Tereesa Padgett, City Clerk Mayor Summers called the meeting to order at 7:30 P. M. The Invocation was given by Mr. R. B. Vastine, President, Homeowners Association, Leisureville. The Flag Salute was led by Councilman Wallace. Mr. Michael moved that minutes of special meeting of September 5 be ac- cepted as written~ seconded by M~s. Jackson and motion carried 5-0. ,.P~IIB LIC .A.~DIENCE Mr. Michael spoke from a prepared statement to the effect that if he should ever cease to meet qualifications of couneiiman he would resign from the City Council. He ~elt his personal life is not open to debate and he ~ett an individual in the City with selfish motives would forget the whole thing if he would change his vote on the Sign Ordinance. He stated he was not predisposed to change his vote and would not allow anyone to intimidate him. Layton Timm, 118 S. E. 8th Ave.~ then appeared before Council and stated that in his opinion Mr. Michael is not qualified to serve as councilman and he was requesting a legal opinion. He asked if it was determined that ~r. Michael is not qualified if the decisions he had made since failing to qualify would ~e rescinded retroactive. -1- MINUTE S REGUIAR CITY COLhNCIL ~ETING SEPTEMBER 14 ~ 1970 PUBLIC AUDIENCE ~ cont'd. The City AttOrney stated he gave legal op/nion to Council: and they alone determine if a Council member meets legal qualifications to serve. The Council gave 5~. Michael a vote of confidence, and it was determined he is a legal resident of the City of Boynton Beach. Robert Beyrer - objected to the manner in which the budget was passed. Har~y LeF~r~e: ~25 Ocean Inlet Drive - the attack on Mr. Michael by ~. Timm is a ~is~ace~ a~dhe state]~ if Mr~ Michael does not have any place to live !nside the City he can s~y w~th him room and board free of charge. F~. Vincent Mo!to - Smokey's Wnar~ - objected to Culvers moving garbage containers. Kenneth Lyman, 216 S. E. 3rd St. - Objected to Culvers using all facili- ties[of City on F I N D property. Made objections regard/hq new build- 5_ng being built without proper parking and permits. Y~. Herman Forbas, 425 N. W. 4th Ave. - complained about hot rodding on his street, He felt someone is going to be killed if it isn't curbed. Eddie Mitchell, 329 N. E. 12th Ave. - objected ~o blacks being buried in the back of the Cemetery. He felt dead people are being segregated. George Culver - He stated he had been in business for 13 years and he wished his competitors would worry about their own business and stop being so self-righteous. Fir. Molte: Smokey's V~har~ - objected to Mr. Culver and his wife allegedly pulling knife on him and altedged Mrs. Cutver slapped his wife. Mr. Van Deusen - Urged that something be done about the speeding on N. E. 22nd Ave. Cars going 70 mph between 4 and 6 P. M. and 10 and !t P.M. Mr. Jones stated that Chief had requested more enforcement in that area. Further, with reference to garbage collection, Mr. Van Deusen complained about the spillage o~ glass in front of his house: and he personally swept it up. The City Manager stated he felt these complaints would be taken care of: but to bear in mind it is a new system~ and it does need to be corrected, but action will be taken. -2- MINUTES REGULAR CITY COIINCIL MEETING SEPTEMBER 14 ~ 1970 PU. Co,sider requests for change in zoning Parcel James Patterson appeared before Cou/%cil ~efe~ence to his change in zoning on Lots 20 and 21, Block 1, Bo~nton Place, from R1A to R2. Letters in the file fr<~m Bowen and Shook objected to the change. No one appeared in person objecting to the request. M~. Michael moved that the r~commendation of the Zoning Board be fol- lowed to change from R1 to R2: seconded by Mr. Wallace and motion car- ried 5-0. Ordinance ~70-27 was read by the City Attorney re Pattersonts ~equest to rezone Lots 20 and 21 in Block i~ Boynton Place. ~. Michael moved that O~dinance 70-27 be passed on first reading~ seconded by~s. Jack- son and motion carried 5-0. ~rcel 2 Mr. Silverman of Randall Associates and his partner, Mr. Wolfe, ap- peared before Council in reference to rezoning N. 318.5t of S~ of SW% of SW~, Sec. 27-45-43 lying east of Int~acoasta! fmom R-iAA to C-1 for apartments as it,pertains to 624.64' × 243.52~ and 75' × 450' f~om R-tAA to R-2 for duplex south of Lee Manor and east of U. S. !. It was revealed they had sat down with the neighboring property owners and worked out a compromise. C-1 was changed to R-3. Traffic matter has been settled in that they will have private streets. No one op- posed the request in person and it was revealed one letter from Thomas Cape was on file. No one else spoke in favor of request. fi~. Michael moved the request be granted and the zoning be outlined as .approved by Zoning Board by ordinance. City Attorney~ Gene Moore, stated the burden of proof that additional service is needed would be on F~. Benedetto~s shoulders. Mr. Michael moved that they did not show sufficient p~oof to justify operating an additional t~xi service as required by See. 27 of the Code of O~dinances, but for Mr. Benedetto to feel free to apply again when he can prove service is needed. Motion seconded by Mr. Wallace and motion carried 5-0. Mr. Michael moved seconded by M~s. Jackson, that O~dinance 70-22 he passed. ~. Jones stated he and Mr. Hopkins would get with the Committee on Friday. Mr. Wallace moved that Ordinance 70-22 be a~m~pted on second reading, seconded by Mr. Michael and motion carried S-2. Messrs. Nylund and Summers voted ~no~. The Mayor stated he would cooperate to make the system work. Ordinance No. 70-24 - adopting 1970-71 Budget (Smd reading) Reference to adopting 1970-71 Budget, O~dinanee 70-24 was read by cap- tion only, and Mr. Michael moved this be passed on third reading. O~dinance No. 70-26 - setting millage rate for 1970 taxes The City Attorney read Ordinance 70-26 setting millage rate for 1970 taxes. Mrs. Jackson moved to pass O~dinance 70-26 on first reading, seconded by M~. Nylund and motion carried 5-0. O~dinance No. 70-28- (proposed) Anti-pornography The City Attorney recommended the proposed anti-porno~aphy o~dinance he tabled. M~. Wallace moved to table O~dinance 70-28, seconded by Mrs. Jackson and motion carried 5-0. OLD BUSINg. SS Report on vote re purchase of garbage pickup equipment - Mr. Michael apologized to Mayor Summers re vote on purchase of garbage pickup equip- menu and stated he hoped all would work together for the best interest o£ City. Resolution received from Chamber of Commerce re Sign Ordinance The City Manager read a resolution adopted by the Chamber of Commerce with regard to the Sign Ordinance. Mr, Michael moved that the resolution ~e made part of our official records ~ seconded by Mrs. Jackson and motion carried 5-0. Report by City Manager Resolution 70-P - Field parcel With reference to Fields property, clearing is underway: and it will be another week before they will be finished. No further action necessary at this time. Resolution 70-R - Niaosia parcel With reference to the Nicosia parcel it was felt abatement proceedings are in order. The City Attorney was requested to initiate action in Nieosia parcel upon motion by~.~. Miahae!, seconded by Mrs. Jackson and motion carried 5-0. _NEW. Mr. Michael moved that the City authorize the Purchasing Department to go out for bids for additional first-aid vehicle and the City~nager see i~ there is any way to work out purchase of new equipment. Request o£ Teleprompter re change in rates Mr. Michael moved that due to the fact the City is not actually operat- ing Teleprompter TV there is no reason to authorize ra~e change. W. 3rd St. It was felt /nformation should be passed on to Ridgewood Hills that it will cost $9.00 per foot or a total of $8,370, and Council will assess each side t/3rd and ~ will pay 1/3rd.
