Vastine, 132 Leisureville Blvd. spoke with regard to acquisi- tion of beach £ront property, commending Council on the consideration of purchasing property~ inasmuch as there will be 9~000 people in this sub-division in ~]e not too distant future, Eddie Mitchell: 329 NE 12th Ave. - Reference to Recreation ~oard ap- pointments. He read from a prepared statement~ making threats. He was adv/sed the individuals who have not attended the board meetings had been dropped and new appointments made~ and all additional names Will be placed on waiting list. David Roberts, 270 South Blvd., High Point - RepreSented residents of High Point Apartments, as it pertains to the State Road Dept. notice that certain buildings will be torn down to make way for I-9S. He criticized the City and press for not notifying them of this condition existing. He requested final drawings o~ the proposed 1-95. He said ~he Department oC Transportation man said he had been thrown off the property when they asked the builder to stop building, qe said the ~uilder declines comment, and further noted the builder, Mr. Sarno, is a member of the Planning Board. -1- MI~IUTES REGULAR MEETING OF WdNE t5, 1970 CITY COUNCIL PUBLIC AUDIENCEi, cOntd, Pmank Carrel~ High point - Stated that there are 29 buildings coming out of High Point tha~ have just been built, which affect 116 families. No~ Diamond.,' 415A Main Blvd.- Stated she had gone to the builders, Chamber of C(m%merce, County Title an~ Abs.~.act, and none of them knew anything abou~ what wa~ going on /n the City. Mr. Michael moVed that this be placed on the Agenda for Council con- sideration under -~Other~ · Motion seconded by Mrs. jagkSon and motion carried 4-0. PHBLIC HEARING 8 P ~ M. Consider request for change in zoning Lots !6 thru 21, Block 4, Lake Boynton Estates Prom R-1 to Applicant: Thomas J. Reale No one spoke in favor of request. Evelyn Howell spoke against the request. It was noted t~o letters of objection are in the file. Mr. Michael moved that the request be denied. Motion seconded by Mrs. Jackson and motion carried 4-0. Approximately 5600 feet of chain link fence - no action taken Pumper with Booster Tank City ~,~unager received bids from four organizations, and recom- mended rejecting same and re-advertise. Mrs. Jackson moved that City go out for bids again for pumper witch booster tank. Motion seconded by ~. Wallace and motion carried 4-0. C. Traffic Signals - SR804 and Seacrest Mr. Hopkins called attention to need ~or traffic signal at Seacrest and 2nd Avenue. He stated Ocean City Electronics, Detray Beach were low bidders. Ym. Michael moved that bid be awarded to Ocean City Electronics for $13:120~ low bid, seconded by }~s. Jackson and motion carried 4-0. -2- I~IINUTES REGULAR CITY COUNCIL ~ETING J~IYE 15, 1970 LEGAL ORDINANCES - 2nd Reading No. 70-12 - Sign Ordinance - on the table Mrs. Jackson moved that the Sign Ordinance be removed from the table~ secohded by Mr. Wallace and motion carried 3-0. Mayor Summers voted ~no,~ . ~. Sheppard spoke for the committee studying the Sign Ordinance, and asked for a meeting with Council. to go over their proposed sign ordin- Mr. Wallace moved to table the sign ordinance, and that a Special Meet- lng be called for Monday~ June 22nd at 7:30 P. M., seconded by Mr. Michael and motion carried 3-0. Mrs. Jackson abstained because she will be out of the City on that date. 70-16 - Amendin9 Seas. 17-51 and 52 of the Code The City Attorney read Ord. 70-16 by title only. Motion by M~. Miehaet to pass' Ord. 70-16 on second reading~ amending Seas. 17-51 and 17-52 of the Code. Motion seconded by Mrs. Jackson a~d motion carried 4-0. ORDINANCE - tst Reading ~o. 70-17 - Amending Sec. 3-19 of the Code Ordinance No. 70-17 was read by the City Attorney. Mr. Michael moved that Ordinance 70-17 be passed on first reading. Motion seconded by M~. Wallace and motion carried 4-0. RESOLUTIONS Res. ~o. 70-0 - Bank Signatures Resolution No.'70-0 was read by the City Attorney. Mrs. Jackson moved that Res. 70-0 adding name of City Manager to bank signatures be approved. Motion seconded by ¥~. Wallace and motion narried Res. No. 70-P - requesting certain parcels to be cleaned up Resolution No. 70-P was read by the City Attorney. Mr. 5lichael moved Res. 70-P be passed. Seconded by Fit's. No. 70'.'Q,.- re purchase of beach property Resolution No. 70-Q was read by the City Attorney, authorizing the City Manager to make application for federal grants to purchase ~ea~h property },~. Wallace moved that Res. 70-Q be adopted, seconded by Mr. Michael a motion carried 4-0. 01XTER The City Attorney reported that the fee to be paid to the County for tax assessing and collecting is approximately .28% to County Tax Col- lector and .32% to County Tax Assessor. OLD BUSINESS Reconsider the reguest of L. Frank McGee on behalf of W. G. Lassiter,Or. Mm. Lassiter requested that his ~equest be reconsidered to construct a service station at NE corner of SR804 and Congress ~ Mr. Michael moved that the request be reconsidered and the permit be granted~ Motion seconded by Mr. Wallace and motion carried 4-0. Discuss Caldos Developers, Inc. Mr. Wallace brought up for discussion Caldos Developers, Ina. He re- viewed the Grand Jury report and prepared statement given by Mr. Benner at Special Meeting: June 8th. Mr. Wallace cited many items that appeared to him to be problems in subject development. D~. Michael stated that unfortunately these are moral questions and the City has no right to legislate moral obligations, but it does have re- sponsibility to collect moneys owed the City. He moved that the $18~000 indebtedness of Caldos to the City be turned over to the City Attorney for collection and reques= immediate payment. Motion seconded by ~Lrs. Jackson and motion carried 4-0. Mr. Wallace requested a meeting with developers - Mr. Granados, President of Caldos and Mr. Benner~ and i~ this is not forthcoming he expects to request the item be placed on agenda for further Grand Jury investiga- tion. Discuss Pol.i. ce Station Complex Mr. Victor Rigaumont, A. rehitect, appeared before Council with reference to construction of Police Station Complex. Mr. Michael moved that City Manager come back at next regular meeting with proposed site locations and cost limits of project and sources of funds, seconded by ~irs. Jacl~on and motion carried 4-0. ADMINISTRATIVE Consider.~ppointments to Planning Board With reference to vacancies on Planning Board, ~s. Jackson submitted the name of Frank McCoy, former Mayor of Boynton Beach. Mayor Summers submitted the name of John ~.~ite and the name of O~is Walker was sub- mitted by Eddie Mitchell. The City Clerk is to check as ~o whether they are all registered voters and appointments are to be made att he next meeting. Report on progress of rest room facilities at Wilson Par~ Mr. Johnson: Recreation Director, stated that the specifications have been prepared for the rest rooms for Wilson Park and are now ready to be sent out for bid. He also reported ai~ conditioner at Senior Citi- sons building is in fine shape now. Also that reareation facilities are open during weekends. Bzell Heste~ stated the sing-in held over the weekend was sadly lacking in regard to suitable piano. He felt the City needed to get a bet-CeD one. Report on Palm Beach County Lea,quo meeting Mrs. Jaokson reported on the Palm Beach County League meeting. It had been determined they could not afford a lobbyist but appointed a liaison committee to %~ork with county eommiesioners to get them to understand problemS of municipalities. It was felt various candidates running ~or office should be interviewed by municipal league. Mr. Jones~ City Manager~ reported on the beach erosion part o~ meeting and stated that Mm. Mariott~ Delray Beach talked of the problems De!ray has suffered and asked that it be a county-wide project~ and county agreed to look into this to create an erosion authority. There is a move to conduct mecreation on a county-wide basis. Mr. Michael moved that supplemental agreement No. 1 for change order as submitted by Russell and Axon he approved as requested by Murphy Con- struetion CO. Motion seconded by Mr. Wallace and motion carried 4-0. List of Payments made in Play Mr. Michael moved that list of payments for ~;my be approved as presented. ~otion seconded by Mr. Wallace and motion caz~ied 4~0. ~pnsider requests for use of Council Qhambers Permission was granted to Leisureville Homeowners organization for use of Council Chambers July 7th, as requested by i~. Vastine; all future requests to clear administratively. Approval of bills Mr. Michael moved that bills of Rubin Construction in amount of $11,029.88 and Brooks Products in amount of $1,035. be approved, seconded by l.[~s. Jackson and motion carried 4-0. OTHER Review of complaints byHigh Point residents with regard to 1-95 con- struction was placed on the agenda earlier in the evening. Mr. Michael reviewed the background and stated right of way was purchased back in 1947 or before. He stated that there had been public hearings to tell people what was coming. He stated there was nothing the City could do to stop Mr. Sarno ~rom selling houses to new residents. Tom Mu!doon, Palm Beach Times ~ stated he did talk to State Road Dept., and that as of the end of this month they were going to have official condemnation in this area. The land is going to be condemned. Spokesman for residents was P~. Roberts who stated that: Residents stated they felt the owner of the land certainly is lacking in morals to do what he has done %o them, who had bought their retirement homes in good faith. The Mayor stated the City records all public hearings and he ~uld be glad to have the public hearings made available to those people i~ they wanted to hear what took place. ~, Michael suggested the Mayor ask the State Road Department send Mr. Ramos or someone here to bring the people up to date on facts on exactly where this road wmll be humlt, if mt is bumlt.
