Tereesa Padgett~ City Clerk In the absence of Mayor Summers, who was attending Mayors Conference in jacksonvitle~ Vice Mayor Forrest Wallace conducted the meeting. He led the audience in t/lc Lord's P~ayer, ~ollowed by Flag Salute by Robert Stoffregen, member of Boy Scout Troop ~305. Introduction of Guests Mrs. Jackson introduced her daughter and three grandchildren from Connecticut. Robert Beyrer, representing Senior Citizens of Sterling Village and Concerned Citizens of Boynton Beach, was recognized. Bertha Welch, Boynton Beach Sorosis Club .P. resentation of Certificates Vice Mayor Wallace presented certificates to students of Boynton Beach Junior High School who participated in the seventh annual Youth in Goverr~aent program. MINUTES - Re.gular Meeting, -April 6, 1970 Mr. Nylund moved that minutes of April 6th meeting be accepted as written, se=onded by Mr. Michael and motion carTied 4-0. PUBLIC AUDIENCE Eddie F~itchell, 529~NE 12th Avenue, appeared in regand to toilet facilities at Wilson Reemeation area. He stated he felt there was great danger in using toilet facilities at the pool area unless this was supervised at all times because little children ~ould fall in and drown and the city would be held liable. He felt there should be outside facilities because of this factor. He asked thet this be placed on the agenda so action can be t~ken. -1- MINUTES REGULAR CITY COUNCIL ~ETING APRIL 20, 1970 Bill Edell - Thanked Council for use of Civic Center for the Sing Into th Sever~cxes program, and thanked Mr. %'&~llace and }~. Eytund for attending. Robemt Bearer - Referred to an article in newspaper regarding the failure of Council to take action on purchasing beach property. He felt i~ tb~ city did not purchase additional ~foo~aqs the existing beach would soon have to be confined to Boynton residents. john %~ite - 122 b5~ 12th Ave. Asked if letter conce~ housing had been received. He ~efe~red to Abitone Apts. at ~4 loth being unsani- tary and hoped city officials would take t/me to make a visit and see for themselves. He feared fop the safety of children's lives due to light fixt~mes which have hot wires exposed. ~arT¥ LeFort, 725 0~ Inlet Drive - read an a~ticle f~om the .news- He felt everyone should be wl!ling to listen to both sides ~-nasmuch as we do have f~eedom of speech. He re~erenced his remarkS to a recent happening with Col. Wehre!l. .Bpb ~Scheurer - Fraternal Order of Police indicated they are in process of b~ilding a police pistol and rifle ~ar~e. Although all of it to date has been ~ donations he requested the city b~iid a fence a~ound the property. Though this is primarily for police training, it is intended to be open to the public. Mmrvin %%%/tesi.de - submitted a petition with regard to the sign at Alfredo's. He noted ~wo addresses had been used 2405 SE Second St. and 240 SE 23rd Ave. is add,ess of ~esidence two houses up from the res- taumant. He said his ~ife had just been brought home ~rom the hospital and this sign is very annoying to the family and neighborhood in ueneral · Howard .Foley, 226 SE 23rd - said he felt this is now a night club and open till 2 A. M. He reiterated the sign to be a nuisance. Kenneth L~man, 216 SE 5rd. He stated the street adjoining his p~op- er~y is two-way, but t~he parking is one-way. He said every~one coming in thinks they have to use his stTeet. He wants somethin~ done as his street is pretty] much tol~n ~p. -2- MINUTES REGULAR CITY COUNCIL MEET]2~G APRIL 20~ 1970 BIDS_ - Receipt of bids for censtr~ction o£ NE 7th Avenue %n aceo~dan? with policy adopted recently by Council bids were ~eeeived Friday and tabulations p~esented at this meeting. MP. Michael moved that mecommendation of Tabulating Committee be accepted and award bid to Hardrives as low bidder. Motion seconded by Mrs. Jack, on and motion caPPied 4~0. ?UBLIC HEARING ,Request ~of APnold St~oshein to abandon that po{t.ion of NE 7th St. abu~tlng Lots 23~ 24_a. nd_25, Block 7, Lake Addition-- No one spok~ against the request. Mr. Stroshein appgared amd stated it would not be possible to build on the south end because the~e is 25' of muck. However, M~. Hopkins indicated the city was planning to build a street on S. E. 7th Avenue ove~ muck. Mr. Nylund moved the request for abandoning that poPtion of the street be granted. Motion seconded by Mr. Michael and motion carried Mrs. Jac~n voted ~no~. Mr. Moore read Resolution 70-I covering the abandonment of the area, returning it to acTeage. Mr. Michael moved the resolution be passed, seconded by M~. Nylund and motion carried 3-1. Mrs Jackson voted Students were excused at this point. .C..onsider .qrantin~. oQnditional use for a ~arcel at NE coroner of .Congress and State Road 80~ fop e service station William G. Lassiter Jr. appeared in reqard to his request for condi- tional use of a parcel at NE comnem of Congress and State Road 804 ~ No one spoke against the request. Mr. Michael moved the mequest be denied, seconded by Mrs. Jackson and motion carmied 3-1. Mr. Nylund voted ~no~. -3- MINUTES REGULAR CITY COUNCIL MEETING APRIL 20, 1970 LEGAL ORDInaNCES - 2nd Reading No. 70~1t - Rezoning Maloney parcel and Fleming Parcel The attorney ~eported that based on the stipulation placed upon the Fleming parcel that a deed be tendered to the city on the North 50' of subject parcel for a right of way into the city o~ned 20 ac~e parcel that subject deed had been p~epa~ed and furD/shed to the applicants, but the fee simple owner was outside the confines of the Lhnited States and the deed could not be signed and returned to the city until some- time in May. Mr. Moo~e recommended that the ord/nanee be passed and the applicants notified that ur~less this deed is physically tendered to the city in acceptable form prior to the expiration of the 30 day period.the Council will ~ive consideration, to revoking that portion of Ord!inanee 70-11 pemtaining to the Fleming parcel. Mr. Michael moved that Ordinance 70-1i pertain/ng to rezoning the ORDIN~NCES - 1st Reading .No.. 70~13 - Repealing O~dinanee 68-19 The City Attorney read Ordinance No. 70-13 in its entirety- M~s. Jackson moved that O~dinance No. 70-13 be passed on first readinu. Motion seeonded by M~. Michael and motion carried 3-1. Mr. Nylund voted ~no~ . No. 70-14 - Amending electricel code The City Attorney read Ordinance No. 70-14 in its entirety. Mr. Michael moved that O~dinance No. 70-14 be passed on first reading. Motion seconded by MrS. jackson and motion carried 4-0. OTHER - Consider recommendation of City Attorney re Board of Adjustment Mm. Moore favored transferring present jurisdiction and authority to Zoning Board and let them recommend to Council~ mather than have an appointive board have final decision. MrS. Jackson moved that the Board Of Adjustment remain status quo. Seconded by Blt. Michael and motion caxTied 4-0. -4- MINUTES REGULAR CITY COUNCIL MEETING APt%IL 20~ 1970 OLD BUSINESS County, cont~o~ Mr. Michael moved that discussion of county control be removed f~om table, seconded by Mr. Wallace and motion carried 4-0. Mr. Michael cautioned the audience that we were fast being taken un- der metro-goverr~nent. Mr. Michael moved that the ownership records be maintained in City Hall and instruct the City Clerk to contact county office and re- solve the issue of a reasonable fee for service and report back to next Council meeting. Motion secOnded by Mrs. Jackson and motion carried 4-0. gulfstream Marina. - consider alternate proposal for fire protection Mr. Michael moved this not be considered because it has already been considered by appropriate board. Motion seconded by Mrs. Jackson and motion carried 4-0. Discuss proposed annexation of 265 ac~e tmact, west of High Ridge Road (gP the table) Mr. Michael moved this item be removed from the table and stricken from agenda. Motion seconded by Mrs. Jackson and motion carried 4-0. Receipt of prpposal from Hutcheon.~ngineers, Inc.- (left on table) Report on-Two George's building on FIND property (1) Survey Mr. Moore advised that at any point FIND requests the removal of the building it would have to be done. Mm. Michael moved that city pass resolution with intent to use the 55~ at the e~d of the sfreet as public property. Motion seconded by Mrs. Jackson and motion carried 4-0. .NEW. BUSINESS None. ~DMINISTRATIVE Proclamation - Armed Forces Week Mr. Michael moved that the Mayor issue Proclamation establishing May 10-16 as Armed ForCes Week. Michael moved that Building Depart- ment .be instructed to 'get in touch with the owner ar~ try to work out a-.different arrangement in regard to eo~aplaints ~ade about the Sign. Motion seconded by Mrs. Jackson and motion carried 4-0~ Mr. M. ichael mo. ved that the Council authorize going out for hid on and feno~g, the pistol range. Motion seconded by Mrs. Jackson motion Carried' 4-0. City Attorney recommended that we get ~ touch .with the begisla.t~..re and cheek into the possibility of Obtaining copies of proposed bills. ORDIN~.NCE - tst Reading 70-12 - Sign Ordinance City Attorney read the proposed si~n ordinance in its entirety (21 pages ). Mr. Timm requested a 60 day period to come up with an alter- nate~ Mr. Har~y LeFort made inquiry in regard to temporary signs. Employee of Fe~rin Signs commented on various items~ Mr. Michael moved that this ordinance which gives the City a start on a sign ordinance be approved on first reading and suggested changes can ~e made by putting request in writing to Council~ and considered two weeks from this date.
