15-007 1 I ORDINANCE NO. 15- 00/ 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, 4 AMENDING CHAPTER 1 OF THE CITY'S CODE OF 5 ! ORDINANCES, ENTITLED "GENERAL PROVISIONS ", BY 6 CREATING SECTION 1 -12, TO BE ENTITLED "CIVIL RIGHTS "; 7 PROVIDING FOR NON - DISCRIMINATION WITHIN THE CITY 8 1 AND ALL OTHER ACTIVITIES PROMOTED OR SPONSORED BY 9 THE CITY OF BOYNTON BEACH; PROVIDING FOR 10 CODIFICATION, CONFLICTS, SEVERABILITY AND AN 11 ( EFFECTIVE DATE. 12 13 WHEREAS, the City Commission seeks to codify the City's policy of non- 14 discrimination; and 15 WHEREAS, the City Commission seeks to further ensure a policy of non- 16 discrimination in all activities promoted or sponsored by the City; and 17 WHEREAS, the City Commission finds that codifying a non - discrimination policy is 18 in the best interests of the citizens and residents of the City. 19 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION 20 OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: 21 22 Section 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed 23 as being true and correct and are hereby made a specific part of this Ordinance upon adoption 24 hereof. 25 Section 2. Chapter 1, entitled "General Provisions ", of the City of Boynton Beach 26 Code of Ordinances is hereby amended by specifically creating Section 1 -12, to be entitled, 27 "Civil Rights" to read as follows: 28 Sec. 1 -12 Civil Rights 29 30 Section 1. Purpose. 31 32 The Boynton Beach City Commission desires to secure for its citizens 33 freedom from discrimination because of race, color, national origin, religion, 1 1 ` sex, gender identity or expression, genetic information, sexual orientation, 2 disability, marital status, pregnancy, familial status, or age, and thereby to 3 protect their interest in personal dignity; to make available to the City their 4 full productive capacities; to secure the City against domestic strife and 5 unrest; to preserve the public safety, health and general welfare; and to 6 promote the interests, rights and privileges of individuals within the City. 7 The City Commission also desires to adopt an ordinance which is consistent 8 with federal state and local laws and which affords its citizens a clear channel 9 of access to remedies in the case of alleged discrimination, to wit, the Equal 10 Employment Opportunity Commission, the Florida Commission on Human 11 Relations and the Palm Beach County Office of Equal Opportunity. 12 13 Section 2. Adoption of Boynton Beach Civil Rights Act. 14 15 The Florida Civil Rights Act of 1992, Chapter 760, Sections 760.01 through 16 760.11 and Section 509.092; Florida's Fair Housing Act, Chapter 760, 17 Sections 760.20 through 760.37; the Palm Beach County Equal Employment 18 Ordinance, Chapter 2, Article VI, Division 1, Sections 2 -251 through 2 -313; 19 and the Palm Beach County Ordinance for Equal Opportunity to Housing and 20 Places of Public Accommodation, Chapter 15, Article III, Sections 15 -36 21 through 15 -67 are collectively adopted by reference as the Boynton Beach 22 Civil Rights Ordinance Act, subject to and including by reference such 23 amendments, corrections and additions as shall occur therein or as may 24 i appear in this Chapter. 25 26 Section 3. It is the intention of the City Commission of the City of Boynton Beach 27 that the provisions of this Ordinance shall become and be made a part of the Code of 28 Ordinances of the City of Boynton Beach, Florida, and that the Sections of this Ordinance 29 may be renumbered, re- lettered and the word "Ordinance" may be changed to "Section," 30 "Article ", or such other word or phrase in order to accomplish such intention. 31 Section 4. If any clause, section, or other part or application of this Ordinance 32 shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such 33 unconstitutional or invalid part or application shall be considered as eliminated and so not 34 affecting the remaining portions or applications remaining in full force and effect. 2 i 1 Section 5. All Ordinances or parts of Ordinances, Resolutions or parts of { 2 1 Resolutions in conflict herewith be and the same are hereby repealed to the extent of such 3 conflict. 4 Section 6.
