated duly elected, upon motion by Mr. Nytund, seconded by M~s, Jackson and motion carried 3-0. Mr. Effron will ~ecome Vice Mayor in 1971 and Mayor in 1972. MINUTES M~. Nylund moved thee m/nutes of Nov. 18:1970 be accepted as w~itten, seconded by Mrs. ~Jaekson and motion carried 3-0. PUBLIC AUDIENCE Ezell Hester~ 1106 N. W. ist St. - made inquiry as to whether there was a position in the City known as AdminiStrative Assistant. Mr. Jones ~epiied that an individual was serving in that capacity, ~ecause so muo~ was referred to City Manager he needed someone to help with the leg work so he could manage the affairs of the City. It was revealed this is being tested on a temporary basis, and is at present a stopgap and non-classified. Jack- son and motion carmied 3-0. RESOLUTIONS No. 70-GG - enumerating oommitments of Catdos: Developers of Le/sureville M~. Nytund moved that Res. 70-GG be removed from the table and stricken from Agenda. Motion seconded by Mrs. Jackson and motion carried 3._-0. Other Consider utility tax exemption for Churches It was recommended this not be considered at this t/me until full Council is present. Mms. Jaclcson moved to table, seconded by ~. Nytund and motion carried 3-0. P~BLIC HEARING 5:00 P.M. Consider abandonment of a 10' utility easement between Lots 4 and 5~ Block 45, See. 5A, Palm Beach Leisureville Enrico Rossi appeared on behal~ Of Caidos as their engineer. He ad- ViSed that the Plann/ng Board approved the request unarnimousiy. No one spoke against the request. Harold Hopkins stated City has no need for easement. Mm. Nylund moved the request be gPanted for abandonment, seconded by M~s. Jackson and motion carried 3-0. The City Attorney will read Resolution aT next meeting. OLD BUSINESS Request of Philip Moreno for license to provide waste and t~ash removal service for commercial estabtishrnents (On the table) ~. Jones reco~nended t/~ request of Phil Moreno be st~i~en from the Agenda since Mm. Moreno has withdrawn his request. M~s. Jacl~on moved to memove from table and strike from Agenda. Motion seconded by Mr. Nylund and motion carried 3-0. -3- MINUTES REGULAR CITY COUNCIL MEETING DECEMBER 2, 1970 OLD BUSINESS, conrad. Proposal of W. R. Hough for financing Police Complex (O~ the table) Mr. Jones requested this be stricken from Agenda and hold workshop on it. Motion by ~. Nylund to remove this from table and hold for next year~s Council. Seconded by ~irs. Jackson and motion carried $-0, Final Bill of Derrico Construction Mms. Jackson moved to remove final bill in the amount of $49,762.40 for Derrico from table. Motion seconded by Mr. Nylund and motion carried This was explained by Mr. Jones that the City does not have easement but meeting is scheduled Friday morning re deeding property to the County. Since it was not Derric0's fault, and they had fulfilled their obligation, Mr. Nylund moved to pay Derrico the above amount. Consider Waiver of Fee for LiCense to solicit ads for Program The City Manager recommended the fee be waived for license to solicit ads for program at Sunshine Square by Bill Edell. Mr. Nylund moved to grant Mr. Edell*s request and waive fee, seconded ~3 PBs. Jackson and motion carried 3-0. Virginia Farace as Librarian at an annual salary of approximately $77000.00. Mr. Nytund moved to accept the City Manager's recommendation to appoint M~s. Farace Librarian at the above stated salary~ seconded by Mrs. Jac!cSon and mo- tion carmied 3-0. Consider Appointment of Acting Recreation Supt. Mrs. Jackson moved to defer appointment of Acting Recreation Supt. ~ seconded by Mm. NylLhnd and motion carried 5-0. Discuss City's Plan for S. W. 15th Avenue Mrs. Jackson moved to have the City deed S. W. tSth Avezu/e R/W to the County, seconded by ~. Nylund and motion carried 5-0. List of Payments made in October Fir.
